If they claim entrapment they'll need to explain just what it is that KC is being trapped about,

...and if they say she was distraught they have to explain how she knew it was Caylee.

Is that what is called a Lose-Lose situation?

I tried to quote the quote you quoted (ahhh)- SoCalSleuth- yeah, I just looked up the case we were talking about a bit back. Its Illinois v. Perkins, 496 U.S. 292 (1990) - in the case, the U.S. Supreme Court held that jailhouse questioning by an undercover agent that produced incriminating answers was admissible since it was not "coerced" and didn't violate Miranda - "strategic deception" is admissible evidence.

Another case - Arizona v. Maura - a suspect in custody was read Miranda rights, asked for a lawyer, and said he wanted to remain silent. A police officer was in the room, and the suspect talked to his wife - and his answers to HER questions were incriminating. It was admissible since there was no "interrogation."

Interestingly the dissent in Perkins complained that the ruling meant police could pose as priests to get admissible testimony - I wonder if that's ever been done?

ORLANDO, Fla. -- Investigators arranged to videotape Casey Anthony's reaction in jail when she learned that a child's remains were found near her family's home, a source told WESH 2 News exclusively on Thursday.

Anthony doubled over twice and appeared to hyperventilate, according to the source who has seen the tape.

Investigators say the tape shows Anthony's consciousness of guilt, because it was days before the remains were identified as her daughter Caylee.

WESH 2 News reporter Bob Kealing reported Thursday that Casey Anthony was purposefully taken to a jail nurse's station in December and seated where she could see breaking news coverage on TV about the child's remains. A video camera documented her reaction, a source said.

It was more than a week before the remains were identified as Caylee, who was reported missing last July.

Casey Anthony is charged with first-degree murder in connection with Caylee's death. She is in Orange County Jail on no bond awaiting trial later this year.

I'd like to think that it's obvious her reaction points to her guilt but I'm sure Baez will spin some carp about how she had a "gut feeling" it must be Caylee or "ZFG knew this location" "yada yada yada" Just sayin...
 
I am glad they released this news, just to quiet down the endless discussion of the meaningless '03 on the diary.
(I have a journal given to me, with a date inscribed on the hard cover...I have written in it a few times in the last 8 years...but it never changes the original date that was originally placed on the hard cover... I date my most recent entry, but not the year)
 
Well, to be fair (gag) I can imagine the defense would say the moment the remains were found there was instant and loud speculation that this was Caylee. It wasn't reported exactly neutrally.
 
She was taped! Cool. I've been critical of FL's ghastly sunshine laws, but I'd be lyin' if I said I wasn't looking forward to that doc dump!

Oh, and PS, I just love Orlando LE. Nice going. They know how she looks on camera...it was so clever to arrange to have one trained on her.
 
Wasn't that when the official ruling was made that the remains were Caylee? This was prior to an identification; at this point the news was just reporting that the remains of a child were found--and where they were found!

I think so. Anything she said to the chaplain couldn't be used, I don't think LE would arrange to videotape that so I'm assuming there were 2 different incidents.
 
Please, please let that tape be shown to the public. I can't wait to see it. She's a pure devil!

Yeah, you're right. And I think they'll say she connected the dots just like everyone else did. To be completely neutral, the bones at JBP didn't have tons of police/CSI there within 15 minutes - here, a skull was reported, so I am sure LE's reaction was much different than small bones from LP.
 
FINALLY, something that wasnt a LIE from that criminal. An honest reaction to the TRUTH of what SHE had done. I doubt we will see this video, not until the trial. This is too HUGE for the Prosecution. I LOVE IT. I cant waite to see JB response to this!

I'd love to see it though. As fast as the defense can spin hopefully the prosecution can spin better and faster. Her reaction might be so incriminating the jury will have no doubt. Hopefully......
 
This is probably a silly question, but with all the hippa laws and the fact that KC was in the nurses office, could the D claim that that tape cannot be seen? Was she brought there for medical treatment?:confused:

Nope...they were not video taping her medical treatment or assessment they were taping her reaction to the news. Also, there is no expectation of privacy anywhere within the jail complex.
 
I'm guessing JB's team will find a way to get the court to suppress the tape and not allow a jury to see it.
 
i think LP would help LE in any way they asked, but there are other ways of telling what kind of reaction casey had. how many people, upon discovering that the body of their child had been found would react w/ anger for example? it's possible casey was angered that her plans had been thwarted, and by caylee of all people!
i know it's not possible for us to feel like that, but we're talking about casey here.
she may also have been fearful, and not about finding out that it really was caylee, but by how this find would effect her case.
if his doesn't make sense i apologize. i'm running a faver, taken painkillers (always makes my head fuzzy) and i'm pretty sure what's left of my mind is wandering ....
