Right now, the preliminary hearing dates for this case are set for the week of February 23. There are three days set aside for the preliminary hearing, in which the prosecutor presents evidence to a judge using cross-examination of detectives and others with the intent of showing there is enough evidence to proceed to trial. Defense counsel cross-examines witnesses in order to refute the evidence presented.
The case could go to trial as early as this summer if there are no obstacles or issues raised in hearings in the lead-up.
Aldrich initially faced 305 charges. However, amended charges were filed on Jan. 9 and 12 additional charges were added.
Aldrich is now facing two additional counts of:
  • First-Degree Attempted Murder – After Deliberation
  • First-Degree Attempted Murder – Extreme Indifference
  • First-Degree Attempted Assault – Serious Bodily Injury with a Deadly Weapon
  • Attempted Assault – Extreme Indifference
  • Bias Motivated Crime
  • Crime of Violence

An El Paso County courtroom was tense on Friday afternoon when an attorney representing the alleged Club Q nightclub shooter, Anderson Aldrich, got into it with Judge Michael McHenry regarding a request to continue Aldrich's preliminary hearing.

Joseph Archambault, one of Aldrich's defense attorneys, told McHenry that he and his legal team wouldn't be ready for the preliminary hearing date of Feb. 22, due to the "voluminous" amount of discovery and a very busy schedule between now and the hearing date.

McHenry was not very receptive to the arguments presented by Archambault, and ultimately refused to grant a continuance, asking Archambault why this busy schedule was not brought up at a previous hearing.

McHenry went as far as to say if Archambault is too busy between now and Feb. 22 to review the discovery, that perhaps he should "ask his supervisors" if a different attorney can be put on the case.

"You're going to be here on Feb. 22," McHenry said to Archambault. "You aren't entitled to review every page of discovery for a preliminary hearing ... and I know you're fully aware of that."

Twelve new criminal charges were also added to Aldrich's case after a motion from Allen was approved by McHenry.

Aldrich appeared in Colorado's 4th Judicial District Court on Wednesday as well, where Judge Robin Chittum dismissed a request from the defense to hold former El Paso County Sheriff Bill Elder in contempt for allegedly leaking sealed documents to the media.

 
COLORADO SPRINGS, Colo. (KRDO) -- The accused killer in the Club Q mass shooting appeared in court Friday at 2 p.m.

In a motions hearing, Fourth Judicial District Attorney revealed exhibits he plans to bring to trial. Allen told Judge Michael McHenry he will hand over the exhibits to the alleged shooter's defense team by February 3.

Included is surveillance video from inside and outside of Club Q as the alleged shooter parks their vehicle, walks into the business, and when they are apprehended. Allen said he also plans to show body-worn camera from the first police officer who arrived at the mass shooting scene.

Allen added he would provide a list of witnesses he plans to call before February 3.

Anderson Lee Aldrich, who is nonbinary and uses the pronouns they and them, tried to pin the shooting on a man who subdued them while also claiming the shooter was hiding, Officer Connor Wallick testified. Officers didn’t believe it and shortly afterward confirmed that Aldrich, 22, was the shooter, he said.''

''Former District Attorney George Brauchler, who prosecuted the Aurora theater mass shooting case but who isn’t affiliated with the case against Aldrich, said if Aldrich illegally obtained the gun or guns used in the attack, that would make it harder to plead not guilty by reason of insanity, if that’s what Aldrich chooses to do. Circumventing gun laws would show that Aldrich knew right from wrong, as would showing that Aldrich was motivated by bias, he said.
“Hate isn’t insane. Hate is a choice,” Brauchler said.

Defense attorneys have not publicly raised insanity or Aldrich’s mental health as an issue and they haven’t been asked to enter a plea yet. However, an insanity plea is one of the few options Brauchler said he sees for the defense.
“It’s not a whodunit. It’s not a what happened. It’s a why did it happen,” he said.''
