Whalen was “obsessive” of her time with Hill and would send “excessive” text messages to Hill as she was concerned Hill would find another partner, according to the court documents.

Hill directed racial epithets at Marissa and Whalen because Marissa’s father, who was not a part of her life, was believed to be Afro-Canadian.

Whalen would direct racial epithets at Hill, her children and family as they were of First Nations’ ancestry.

Marissa was the target of animosity, maltreatment and physical abuse from Hill and Whalen. Neither Hill nor Whalen stopped the abuse nor prevented the other from abusing Marissa.

Other acts of violence against Marissa, by Hill, included hitting, slapping, smashing her face into a wall and force feeding her food.

Marissa was made to stand against the wall or in a corner for long periods as a form of punishment and she would be struck if she did not do so.

There is also evidence Hill and Whalen would tie up or bind Marissa.

“Rainbow Hill and Amanda Dipota have effectively had their trial — they plead guilty, that’s their trial,” said Iain MacKinnon, who successfully challenged a ban that was imposed June 28 when Rainbow Hill and her sister Amanda Dipota pleaded guilty in connection to Marissa’s death.

“They agreed on facts. These were agreed by the Crown and defence. If the public can’t know about that, that in effect has become a secret trial.”

“Although these are facts accepted as proof beyond a reasonable doubt by the defendants ... such may not be evidence entered or accepted at the trial of Roseanne Whalen,” said Tucker.

“The facts and the plea of Miss Hill and Miss Dipota are not accepted as true by Miss Whalen at all, nor are they evidence or facts to be used to determine the guilt or innocence of Miss Whalen in her trial,” she said.

“She has plead not guilty and she will proceed with her trial on that basis. There has been no finding of her culpability in relation to the death of her child. The charges against her are unproven.”

Aug. 3, 2011: Women return to Six Nations area, remains dug up, bag, blanket removed, remains reburied, blanket, bag placed in gym bag;

Aug. 4, 2011: Women return to Six Nations area, burn gym bag in friend's backyard fire pit;

Oct. 16, 2011: Police recover parts of Marissa's body;

June 28, 2013: Rainbow Hill pleads guilty to second-degree murder, Amanda Dipota pleads guilty to accessory to murder;

July 15, 2013: Roseanne Whalen scheduled to appear on charge of second-degree murder;

Aug. 16, 2013: Hill, Dipota scheduled to return to court for sentencing

Video at the link gives some more details. They went to Six Nations reserve and made up a story about burying a dog. They texted each other about the "dog" and getting rid of it. Ugh.

OMG, that poor child. Treated worse than garbage. By everyone around her, including her own mother. Praying that no leniency is given to any of these women. IMO, there is no legal punishment that will be enough for this crime. Sickening.
 
what about the stepfather?! no charges for him? he was there. yes, he called 911 but he hung up when directed to and was there when the paramedics were turned away at the door

he had to know Marissa had died and he had to know who killed her and he had to have helped cover it up too

I wonder why the police didn't investigate then? weren't the paramedics supicious?

The two-year-old toddler died on July 29, 2011 at the hands of her mother’s lesbian partner Rainbow Hill who tried to cancel a 911 call and then “coached” other people in the house to lie to police and paramedics about what happened, according to an agreed statement of facts submitted when she pleaded guilty last month to second-degree murder.

Meanwhile, according to the court document, Marissa’s own mother Roseanne Whalen hid her dead or dying daughter in the basement while Hill and other family members “orchestrated this deception” of the emergency responders who showed up.

OK so the mother is in court today and I believe the publication ban on the statement of facts of the other two accused are still active right now. I was thinking about the details given r.e. Marissa's death and that there was a "loud noise". I doubt Rainbow Hill gave that as a statement, as if she doesn't know how she killed Marissa, a loud noise didn't kill her. I've read on facebook from someone who went to all the hearings that the real story is worse than what we have found out so far. The feeling is also that more people should have been charged, as I suspected. RIP little angel.

Wearing a white T-shirt and black pants, Roseanne Marie Whalen, 25, stood in the prisoner’s box and spoke to her lawyer briefly before her matter was adjourned for two months.

Lawyer Geoffrey Hadfield had the matter put over until Sept. 16 assignment court, but didn’t provide further details or reasons why it was moved to that date.

“There’s a good reason for that, but I don’t want to put it on the record for now,” Hadfield told the court.
 
The murder trial of a Fort Erie woman, charged in connection with the death of her two-year-old daughter, will take place in Hamilton.

Roseanne Whalen appeared in Welland Superior Court on Tuesday at which time the Crown's office announced it would not contest a change of venue application in a case which has made headlines since Marissa Whalen's remains were found near a rural area of Ohsweken, near Brantford.

Assistant Crown attorney Robert Mahler said the Crown was content with the defence counsel's request that the trial be heard in a Hamilton courtroom starting March 17, 2014.

The mother of this poor baby's trial is supposed to begin March 17th. She has plead not-guilty although her accomplices plead guilty. Apparently, she buried her baby and then dug up her body ! Her disappearance was not reported for months. Explain away, lady. Justice is waiting baby Marissa. xo

First time I've heard of this case or have seen a picture of this child. I simultaneously fell in love with her while my heart broke. I hope justice for Marissa is swift and powerful. And unrelenting.
 
Such a beautiful little girl...such a sad case....I would love to have adopted her....
