It’s funny we really needed him cos this is a financial case but the government never looked for an accountant to tell them where the money went. You’re gonna learn about that. Our expert gave them a report, they hired one now. I guess we’ll see where that goes.

They're treating this as if Merritt isn't the one on trial.

RIGHT< that is funny now, looking at the OS. Because in cross, it came out that this witness didn't really look at where the money went. He just looked at ALL cashed out money from CM, and assumed it went to pay vendors and material costs, even if it was cashed out in casinos.

Instead of really trying to decipher where the money went, the accountant just made assumptions.

3600 bucks, taken out of a casino ATM, and this accountant said that money went to paying off MSMetal. When Rodriquez called him out on that assumption, in yesterdays exhibit, he said it didn't matter to him where something is cashed. And he had no receipts or evidence it evader went to MSMetsal---he just said it was close to the amount of the outstanding debt, so he attributed it to that debt. :rolleyes:

I hope the jury was listening to that specific exchange.

And he assumed cash payments into Kavanaugh's account were EIP sales revenue. :rolleyes:

This guy is feisty haha I think he has been a good witness for the defense, I don't think Rodriquez is doing as good as some think, but that's JMO He was able to say over and over and over again that the Provecho/Levine thing was off books, not included in the ledger. And if that wasn't good enough, the judge asked more questions about Provecho. I think it is just this guys demeanor... he seemed to be "annoyed" even yesterday when Maline was questioning him... will see what he is like when Maline does re-direct.

On another note... does no one else think it's funny that the defense is using Dr. Rudin now????:D:D I really can't wait to hear what he has to say, because it should give us an indication of why the State didn't call him.
She's doing an outstanding job of showing his bias and only reporting what DT wants reported and/or what shows Merritt in the best light, even though is very skewed.

I don't think it is that big of a deal it was off the books, not included in the ledger. It was in a side note, which is a reminder, a notation, of monies owed. And sent in an email, memo, right before the murders.
It was not in the ledger because of the long standing, strange turn of events, surrounding the situation. JMO

He was trying to blow it off since there was "no demand for payment".
 
The DT was grasping for straws and DK was the final one. Sounds like that didn't go well for them either. I live in Hawaii so the fact DK was here was.especially interesting to me. You guys may be right. DK may have been next and if I were him I might not feel safe even now.

I haven't visited your lovely state in many years, so I can't remember. Is it common, in certain "tourist-y" areas, for merchants to require a photo I.D., when using a bank debit card? I live in San Diego and have had to show one myself.
 
In some ways there is the comfort of doing stuff in broad daylight

DK didn't send himself money by deleting cheques, backdating and forging signatures.

He just changed Joey's pass and sent himself money right out of Joey's Paypal while Joey was known to be missing by many people

he had to have known that it could never have been believed Joey had authorised it

he simply was not worried about all of that

True, whatever DK did concerning the accounts after Joey disappeared he didnt do it in the cloak of darkness.

I've always felt the reason CM told LE if he had murdered anyone it would have been DK is because he couldn't manipulate DK. He knew SB would be an easy target. Yet he said he had never met DK, and actually thought he lived in HI fulltime.

So what could have made CM so mad he had murderous thoughts about killing DK?

Imo, he was livid when they did meet with Joey's mom. It scared her so badly she vividly remembered how heated it became between DK & CM.

So what made CM so furious he had murderous thoughts about killing DK too? Imo, the answer is simple. DK couldn't be manipulated like a distraught mom. DK refused to fall for CMs congame, and pay him more money for what DK knew he had already been paid for by Joey. Plus DK was already aware CM owed Joey 30K he had never repaid. If DK also was a con about somethings he could easily recognize another one. Although honestly I've seen no proof that what DK did afterwards was illegal. But he sure became the thorn in CMs side.

So here CM had already murdered a family of four thinking he had removed all his obstacles standing in his way to Joey's money. But he didn't consider the possibilty of DKs assistance, and involvement.

Imo CM was so sure Susan would rush to CM only begging for his help. Imo, he felt the family would plead with him to be the ONE to keep Joey's business afloat until he returned which would give him full access to the money.

One of the biggest mistakes he made afterwards was not considering who all may be involved with trying to save Joey's company.

DK afterwards became the biggest obstacle then standing in CMs way to get what he wanted.

Imo when CM mentioned murdering DK he meant it. He felt then he should have also murdered DK when he killed the other 4 because he realized DK had become the main obstacle standing in his way after he had murdered Joey.

#McStay - Juror #12 has been released. An alternate juror has been put in place. It's surprising that this is the first juror that needed to be replaced in a trial that has lasted since Jan 7.
