Casey defense team files motion to dismiss case--Could KC walk!

I find it interestiing that they filed these motins now..since they filed notice of unavailability and they also know they 2000 pages of docs are suppose to come out next week.

Sounds to me like they are trying diversion before the docs come out to the public.

It is like an "E" ticket ride at disney..yet almost more predictable. Will they get their way????

Not too long ago, Brad Conway came out to the media and said that BAEZ was preventing G & C from visiting KC, and that Baez was taking letters to KC from her parents ..... now Baez is saying that KC NEEDS family visits???!!!! Something is brewing .......
Judge S. has already addressed this issue also .... I think Judge S is going to get very unhappy with these repetitive motions and waste of his time.
Looks to me like the defense is DESPERATE for KC to talk with her parents and brother (UNrecorded) and get their stories in sync.

IIRC this may have something to do with a stop being put on lawyers giving family notes and vice-versa.... Am I remembering that right?

How can they say this: According to the motion, "the state deliberately misled the court and delayed formal identification of remains so it could obtain exclusive control of the crime scene through Dec. 19, 2008" the date the medical examiner announced the remains belonged to the little girl.

The skeletal remains was discovered Dec. 11, 2008 by a meter reader.

Defense lawyers said exculpatory evidence was not preserved and that violate Casey Anthony's rights. Exculpatory evidence supports a defendant's claim of innocence.

When they say they've already got "proof" she is innocent because the body was put there when she was in jail??????

Could the timing of this defense motion have anything to do with the fact that the 15 day deadline to produce the evidence 'that proves Casey's innocence' is fast approaching and no sign of the BOMBSHELL evidence as yet. Wonder where it could be?

Sorry, I should have put Henry Lee. He never testified at the trial because he was "busted" for having taken a piece of evidence (possibly a broken fingernail) from the scene. He claimed he didn't, the Judge ruled against him and sullied his reputation. Long story!

Exactly. If you're going to argue there's "no evidence" and the prosecution has the wrong guy, you have to do what you can to support that. If you don't take a plea, you usually try to get the case thrown out.

Here I personally think JB went about it the wrong way. He's at base arguing admissibility - that the state tampered with evidence so it shouldn't be admissible at trial. Or alternatively, that it's not believable evidence. Those both are questions of fact - admissibility for the judge, credibility for the jury.

Well all of it, you know, those trash bags and tape every little piece. Cuz that away they could have put things in their pockets if it looked like KC may have accidentally dropped something there when she was taking a run around the the neighborhood. KWIM??? Cuz I'm sure that Mr Baez knows all of KC's secrets. And if she accidentally littered while she was taking a run, well he could just move things like that out of the way.

AZLawyer, what do you think-

If you want to get the case dismissed when there clearly is some evidence, you'd first file a pretrial motion to suppress some evidence on 4th amendment grounds (LE searches), and motion in limine to exclude the scientific evidence for reliability.

THEN, if your motions are granted, a motion to dismiss based on the now lack of evidence. How many motions to dismiss do they think the Judge is going to want to read?

IIRC, Andrea Lyon had stated that she would be filing these motions after Labor Day.

Wanna bet that when we get to read them, it will be clear JB didn't write them? It will be easy to tell. If there are appropriate legal citations, he didn't write them!
