Has anyone read the NC Statutes about the death penalty? Of course it has to be 1st degree murder but there are other elements that must be met to be considered for the DP. Scanning over the list I don't see "aggravating circumstances" being met. I just scanned the list so maybe I am mis-reading the statutes.

"the judge shall include in his instructions to the jury that it must consider any aggravating circumstance or circumstances or mitigating circumstance or circumstances from the lists provided in subsections (e) and (f) which may be supported by the evidence, and shall furnish to the jury a written list of issues relating to such aggravating or mitigating circumstance or circumstances."
 
I believe they've known he was guilty and even had part in ensuring the girls went back to Canada "temporarily".


ITA Maja. All I ask for at this point is a competent lawyer or two for Brad. I want him to get a fair trial and I want his counsel to be intellient and capable of handeling this case. I DON'T want Brad to have any excuses.

I recall a carved wooden sign over a Judge Advocate's office that read: Honest Lawyer.

I can't imagine they would ever disclose details of that sort.
 
I feel so sad for Bella and Katie. This is a tragedy on every front.

False. That would be malpractice and they could lose their licenses over purposely sinking a client's case.

2 people, who seemingly had everything to live for.... 2 children - now losing both of their parents.

2 people who married, kept up appearances, looked like a "perfect family" from the outside.

All the while hiding what would lead up to this tragedy.

There were so many other ways this could have ended. And almost all better than what's happened now. Money, control, abuse, finality. Neither NC nor BC could figure a better way out of this mess. What drives a person to think that killing another human being is the answer to ANY problem? Even if it took the 'four minutes' to kill her via strangulation - there was so much time to have this end differently. He could have stopped at any time. And yes - a physical altercation would have been "bad" for him in the divorce and custody - but what NOW? Is anything worse than this for Brad?

What did this action solve?

Terribly, terribly sad. Many lives destroyed.

I say this because I can't imagine them ruining the reputation of their practice over BCs custody case.
 
These killers ALWAYS believe they won't get caught and they'll get away with it. Always. They always believe they're smarter, more clever, wiser, able to fool anyone and everyone. And most of the time they're wrong. Very, very wrong. And they never seem to learn from watching those who went before them. Their wants/needs/rage is the primary source that drives them and damn anyone who gets in the way.

Well I guess everyone can put away their piggy banks for now...no bail.

That would not surprise me one bit. But they may know, they may not know, or they may have just guessed, but if they are DP certified, I would guess it would be a money thing. After all, I'm sure they have other clients, but they also have to be paid, and be able to pay their staff. Pro bono is a good thing, but you can't wrap your life around it.

I think K&B did what they had to, what they needed to do, and gave BC fair representation in the custody matter, and while they are bound to do so, they still need to look for the best interests of the children.
 
Maybe that will help him remember if that dress that Nancy wore Friday night was orange or green.

Too funny RC!! I went back to read the N&O article again and it now says that Brad's court appointed attorney will be Kurtz at the standard rate of a public defender.....
 
He really doesn't react to much, does he? The one thing I did notice was his very first appearance when Nancy was still missing...the far away look in his eyes and the look on his face was this look like "oh $hit what have I done." In that presser he looked a million miles away and in a hellish internal place.

I see that - $ 95 per hour and the state will not pay for prior attorney fees. Interesting.
