A note from Mr. Lambert's Hallway Blog from Day 6, August 10.

Quote:
EDITOR’S NOTE: After today’s lunch break, Chris Lambert was subpoenaed by the Defense. Judge van Rooyen denied Defense Attorney Sanger’s request to have Lambert removed from the courtroom. However, publication of the Hallway Blog will be suspended at Lambert’s own discretion until the matter is resolved.
Day 6 — YOUR OWN BACKYARD

I'm sorry but is Paul & Ruben's attorney certifiably insane?? The purple ties... the SCOTT PETERSON STUFF... I am blown away by how nonsensical this garbage is. He wants to distract the jury but I'm pretty sure none of this is enough of a distraction to get away from the fact that (in my opinion) it is obvious beyond a reasonable doubt what occurred that night and where her body was transferred to.

I can't answer your first question, I guess it's a matter of perception.

I think we'll need to get used to Sanger using something each week to distract those following the case and discussing PF and the evidence. Who knows next week maybe the chairs they're sitting in, or the lighting in the courtroom. Sanger will come up with something to try and keep us from discussing PF you know the one on trial accused of murder of Kristin Smart.

I wonder what motion Sanger would file if the DA showed up without wearing a tie?

Morris testified that both Cholla and Cirque did not have interest at any other place in Santa Lucia Hall besides Paul Flores’ room - Morris took both dogs through all 3 floors of the building.

After returning from lunch recess, Judge van Rooyen said the prosecution laid an adequate foundation for Morris to testify to the search of Santa Lucia Hall with her cadaver dogs Cholla and Cirque. Both dogs alerted at Paul Flores’ dorm room.

Morris stayed at the door and ordered her dog to work. They would run down and then alert at a door to show they wanted inside. They both alerted at dorm room 128. When in the room, both dogs alerted to the left side bed and desk. According to Morris, both were strong alerts.

Last to take the stand today for 15 min was Tim Davis, who helped Cheryl Anderson walk #KristinSmart to her dorm after the Crandall party in ‘96 before PF joined the trek home. Davis is expected to be the first witness tomorrow morning.

The defense also requested a hearing date of Aug. 25 to argue its motion to recuse the SLO County DA’s Office from the case. Neither prosecutor or lead investigator wore purple ties today.

A cadaver dog “gave me probably the strongest alert I’ve seen her do” in Paul Flores’ dorm room, its handler said on the stand Wednesday afternoon. That includes alerts the dog gave in other searches when a body was ultimately found, she said. https://sanluisobispo.com/news/local/crime/article253409930.html…

Still Missing - CA - Kristin Smart, 19, San Luis Obispo, 25 May 1996 *arrests* #2

8/11/21 Wednesday, Day 7 of Preliminary hearing: State witnesses: Adela Morris, cadaver dog handler. Defense attorney Robert Sanger argues Morris doesn't have proper qualifications, was unsure of Cholla's false-positive rate & wasn't able to testify about alerts leading to potential evidence; however, the judge ruled that her testimony would be allowed & testimony turned to the search of Paul's dorm room. Her dog, Cholla, aided in the search of Paul's dorm room. Morris says that her dog alerted right away to a door on the left side of Santa Lucia Hall, room #128. She says Cholla gave "the strongest alert she's ever seen her do." Morris says both of her dogs, Cholla & Cirque, "strongly alerted" to the left side of the room, specifically the mattress & desk. And other areas in 1996 following Smart's disappearance. Morris testified that Cholla alerted to a piece of plastic in a dumpster & showed interest around the Performing Arts Center & at the Arroyo Grande home of Paul's mother, Susan Flores.
Timothy Davis. He was one of the last people to see Kristin alive after walking with her, Paul Flores & Cheryl Anderson from the Crandall Way party on the night of Kristin's disappearance. The prosecution entered nearly 40 photos of 135 Crandall Way & asks Davis to identify them. His direct examination will continue on Thursday.
"This conduct not only has the appearance of impropriety but is in fact improper," Defense attorney Robert Sanger says in his motion. "The wearing of purple attire, from the lead prosecutor to the DA's investigator to the witness coordinator is a blatant representation of a 'party' & a community movement to convict Paul Flores." A temporary motion hearing is scheduled for 8/25/21. A representative from the State Attorney General's Office will need to be in attendance since the AG's Office would be handed the case if the motion is granted. Preliminary hearing continues on 8/12/21. No court on Fridays.

Tim Davis resumes testimony & describes walking Kristin Smart with Cheryl Anderson when Paul Flores “all of a sudden” joins them. “I have a really good memory of this b/c I’ve rehashed this over 25 years” Tim said about seeing Kristin laying on grass next to the Crandall house

“He was by himself in the darkness?” DDA Peuvrelle asked Davis. “Correct,” Davis said. “He came out of the darkness.” Cross examination expected this morning.

Matt Fountain @MattFountain1 7m
“At that point it seemed weird the guy was there. Most everyone had left,” Davis said. “He was kinda in the dark … and all of a sudden he was just there. I was like, who the hell is this guy?” David recalled.

Lauren @LaurenWalike 8m
Davis was walking with Smart and Cheryl Anderson. He said Flores walked toward the group out of the darkness near the Crandall house. Davis said he walked to the Health Center and passed Smart to Flores. Davis said Smart couldn’t walk on her own.

Paul joined the group, not being invited according to Davis. Davis was supporting Kristin on the walk while she was too intoxicated to walk on her own. Cheryl assures him he did not have to walk them all of the way up so he passes Kristin to Paul for him to support her.

PF “came out from wherever he was and joined our group of three,” he said. KS “was tired and wanted to go to bed,” David said.

Matt Fountain @MattFountain1 10m
At about 1:30am, he was getting people home when David noticed KS laying on the grass outside. Helped her up, started walking with her and Cheryl Anderson back to the dorms.

Matt Fountain @MattFountain1 11m
He recalled PF and KS falling to the floor about 5 feet in front of him at the party, and got up quickly, almost embarrassed

Ava Kershner @avakershner 11m
“They both seemed intoxicated,” Davis said. He remembers seeing Kristin laying on the lawn around 1:30-2am and it being noticeably cold, in the 50s he said. Towards the end of the party, he would plan to walk Cheryl Anderson and Smart back to the dorms.

Reporting for @CPMustangNews for the Flores Preliminary Day 8: Tim Davis starts the day as the first witness called, he reviews pictures from the house at 135 Crandall Way. He describes the night of May 24, 1996, the party, and what actions he saw from Smart and Flores.

Matt Fountain @MattFountain1 15m
He said PF was “very intent on being around (the girls at the party), being near them.” “He was, I would say, engaging as much as he could be,” Davis said of PF.

Tim Davis testified this morning about the party at Crandall Way on May 24, 1996. He said there were two people “who stuck out like sore thumbs”: #KristinSmart and Paul Flores.
