Here's the front page story from the San Francisco Examiner last September that talks about how the parents had evidence that Ayres was competent but were ignored and shut down by the DA and told that Ayres was not competent to stand trial. And now even the JANITORS at Napa can tell that Ayres is competent. Why couldn't the DA?

Kudos to San Francisco Examiner Mike Aldax for being the only reporter with balls to believe the parents last September and doing a front page story.
 
Just to give readers a comparison of how other DA's offices around the country stack up in convicting pedophiles - all of whom were arrested AFTER AYRES.

Jerry Sandusky case in Pennsylvania. Length of time from arrest to conviction: 7 months.

Dr. Scott and Dr. Mark Blankenburg, pedophile pediatricians in Ohio: Length of time from arrest to conviction on 79 counts of child molestation, possession of child *advertiser censored* and bribery: 9 months.

Dr. Earl Bradley, pedophile pediatrician in Delaware in one of the largest cases of child abuse in the history of the US. Length of time from arrest to conviction of molesting more than 100 children: 9 months.

I stole this from the William Ayres Blog because it struck me. These victims have been waiting a lifetime, and those are just the ones who havent killed themselves.

In the same blog I linked, it details an email from the mother of an Ayres victim who spoke with S, Wagstaffe after a surveillance video was shown to him of Ayres out at dinner with friends. Apparently his response, in a nutshell, was that if Ayres hadnt been using a walker, he would have retried him.

San Mateo paid the cost of Ayres visit to Napa. Cost it against a new trial.

COME ON, San Mateo!!!! Where is the outrage here?

More questions about the everchanging and contradictory stories coming from San Mateo District Attorney Steve Wagstaffe just one year ago about whether he was going to retry Ayres- a San Mateo County appointee for four decades, which included working for Wagstaffe's office :

Why did DA Steve Wagstaffe give San Mateo Supervisor Dave Pine on August 18, 2011 his "word" ( exact quote) that he was "strongly considering retrying" Ayres for mental competency? Pine exacted a promise from him that a retrial was still on the table.

What made Wagstaffe change his mind about retrying Ayres just two days later, after seeing actual EVIDENCE that Ayres was competent?

Did he know all along that he wasn't going to retry Ayres and then just happened to LIE to San Mateo Supervisor Dave Pine when they spoke?

Why did Wagstaffe hide out from reporters for two days after the surveillance surfaced?

Why, after promising San Mateo Supervisor Dave Pine on August 18, 2011, that he was seriously considering retrying Ayres- did he do a 180 with the mother of a victim just two days later? What changed his mind so qukckly and made him close off the option of retrying?

Surely if he thought he couldn't justify the cost to tax payers, he would have made up his mind about not retrying Ayres weeks before he spoke with Supervisor Pine.

Was Wagstaffe lying?

You decide. It wouldn't be the first the time the San Mateo DA has lied to people, according to defense attorneys and the citizens of San Mateo.

At least he is in jail where he deserves to be. Finally. He thought he was so smart, I have a feeling he just couldn't let sleeping dogs lie and was too proud of himself in Napa State at having fooled them that he couldn't keep quiet. jmo of course.
Hopefully, they will get the second trial going and the DA's office will use the information they were too lazy to go out and get before.
I am just happy he is now waiting in jail.

The nursing supervisor who oversaw Ayres' unit was among five other people who testified Tuesday. The supervisor, Sybil James, told the court that on more than one occasion Ayres had to be removed from the company of another inmate out of concerns he might be "grooming" him, a term used for the process by which sexual offenders prepare for a potential victim for abuse.

James said she and other staffers noticed Ayres spending time alone with the man, who is developmentally disabled. The man had previously been involved in an undescribed incident with another man that resulted in the filing of a police report. The developmentally disabled man was eventually moved to a different unit of the hospital for his safety.

Do you think San Mateo will find this somewhat compelling evidence of not only his mental acuity, but also of his guilt?
 
Well, the decision as to whether Ayres is mentally competent to stand trial now lies with Judge John Grandsaert.

Grandsaert used to be a prosecutor in the San Mateo DA's office, working with juveniles. There's a very good chance he hired Ayres himself, or was involved in cases where the defender for the juvenile hired Ayres.

Grandsaert has been under investigation by a government agency for over a year now for possibly conspiring with San Mateo District Attorney Steve Wagstaffe to keep victims out of a key and important hearing last year- a hearing where the DA announced that Ayres was incompetent to stand trial.

We all know Ayres was competent but the DA didn't want to deal with it. Told the mother of a victim last year that it wasn't helpful that Ayres was using a walker and they couldn't justify it to taxpayers.

The prosecutor just couldn't be bothered with the case last year. Closed off her mind to the probability that Ayres was competent. Because of her, the SAn Mateo's decisision to house Ayres in Napa State Hospital has cost taxpayers far more than a retrial for mental competency would have cost- a trial the DA said they couldnt win.

Also, if Judge Grandsaert decides Ayres is competent to stand trial, the DA could still decide not to retry Ayres. Remember: the DA hired Ayres over the years, as did the courts, probation, juvenile defenders, Children's Services.

If they had wanted to convict Ayres they would have put their most seasoned prosecutor on the case five and a half years ago- not one who is under investigation for misconduct.
 
Yes. I was seriously doubtful that this was going to be the case. I am really sorry for the victims that don't want to be a part of the next trial, it being too hard on them. I certainly understand. Will he stay in jail until the new trial? Never mind, I see bail is $900,000 and there is a hearing set.
I wonder if the police report regarding the "grooming" is available to the public?
 
The judge needs to step aside-surely there are some attorneys for the victims who might make a case for that.

If you cant trust the DA (remember prosecutor McKowan indicated that she does not speak for the victims....she speaks for the citizens of San Mateo County) and you cant trust the judge....
 
It was just a year ago that a relieved prosecutor told the reporters that she wouldn't be retrying Ayres. It was clear the way she didn't work on the mental competency issue in June 2011 that she just didn't want to deal with the case and didn't want to put the work in needed to nail Ayres.

Why on earth would any prosecutor make a remark like that? The parents were angered when they read it. She didn't put her all into the competency trial, and then just rolled over and gave up. She sounds relieved that he won....

Shame on the San Mateo DA's office for their behavior all around - and especially for their insensitivity to parents and victims

I've posted a comment on Mercury News stories by Aaron Kinney, the dufus who's supposed to be covering ayres, as well as tips to editors of local papers (Including the Merc)... No response, no weekend articles.

Too much detail in the SM Daily Journal article to have been printed mistakenly: it has discussion about the amount the bail was set at, and comments from the defense attorney AND prosecution about ayres making bail.
 
The Merc News is now reporting that ayres posted BOND, not bail, as the SM Daily Journal said. In some ways this is better... the ayres clan is now out another $90K. IF they're going to continue to support the perv, they should end up destitute by the time they're done.

I guess, at the end of the day, we dont know who is financing him. He sure has some friends in high places.
 
Ayres socked away a lot of money over the years.

Our concern is that the Judge- who is still under investigation- has not ordered a monitoring device for Ayres.

In Napa, Ayres told a doctor he wanted to get out of there, change his name and go into hiding with his wife. He also threatened suicide AND at the same time was grooming a potential victim.

The police in San Mateo will never put Ayres under surveillance. It's not a high priority case for them.
