What purpose would DG have to keep deceased bodies for 24+ hours? He had all day of the 30th and the wee hours of the 1st to dispose of the bodies and he didn't. The aerial photographer captured what appeared to be fully intact bodies lying in the grass. I think they were alive during part or all of those 24+ hrs.

No, as far as I know it cannot be brought down to 2nd degree or manslaughter. Nathan was killed while being unlawfully confined and/or kidnapped - that's 1st degree.

The judge will give the jury instructions on what is available to them as options in this case. He will let them know if kidnapping and/or confinement are applicable in this case, and also how to distinguish between 1st, 2nd, manslaughter, and whether all of those are available. The kidnapping/confinement piece is much more complicated than it seems, since virtually all murders have an element of confinement to them.

The Timothy Bosma case wherein the 2 murderers took TB for a ride and never returned him... is a perfect example. The 2 men actually drove away with a live TB, and subsequently murdered him, however the judge ruled that the jury was not to consider confinement as a route to a first degree murder conviction.

In law, there are two routes to first-degree murder. One is evidence beyond a reasonable doubt that an unlawful killing was planned and deliberate, the other is a killing took place during an unlawful confinement.

At the start of the trial, before evidence had been heard, Justice Andrew Goodman told jurors both paths were open for consideration. During his closing instructions, he retracted that possibility.


“I am not offering any opinion on the facts as to what actually occurred in the Bosma pick-up truck in the minutes before, during or at the moment of Bosma’s death. The facts in this case are for you to decide,” Goodman said.


“However, at the same time, as a matter of law, you are directed that you shall not conclude or return a verdict of first-degree murder in this case by virtue of any accused person committing an unlawful confinement of Bosma. That route to first-degree murder is not available for your consideration.


“There is only one route to first-degree murder in this case. That sole route is if you are satisfied beyond a reasonable doubt on the entirety of the evidence that the murder was planned and deliberate.”


He did not outline the reasons for his ruling.

He didn't have the opportunity to deal with his "problem" until it became dark again? It was light on the morning of June 30th when he brought them to the farm. He started the fire in the burn barrel around 2-3am on July 1st, according to the neighbour.

ETA: He also had his parents to consider. His mother went out that day and returned. She could have come around to see what he was up to?

Of course that doesn't explain why they were out in the open at 9:20am the morning of the 1st. :waitasec:
