And maybe he didn't want to tell her yet? Maybe he wanted to be sure before telling her... she already didn't like Chase, it would just be one more reason not to like him. I could see Joey not telling her everything, just knowing what he know about Summer. She was no nonsense, spoke her mind, and didn't always get along with everyone because of it (it wasn't just Chase).

I totally agree. I think Joey may have kept the recent news about QB checks to himself, at first.

My husband was helping out his nephew, and I began to feel like the nephew was taking advantage of my husband's kindness and generosity...... I made my feelings known to my husband.

Later on, he found some fraudulent charges his nephew had made, using his PayPal card online. Dear hubby did not tell me about it, until after he had dealt with it, had the charges reported, and told his nephew to pound sand.

His reason for not telling me,...He didnt want me:rolleyes: to say I told you so or over react...

I can easily see Joey making the same husbandly decision...

In the CM tapes there is an interesting exchange at Day 10, Part 4, 7.25 minutes.
The discussion is about Feb. 4th. He is asked when did you last talk to Joseph. He immediately responds: I talked to him at his desk at home . . .

CM quickly seems to notice that the answer could be incriminating so he offers up without being prompted: I know he was at his desk because I could hear the kids in the background . . . He thus successfully turns the encounter into a call instead of a physical meeting. When asked about what time this was - he offered: about 5:00 or 5:30.

I might be indulging in confirmation bias, but I thought it to be a moment when the truth almost slipped out.

One more thing, I was glad to see the alternate who was injured yesterday show up for court. He really watches for CM's reaction to testimony, he watches that defense table.

Interesting info from the courtroom. Hope you continue to tell us more. I'm interested in who (e.g. which relatives) will be in the audience. I hope that alternate, should he happen to replace a juror during the deliberations, will not base his decision partly on his interpretation of CM'S reactions during the hearings.

I don't think it's confirmation bias. He wouldn't know where Joey was just by hearing kids in the background.

I think CJ and the kids completely support CM. When I attended day 9 of the trial, their oldest daughter was there. She was sitting front row behind CM, even conversing with the DT.
I know I've read she has been there other days as well.

MOO
Somewhere in the back of my thoughts I have had the impression that his oldest daughter had a different mother? Do I have this wrong? Remember very complimentary posts about her. That she was poised and lovely and well-spoken. Under the impression he had 3 younger children with his current wife at the time?

Another thing about CM's physical capability... in his interview, he said that him and Joseph went "paintballing" about 6 weeks prior but Joey had to stop because he wasn't physically able to do it, but he kept playing soccer (personally... I think soccer is more physical than paintball... but I have never gone paintballing lol). But this means that CM was physically capable of paintballing??? I wanna know more about this heart condition now LOL
Paint balling doesn't require a whole lot of physical assertion.

Yeah I can imagine some of it but these are for very unfortunate blocks of time, even factoring in sleeping time.

Boatload of cleanup and loose ends to tie up.

I was cleaning my bathroom today and dusting every little object and then I started thinking of the frenzied cleanup that was taking place at the McStays. It must have taken days to removed evidence, blood, fingerprints, etc.

I would think the juror, like most would, would consider all the evidence presented. That may or may not include the defendants reactions.

Running out the door and meeting Chase seemed to be common though, wasn't it? I am not sure how much they met in person, but we do know they spent a lot of time on the phone together.

I think it most likely happened that way too... Chase talked himself out of the jam at lunch time... they both left.... what I'm unsure of is if he maybe followed Joey? or waited to go there later? There is just something not adding up... whether it was Joey was gone before he got home or something in between that meeting and we just haven't been able to figure out yet, and may never figure it out.
Keep in mind that CM seems to have spent an inordinate amount of time with the entire family after they moved in to their new house. In his interview he seems to have had a bird's eye view of their family life. IMO, he injected himself into their life. He weighs in about Summer, the children ? Joey's relationship with his wife? All the while having a family of his own. I wonder how CJ felt about all his time spent with this family in those waning days? Did he come home and fill her in on his feelings about his BFF's wife and children? Did he tell her about the pizza debacle? Summer insisting the children use forks to eat their pizza? And, he being a bad influence? Can't help but wonder.

Paint balling doesn't require a whole lot of physical assertion.

Earlier in that interview ,CM stated JM was "sick/vertigo" and spent most of his time in San Clemente "bedridden," the two months prior to CM moving their stuff to the storage pods.

