*Motions Hearing (murder & escape charges) (@ 8:30am MT) – CO – Gannon Stauch (11) (missing Jan. 27, 2020, Colorado Springs; found Mar. 17, 2020 in Pace, FL., Santa Rosa County) – *Letecia Lynn (or Leann) Stauch (36/now 37) aka Letecia “Tecia” Lynn Hardin & Letecia Lynn Hunt arrested (in Myrtle Beach, S.C. 3/2/20) & advised of charges (3/5/20) & formally charged & arraigned (3/11/20) with 1st degree murder of a child under 12, child abuse resulting in death, tampering with deceased human body & tampering with physical evidence. No plea entered. Held without bond. [see below for re-filed charges] .
Charged (re-filed 3/20/20) with 2 counts of 1st degree murder (after intent & deliberation), 2nd degree child abuse resulting in death, 3rd degree tampering with deceased human body, 6th degree tampering with physical evidence & 8 counts of crime of violence (firearm, blunt instrument, knife or sharp instrument & causing the death of Gannon). Held without bond.

2/26/21 Update: Divorce: Status conferencing hearing on 3/29/21 & permanent orders hearing on 4/30/21. Murder & Escape: Status hearing on 3/5/21.
3/5/21 Update: Murder & Escape: Judge Gregory Werner just asked Stauch if she still wishes to represent herself, she said yes. Stauch is now saying that she hasn’t gotten a chance to see any of the discovery. She said she isn’t sure now whether she wants to waive her Proof Evident, Presumption Great Hearing without seeing all of the evidence. Judge Werner appointed Colorado Springs attorney Josh Tolini as her advisory Counsel said he delivered about 1,400 pages of discovery to Stauch this week, but Stauch told the Judge that she hasn't reviewed the documents since jail staff confiscated them. The Judge ordered that a new copy, which redacts personal information of witnesses involved in the case, be provided to Stauch to review. DA Allen says they’ve subpoenaed less than 20 witnesses for the Proof Evident, Presumption Great Hearing & isn’t sure how efficient that hearing with be because Stauch is representing herself. The Judge now is saying they plan to cancel Stauch’s hearing scheduled for next week & move it to 5/20 & 5/21 @ 9am. This is the Proof Evident, Presumption Great Hearing that Stauch asked to waive last week & is now unsure if she still wants it waived. DA Allen said they’re putting all of the discovery on a portable drive to be kept in the law library jail for Stauch to access. Stauch is now saying she only has access to the law library for two hours once a week. The Judge is basically saying that she knew there would be issues with representing herself & she’ll have to figure it out. Advisory Counsel Josh Tolini is now saying that Stauch is in a cell by herself & she should have access to paper copies of the evidence in her cell. DA Allen is now saying she’s had several security issues in jail, she’s tried to break windows with “common items”, and so he’s unsure if she’d be allowed to have paper copies of evidence in her cell. A representative from the El Paso County Sheriff’s Office is now saying that they do have significant security concerns over giving Stauch all of her paper evidence. The judge is now ordering the DA to supply 1,800 pages of evidence to Stauch in jail, he said if there are security concerns with that, it can be addressed later. Motions hearing on 3/12/21.

Any news of what happened today? Crawled all over Google looking for a link, couldn't find a thing.

Originally I had today and yesterday as hearings for Murder and Escape but that was scratched and was down as a motion hearing. Don't tell me, LS got kicked out for her constant carry on.
 
I found a couple of articles about today's hearing. The motions are about providing LS with case file papers and the problem person she is at jail. The judge ordered that she is to receive the papers and the sheriff's office is to work out their security concerns.

The Colorado community continues to honor the memory of a boy whose life was taken too soon.

On Friday, a memorial at Grand Mountain School, Gannon’s former school, was dedicated to the young boy. The memorial showcases a photo of Gannon and two quotes:

“Gone yet not forgotten, although we are apart, your spirit lives within us, forever in our hearts.” -Author unknown

“Every child you encounter is a divine appointment.” - Wess Stafford.

I found a couple of articles about today's hearing. The motions are about providing LS with case file papers and the problem person she is at jail. The judge ordered that she is to receive the papers and the sheriff's office is to work out their security concerns.

