The defendant did not display emotion and kept his head down as the jury was asked individually to answer whether or not their verdict was guilty of first-degree murder and agreeing that the allegation of the use of firearm was true.

Each juror said, “yes.”

Paul Kovacich was remanded into custody. He remained seated as court bailiff’s secured handcuffs around him.
He will appear again in Placer County Superior Court at 1:30 p.m. Feb. 20 in Dept. 4 in the historic Auburn courthouse.

I'm confused about this article... it says:
"Judge Mark Curry said a gag order, prohibiting anyone involved with case from discussing it publicly, will remain in place until a February hearing. The defense has issued a motion to dismiss."

What are they trying to dismiss?!?! He's been tried and convicted... you can't just dismiss the case as if it never happened...

Can anyone shed any light for this simpleton?!?!?

Yes, I saw that on page one of my Auburn Journal this morning.... thinking the same thing!! How can you 'dismiss' if the trial has already taken place.... strange indeed!!

Prosecution calls DNA expert in Kovacich hearing
Defense expected to bring more witnesses

Prosecutors recalled a DNA expert to the stand in an effort to solidify a murder conviction for Paul Kovacich Jr. Monday.
In January, the former Placer County Sheriff’s sergeant was convicted of murder with the use of a firearm in the Sept. 8, 1982 death and disappearance of his wife, Janet Kovacich.

Hearing continues at 9 am Tuesday in Historic Auburn Courthouse

In the motion to dismiss, public defender John Spurling asserted that his client was not able to present evidence or witnesses that could have helped exonerate him. During the hearing, Spurling brought forward witnesses to try to prove that point.

The prosecution has rebutted this claim and recalled a DNA expert to the stand during the hearing to solidify their position.

Court will reconvene March 18 at 9 a.m. in Department 4 on the 3rd floor of the historic courthouse in Auburn.
 
didn't make it to the first "dismiss" trial, and looks like I won't make it to the one this Wednesday... have a job interview!!!!

You know, there is no statute of limitations on murder... HOW did they think this reason would fly to overturn a conviction? :doh:

Judge Mark S. Curry in a hearing at the historic courthouse in Auburn rejected the defense’s claims that the former Placer County Sheriff’s sergeant was denied a fair trial because too much time had elapsed between the death of his wife, Janet, and his indictment.

In their motion to dismiss the Jan. 26 conviction, defense attorneys said evidence that could have corroborated Paul Kovacich’s version of events had been destroyed in the 26 years since Janet disappeared.
