Please explain....the defendant has not pled guilty...right? Even though his defense admits to the defendant did the shooting.

If he did admit to guilt, would the prosecution go for LWOP?

Is the defendant trying to be declared insane, so that maybe he can get out in 20 years vs LWOP and never have to spend time in jail? Much like Hinckley has done and gets lots of weekly passes?

Short answer...yes.

Longer answer...yes, I think so and yes.
 
He is pleading not guilty by reason of insanity, but the prosecution are going to argue he was not insane.

That is why the trial is predicted to be so long - there will be duelling psychiatrists arguing over whether he was or wasn't crazy.

Sorry I am not familiar with the US system or the CO system, rather, in order to be able to say off the top of my head what the legal position is re the possible penalties.

Yes...LOL - the talking head just said "no, it's not your computer" which I am thankful for because I was about to reboot!

Yeah about scared me and my little one half to death as I'm sitting outside Petsmart about to pick up my dog and have it streaming on Bluetooth!

I wonder what the parents of "that guy" think about this? Have they spoken publicly?
 
If jurors find Holmes not guilty by reason of insanity, he would be committed indefinitely to the state mental hospital. He could eventually be released if doctors find his sanity has been restored, but that is considered unlikely.
If jurors convict him, the next step is the penalty phase, during which both sides call witnesses to testify about factors that could affect why Holmes should or shouldn't be executed.

The jury would then decide whether Holmes should be executed or sentenced to life in prison without possibility of parole.

If jurors impose the death penalty, it would trigger court appeals and open other possibilities that would take years to resolve.

Yes they have written a letter which was released only very recently. They think he should be forgiven because he was/is crazy.

Our family has not given interviews to the media because we do not want coverage of ourselves. We mourn the deaths and the serious injuries and emotional trauma of the others who were in the theater. The focus should be on the injured and their healing.

I just can't imagine how painful some of these noises are for those of you who listen through earphones, etc. I have great sound on my computer, and I jump everytime!

Prosecutors, however, have so far refused a plea deal. Last year, Arapahoe County District Attorney George Brauchler rejected an agreement, saying that — for Holmes — “justice is death.”


I may be in the minority here, and it's not because I am against death as a penalty. It's just I think living behind bars and having no freedoms ever...that is more punishment than the easy out of death. Prison is no joke! But again, I know this may not be a popular opinion here.
 
Sorry I had to pop away for a few mins> A lady is testifying> She was hit by gunshot. She is describing what heppened> She is crying. She felt a heat sensation in her right leg. She saw the blood come up, and continued falling to te ground...everyone was screaming...

I know I keep quoting myself...

But today, one of the members of the Prosecution made a well deserved outburst, saying "If you want to avoid having to hear all of this testimony, then plead guilty!" (paraphrased)

Now I am confused again??
 
She noticed Suly and tried to reach...but could not quite reach him...names others Maria, Tony, Bryson, Annalise? - who were trying to get out of the theatre. She does not know how long al this took but 'it felt like an eternity'.

Thanks Corundogs. I can understand why the death penalty is being sought if he is convicted. I just hat to see him be sent to a mental facility and then get out. That is not right.
I will go search to see if the jury has to All vote for death or is it majority. Thanks again.