As much as JM used his phone, this could EASILY be debunked/verified with his phone records/movement during that time.

What if Joey gave him an ultimatum during the meeting?

Example: ' I know you are stealing from my account you sorry @#%&##, and if you dont bring me every dam* cent today you have stolen from me, I'm going to have your *advertiser censored** locked up!' 'I will give you until xxxx today to come up with all of the money, and not a minute later.'

That's what I am leaning towards. Joey, being the generous, laid back Cali type guy, probably gave Chase 'one more chance.'

I know, I was referring to Chase.

It wasn’t just CM who said JM was having health problems.

Snip

Joseph’s illness was well documented and had left his entire family completely baffled.

His mother Susan Blake gave an interview to Myvalleynews.com six weeks after her son’s disappearance, where she said she was very concerned about his health.

She said: 'My son had been sick since last August and he’s normally a very healthy person.

"He’s an excellent surfer and soccer player. I even went to the hospital with him to try and see what was wrong; we thought maybe it was stress.'

Mrs Blake described Joseph’s symptoms as something similar to vertigo and said he complained of feeling 'woozy'.

'When I last talked to my son, on February 4, he said he still didn’t feel good,' said Blake, adding that she had provided the Sheriff’s Dept with information on Joseph’s health problems.

His mother was not available to speak to MailOnline about Merritt's latest revelations. Neither was Joseph's brother, Michael.

But speaking on CNN in 2010 he said: 'My understanding was in the last year he’d been having these vertigo type symptoms. He was in the hospital for a couple of weeks, and on the (February) 4, he was talking to my mother and he had to pull over when he was driving home because he felt vertigo type symptoms.'

‘Joseph’s family are the ones who lost the most from all this, no question. But financially I lost everything. I was manufacturing all the waterfalls he was selling and I lost my entire business. Without his sales, I had nothing. I went bankrupt very soon after he disappeared, It killed me financially. I even split up with the mother of my three kids because of the stress.'

The first few sentences are very telling and possibly damning for the defendant. If he thought that he would 'lose everything' without Joey's sales, then he would be very angry if Joey had said something like ' I am not working with you again until you pay back some of the $ you owe me.' ---or something along those lines.

You don't think the side camera would have caught the vehicle driving by though if the Trooper was parked outside the house?

We don't know who or what drove by before 7pm because we don't have that video, but SD did look at her camera footage and took what they thought was important (which could mean they missed it lol) But like you said, maybe they did see one driving by and didn't think anything of it.
But the Trooper wasn't parked at the house.

But out of all these times, it's only the following times that we know for sure that he had his phone off/airplane mode/out of range because of VM's being left:

Thurs 4th

5.48 pm to 9.32 pm (3 hrs 44 mins)

VM's left at 6:09, 6:10, 6:12, 6:17,7:18, and 9:04pm with no tower information

Mon 8th

7.26 am to 1.31 pm (6 hrs)

VM left at 12:34pm

The inactivity is just that in my opinion. There is no way to know if it was off or not. Inactivity overnight does not seem to be out of the ordinary to me, as when I get home from wherever, I sometimes don't even know I got a text until the next day because I don't have my cell phone attached to me at all times, and I don't take my phone to bed with me unless one of my kids are still out of the house.

I went back to the testimony to see if there were other times/dates that his phone didn't register a tower.

During testimony, you can see other day's and times on the phone records, I caught these one's...

45:31 <<< 02/03/10 3 calls where it doesn't connect to a tower. 5:03 5:03 and 5:19pm - 2 look to be from CJ

52:25 <<< 02/07 between 12-12:27pm (looks like those times, have to watch and keep an eye on those lines as they go across the screen) can also see some that don't connect to tower.

I started this post about an hour ago and then got a phone call.. and now I have to go out and don't have the time to watch the rest of the testimony again, it's the first time I had noticed the 2/3 and 2/7 'no tower info' calls. Will try to look at the rest of the testimony later. I would also like to see if there is a pattern of CM/CJ calling each other lots, well, from what we can see anyway.

I was referring to whether JM was actually bedridden? Whether his phone calls were mostly made from his previous home, or if he was on the go? He seemed to make numerous calls from it on a daily basis. His phone records/movement will corroborate CM's statement, or not.
