I think by process of elimination, the jury is going to believe that Mark turned it off.The first and only evening that Dylan was at Mark's house. November 18th.
I can't remember what was in the last text but I don't think the prosecution has claimed that Mark impersonated Dylan.
I don't think there is way to tell who shut Dylan's phone off. Mark didn't admit to it. JMO
Dylan was actively engaged in his text exchange with his good friend RN, about their plans for the morning. RN was asking more questions but Dylan stopped responding. [kind of like Morphew case]
The only 2 people that could have turned off Dylan's cell that night were Dylan or the defendant.
So let's say for argument's sake, that Dylan fell fast asleep and Mark turned it off for him. That wouldn't explain why Dylan wouldn't go with Mark the next morning to get dropped off at RN's, as planned. Especially if Dylan fell asleep at 8 pm.
But even if he overslept from that---why didnt he call or text anyone while watching Nickelodian and eating cereal at 9 am?
If any of the jurors have 13 yr olds, they will understand how vitally important friends are to young teens. Friends mean everything to them at that age. No way Dylan was going to ignore his friends the next morning and go hiking alone up a remote mountain instead of skateboarding with friends and a few hot girls.
