*Prelim Hearing (@ 8:30am PT) – CA – “NorCal Rapist” *Roy Charles Waller (58/31 @ time of first crime) arrested (9/20/18), charged & arraigned (9/24/18) on 12 counts of forcible sexual assault with enhancements (use of gun). Charges for the 10/13/06 assault on 2 women in North Natomas (Sacramento County). The new charges (1/7/19) include 9 counts encompassing a brutal attack against a Martinez woman in 1996. New charges (3/7/19) include 5 counts for 2 victims in Davis in 1997. Total 45 counts filed. Plead not guilty to all counts. Held without bond.
Prosecutors allege Waller raped the woman four separate times during the attack in which he dressed in a skeleton mask to pretend to be a trick-or-treater. Waller is also charged with digitally penetrating the woman, 1 count of oral copulation & kidnapping her with the intent of robbery. The charges include enhancements, including the use of a firearm & binding the victim. (see below).
DNA entered into “genetic genealogy” GEDMatch. DNA from straw matched the rape of 2 women in North Natomas. 15 year spree since 1991 to 2006. Starting in Rohnert Park 1991, then to Sonoma, Davis (1997), Chico (July 1997, 21 yr old w/blood evidence), Woodland (1997), Martinez (Oct. 1996 Contra Costa DA filed charges under “John Doe” can be charged now), Vallejo & Sacramento. Six counties involved: Sonoma, Solano, Contra Costa, Yolo, Butte & Sacramento. All will probably consolidated & tried in Sacramento County. Faces life term in prison if convicted.

R. Doe (July 18, 1997) Butte County: 1 count (
Count 25) of unlawfully seize, confine, inveigle, entice, decoy, abduct, conceal, kidnap & carry away R. Doe with the intent to hold & detain & who did hold & detain, the said R. Doe for ransom, reward, extortion & to exact from relatives & friends of said R. Doe money & other valuable things with a deadly weapon.
C. Doe (July 16, 2000) Yolo County: 1 count (

K. Doe (October 14, 2006) Sacramento County: 6 counts (
Count 32, 33, 34, 35, 36 & 37) of unlawfully have & accomplish an act of sexual intercourse with a person, K. Doe, against said person's will, by means of force, violence, duress, menace & fear of immediate & unlawful bodily injury on said person with a deadly weapon during the commission of a burglary (
Count 38) unlawfully kidnap & carry away K. Doe to commit robbery.
Y. Doe (October 14, 2006) Sacramento County: 6 counts (
Count 39, 40, 41, 42, 43 & 44) of unlawfully have & accomplish an act of sexual intercourse with a person, Y. Doe, against said person's will, by means of force, violence, duress, menace & fear of immediate & unlawful bodily injury on said person with a deadly weapon during the commission of a burglary & 1 count (
Count 45) of unlawfully kidnap & carry away Y. Doe to commit sexual assault with a deadly weapon.
9/24/18 Update: Arraignment appearance lasted only about two minutes. Waller showed no emotion & did not enter a plea. Waller is scheduled to be back in court on Oct. 30.
10/30/18 Update: His appearance was put off until Jan. 7th because his lawyers want the judge to bar media from using photos or video of him. Waller’s attorneys filed a motion asking Judge Jaime Román to “issue an order restraining the media from broadcasting or disseminating Waller’s image and likeness into the public domain,” a request that even the judge noted is problematic given the widespread use of photos & videos from Waller’s initial court appearance Sept. 24. The judge issued a tentative ruling denying the motion & noted “that his ‘image & likeness’ have already been captured by media coverage” & that the court “cannot properly grant” the motion. But he agreed to put the next scheduled appearance off until January, a move that gives media companies time to file arguments against the defense’s efforts.
1/7/19 Update: DA files 28 new charges. Involves 7 women in 6 counties, which will all be tried in Sacramento County. Now a total of 40 charges against Waller. Defense’s motion to bar media is denied. Next preliminary hearing on 3/8.
3/8/19 Update: pleaded not guilty to the new charges at the late morning hearing. He now faces 45 counts tied to nine victims in six Northern California counties for a string of attacks that stretched from 1991 to 2006. Next Pretrial hearing on 5/31 & 6/26.
