Now that you mentioned it, why was CJ even allowed to visit the defendant?

The state or defense would have served her with a subpoena at least 30 days away from the trial date. So she certainly knew she was going to be called to testify, and so would CM.

Why was she allowed to discuss her testimony with the defendant of all people?

There is a good legal reason why witnesses who haven't testified yet, must remain outside of the courtroom until they are called to testify, unless the judge makes an exception which is usually for family members of the victims. Once that happens they can remain in the courtroom.

So hasn't her testimony been tainted by the defendant?

I was found by the defense in a murder trial and they didn't subpoena me because I willingly agreed to testify. I was told not to discuss my information with ANYONE, but they did NOT disallow me from seeing the defendant.
I was on the defense witness list and the prosecution had absolutely no idea why I was on it nor did they bother to talk to me. 1st trial was a hung jury, 2nd trial ended in a 5 year sentence.

I wonder why she hasn't been served with contempt of court. When CM started down that direction of testimony, she should have terminated the visit.
 
If he was home that evening, why was she calling him several times (and he not answering)? And how did his phone ping in Mira Loma at 9:32 p.m.?

Surely she explained that in great detail once the homicide investigation was opened after their bodies were found.

It's been said LE has interviewed her several times since the PH. So she already has had more than ample time to answer that very puzzling question in great detail.
 
Well, through the years she refused to change her testimony and even under pressure and threat of being arrested as an accomplice. She stuck to her story which was Chase and his phone were home when the last call came in. She was reinforcing her story to Chase which helps him. Chase has an alibi for that evening.

She is giving the father of her children the necessary alibi to keep him off death row. Of course she is going to stick to her story.
Just because someone has an alibi , it doesn't mean the alibi is true.

BBM - Since the preliminary hearing? or do you mean before the Prelim? It was said in the preliminary hearing she was interviewed many times, McGee said in court she was interviewed many times since Feb 2010.

Very tactful of you using the above statement instead of just say that he’s over the hill. IMO, the judge is no longer playing with a full deck. Time will tell the outcome of this ruling but hopefully, it will be a moot point.

No. I meant exactly what I posted.

Only a highly seasoned judge would be selected as the presiding judge over a death penalty case. One with much trial experience, and knows the laws as they are written, and how to apply them.

Sorry, I may be mistaken. I thought I had read on one of the trial threads they had spoken to her since the PH.
 
This reminded me to go and look up where they lived. Something in Chase and Cathy's jailhouse convo that I wasn't understanding was that he said something about going to the clubhouse to watch a movie and also mentioned a computer room. I also recall that he was interviewed in the clubhouse by Dugal/Fiske.

Does anyone know... did they live in the Terra Vista apartments? Is this them???

And yes, those apartments look pretty swanky. Too much for these two, who couldn't seem to ever pay their rent on time or keep even a $1 balance, in their checking acct. I wonder how many times, CJ and her kids had to eat Top Ramen for dinner, while good ol' CM was throwing around handfuls of $$$ at the casino's?

I have no idea, and I have not spoken to Cathy LOL I know about as much as you guys as far as what she has said... and that would be very very little. AFAIK she has never spoken publicly and we will not know anything unless and until she testifies. Would it matter what she says anyway? Most here have preemptively determined she is a liar anyway... much like Merritt's sister IMO Everyone wants to hear her but probably will not hear her. JMO

Excellent point! So was he in the clubhouse with his phone or was his phone at the apartment?

Well she is lying that much is obvious as Chase rung her after 9pm so how does that work exactly if they were together?

Thing is... we don't know what she is going to say or what exactly she has said in the past... and even knowing that we don't know, she's being called a liar IMO

I'm not talking about Chase, I'm talking about Cathy. Is Cathy to be faulted for Chase's past? That seems unfair IMO

You understand that his phone was not "off", right? You may want to go listen to Boles testimony on cross about the voicemail calls.