The main concern from the El Paso County Sheriff's Office at Friday's hearing was that Stauch may be getting more paper in her cell than originally agreed upon, and that could give her an opportunity to hide weapons or other contraband.

On Wednesday, Stauch's court-appointed Advisory Counsel, Josh Tolini, delivered roughly 100 pages of case law talking about a person's right to represent themselves.

Ultimately, the judge decided that Stauch will allowed to have as much paper as can fit in a standard 12x18x24 property box, which is protocol in this situation. She will have access to the 1,800 pages of case core that she was originally allowed to have in her cell, as well as additional paperwork brought in by her Advisory Counsel.

She denied her chance to go to the law library because she “had nothing to do there yet”?!?!
I can actually picture her saying that with a load of attitude.

she’s going to spin all sorts of crap about the courts and jail not giving her rightful access to what she needs for a proper defense. It’s a train wreck before it even begins ugh :rolleyes:
It will never end with this one.

I HOPE she attempts something like this, and thinks she's outsmarted everyone.

Then when she's busted...
this sham she tried to make of a trial goes on without her, and justice is swiftly served for Gannon and those who loved him.

Some have mentioned that they feel sorry for the Judge.
I agree but just wanted to share a case that he presided over in 2018 where there was plenty of crazy drama from the defendant and their defense team. Makes me feel confident that Judge Werner is up for the job here.

DA Dan May really wanted the death penalty in this case, the verdict resulted in LWOP + 171.5 years.

Galloway sentenced to life in prison after jury rejects death sentence

A trial that began with the defendant hurling a laptop across the courtroom had more drama Wednesday to kick off closing arguments.

Glen Galloway's attorneys are lashing out at the judge presiding over the case, claiming he has undermined their case and denied their client his right to a fair trial.

In a decision earlier this week, the judge ruled Galloway's attorneys could not argue self-defense in the closings, citing insufficient evidence for the claim. Public defender Kristen Nelson went so far as to demand the judge recuse himself for the decision, which she claimed went against Galloway's rights.

In the same ruling, 4th Judicial District Judge Gregory Werner accused the defense team of stall tactics throughout the trial.

The verbal scuffle came just before closings were scheduled to start. The jury was not in the room.

“Total disrespect for the court," May said. "He could have worn a suit to court every day. He chose to wear orange. He refused to stand for the judge, is my understanding. He called the judge some names that I can’t say on camera. He certainly said the same thing about some of my prosecutors.”

May continued, “He threw the laptop. At the time, everyone thought it was at the court reporter because it just barely missed her. I guess he clarified he was actually throwing it at the judge and that was his in terms of his behavior and character traits that came out.”
 
Well ... I just can’t with her... what a sh#& show this is going to be! The woman is ... well... can’t type the words I’m thinking ... so I’ll just say ‘unbelievable’. Praying that it’s all over with her behavior before she gets to speak directly to Gannon’s mom and dad ... and that she has no right to talk / interview his little sister. Except for the fact that a little boy was murdered by her... and she needs to spend her life in jail ... the rest is downright nonsense! MOO

Stauch had the opportunity to question Commander Gillespie while on the stand. It was her first time questioning a witness. She only had a handful of questions, one of which was asking Commander Gillespie if he knew why she had refused to go to the law library for one of her two-hour sessions recently.

He believed it was because Stauch had nothing to review, since no evidence had yet been delivered (besides approximately 1,400 pages, which were delivered without being redacted, and had to be destroyed before Stauch could see them).

Stauch says she actually denied the visit to the law library because she was told she would be kept in full restraints, meaning she would not be able to use her hands to do her work.

Commander Gillespie said they will have to make accommodations for Stauch in the law library, where she is not wearing full restraints and can adequately conduct her research. Judge Werner made sure to ask about that.

The Sheriff's Office objected to any other papers, besides the case core, being allowed inside the jail for Stauch. They requested other evidence be digitized. Plus, the District Attorney's office will need to deliver the evidence to the jail directly, to avoid calling Stauch's advisory counsel as a witness if there is a violation of chain of custody.
