WOW that got heated during cross examination. Tim Davis fired answers when Defense asked about seeing Kristin and Paul fall on the ground at the party. Sanger questions if he actually saw them on the ground or just on the floor//Davis said he heard a thud & saw on them on floor

Davis expresses his frustration by saying “25 years of this night and knowing that Kristin is gone and dead is a lot of weight on my shoulders.” Davis said he believes Paul is the only guilty person in this case.

“25 years of this night, knowing Kristin Smart is gone and dead is a lot of weight on me” Davis said referencing Smart being declared dead and clarifying he doesn’t know what happened to her. “I tried to do the right thing and help her,” Davis said.

Sanger started questioning Davis about his involvement and influence of media, to which he responds that he does not return the media’s calls and was not influenced by them.

Noting that Davis was “trying to do the right thing” by walking Smart toward her dorm that night, and is clearly not happy having to testify in court, Harry Mesick asked, “No good deed goes unpunished, right?” “You’re telling me,” Davis said.

Davis told the DDA prior to the preliminary hearing that “if this was Western justice, we would (shoot Paul Flores) and move on with our lives.” He told the prosecutor he wanted to “help put this guy (Flores) away” and that he’s “always on that side," the defense says.

Under cross examination, Davis said, “This has been a weight on me for 25 years” and he "would like this wrapped up." He warned prosecutors not to pursue a weak case, the defense revealed, because it “will piss a lot of people off, even more than they’re already pissed off."

Testimony resumes at 1:30pm. Not sure who's taking the stand next.

DDA Peuvrelle asked Davis whether the prosecutor instructed Davis to simply tell the truth in his testimony. Davis said yes. Davis said that after everything he’s learned since the night of the party, “I don’t see anyone else other than Paul Flores as guilty in this case.”

Davis admitted to telling Prosecutor Peuvrelle “I want to put this *advertiser censored***** guy away… I’m happy to do what every I can” but affirms he’s told the truth about the night while on the stand

Davis got visibly frustrated especially when defense questions his reason for testifying. Mesick accused him of changing testimony to help the DA

Ava Kershner @avakershner 4m
She told her roommate Justin Goodwin about it and he reported it to a tip line and later told her she should go on the Your Own Backyard podcast. Jen met with Chris Lambert in 2019 shortly before she met with Detective Clint Cole.

Matt Fountain @MattFountain1 4m
Asked by defense why she didn’t report the statement, she said, “I was terrified.” “When (he told me about KS), he had dead eyes, like there was no soul, like he was looking through me,” Hudson said. Cross continues this afternoon

Lauren @LaurenWalike 5m
Next, Jennifer Hudson took the stand. She said she saw Flores at a house with a skate ramp in SLO. After hearing hearing a PSA about Smart over the radio, she said Flores told her, “That *advertiser censored* was a d**k tease. I’m done playing with her. I put her underneath my ramp in Huasna.”

Ava Kershner @avakershner 6m
Jennifer said as soon as she got out of her car and recognized Paul, he asked her to go skinny dipping and she vomited. Sanger asked her to describe Paul and she said he was very pale with “dead eyes.” Jen never told anyone about her experiences until 2002.

“I didn’t want to be out there with someone who said they killed somebody,” Hudson testified. She didn’t tell the cops but told a roommate in 2001. He called the anonymous tip line.

Matt Fountain @MattFountain1 6m
She testified she was so concerned she left the hangout. When she was out in Huasna giving friends a ride to another hangout, PF appeared to take them to the skate ramp and she vomited, Hudson said.

Correction they were in SLO when the alleged statement was made

Ava Kershner @avakershner 9m
CW: Profanity After the PSA Jen said Paul said “The b****h was a d**k tease, and I’m done playing with her. I put her under my ramp in Huasna.” Jen then left only to see Paul at the end of the summer in a white four wheel drive pickup truck while takin people to said ramp.

Matt Fountain @MattFountain1 8m
Hudson said Paul Flores who was there said, “That b****h was a d**k tease and I’m done playing with her and I put her under my ramp in Huasna.” She said he was not joking and had “dead eyes.”

Lauren @LaurenWalike 10m
Hudson said Flores was not joking and had “dead eyes.” She left the handout right after because she was scared. This incident happened in the summer of 1996, but she didn’t tell anyone about it until 2002.

Our 16th witness is Jennifer Hudson. She testified that she was hanging with friends in rural Huasna in 1996 and a public service announcement came on the radio about #KristinSmart

Ava Kershner @avakershner 23m
After the break, witness Jennifer Hudson took the stand to talk about her experience with Paul Flores. She said that she was at a skate ramp in SLO in summer of ‘96 with Paul and a friend named Red listening to the radio when a PSA about Kristin’s disappearance came on the air.

I just got caught up reading.

I wish I could've heard the verbal exchange between Sanger and Tim Davis.

It appears Tim Davis didn't hold back, especially when he stated "he doesn't see anyone else but Paul Flores being the guilty person in this case."

What was the reaction from the accused? Anything or just that blank stare?

Sorry I have no idea why this came out in reverse.

The day ended with Hudson being asked about Paul’s body language when she saw him, which she said had no indication of being uncomfortable. Peuvrelle asked if Hudson felt guilty for not reporting it sooner, to which she responded, “Everyday.”

Ava Kershner @avakershner 38m
Sanger went through text messages between a Jennifer Hudson and Justin Goodwin. Mesick questioned Hudson’s experience with the podcast, she said she only listened to about 4 episodes in total.

Matt Fountain @MattFountain1 42m
“The possibility that I could have helped,” Hudson said, pausing as she held back tears, “I will never excuse my behavior for waiting and I know it was selfish and I apologize. ... As (Det.) Cole said, it’s better now than never.” We're dark tomorrow. Testimony resumes Monday.

Matt Fountain @MattFountain1 43m
Asked if she feels guilt for not coming forward sooner, Hudson said, “Every day.”

Matt Fountain @MattFountain1 44m
Harold Mesick, Ruben's attorney, attempted to paint Hudson as biased against the Flores’. Asked if she wants to help the Smart family, Hudson replied: “More than anything.”

Matt Fountain @MattFountain1 45m
Ultimately, she was interviewed and she and the roommate took Lambert out to the site where the Huasna skate ramp used to be for his podcast.

Closing the day out, Hudson under cross recalled how her former roommate contacted her in 2019 to tell her that he was interviewed for Chris Lambert’s #yourownbackyard podcast about Hudson’s admission. The roommate encouraged her to get in touch with Lambert, which she did.
