Patrick Frazee murder hearing: 'Bludgeoning of cow' allegations made
A judge denied prosecutors’ last-minute bid to air accusations at trial that Patrick Frazee bludgeoned a cow sometime before investigators say he beat his fiancée to death with a baseball bat at her Woodland Park townhome.

On Friday, Sells said prosecutors won’t be able to detail allegations at trial that would have painted Frazee as someone with a violent history — including beating animals and being unsafe around children.

Patrick Frazee makes final court appearance before trial

During Friday’s hearing, a judge ruled the jury can hear statements Berreth made to her mother and coworkers about her relationship with Frazee, according to KRDO. However, that same judge ruled the jury will not be able to hear allegations that Frazee beat his cattle, saying it doesn’t have value in this particular trial.

During Friday’s hearing, the judge also heard from both the defense and prosecutors about the decorum ruling in the trial, which allows media and other people in the gallery to live-tweet their observations.

According to KRDO, the judge may update the order.

Frazee’s trial is expected to last three weeks and will begin on Oct. 28. 9NEWS will have two reporters in the courtroom and will provide updates throughout the process.

The lawsuit is being determined in the 4th Judicial District Court, which is the same entity that is working on putting on the Patrick Frazee murder trial later this month.

This week, Frazee, the Florissant resident being charged with the brutal murder of missing Woodland Park woman Kelsey Berreth, will be attending a pre-trial hearing on Friday morning. Frazee’s murder trial is slated to begin on October 28 and the prosecution has said that the trial could take three to four weeks.

Kelsey Berreth murder case: Trial for Patrick Frazee begins Monday
Kelsey Berreth went missing from her home in Woodland Park on November 22 last year. Since then, her disappearance has uncovered an alleged mistress, murder plots and brutal killing.

It was put on the record early on in the case that the DA's office was not seeking the death penalty. Fourth Judicial District Attorney Dan May explained the decision came after speaking with the Attorney General's office.

"We are not seeking the death penalty in this case, but we did consult with the Attorney General's office. It was their legal opinion that we had no aggravators," he explained.

The trial is set to start on October 28 and will last three weeks. Krystal Lee is anticipated to testify at the trial.

Media blitz expected for Patrick Frazee trial; national attention not new for Teller County
As the proprietor of a business advertising free water with healing powers in the heart of downtown Woodland Park, WH can’t help but get his fill of gossip from customers about the upcoming trial of Patrick Frazee.

But the dust devil the Frazee case has kicked up which begins Monday with at least four days of jury selection has nothing on the media maelstrom that snared WH back in 2001, he says.

Residents of the nearby town of Cripple Creek, about a 40-minute drive from Woodland Park, might disagree come Monday, when the media crush returns.

Opening statements are on pace for Friday or Monday, Nov. 4, and media outlets are expected to provide blanket coverage.

“It’s a rural area, and stuff like this doesn’t happen all the time,” said Bob Wibstad, 52, who lives in the same subdivision as Frazee between Divide and Florissant. “This has been the talk of the town for the last year.”

Another case that put Teller County under a microscope came in 1992, when 15-year-old Jacob Ind fatally shot and stabbed his parents as they slept in their home in an upscale subdivision of Woodland Park.

The Frazee case has divided Teller County’s notoriously independent residents.

Several people who knew Frazee and grew up with him told The Gazette they can’t believe he did it, and pin blame instead on Frazee’s mistress, Krystal Kenney, who is expected to serve as a key witness against him.

Cripple Creek is a town well-known to Frazee and his family. Those who don’t know him personally generally know someone who does.

“Personally, I think he’s getting shafted somewhere,” said JM, 84, who knew Frazee from the 2 Mile High Club. “I don’t think he’s that kind of guy. And that is the general opinion on the street in Cripple Creek. He’s a decent, normal guy.”

“We hope they fry his *advertiser censored*,” said DW, 52, a Teller County resident of 26 years, even though prosecutors are not seeking the death penalty. “We don’t like people treating our women like that up here. (In) Teller County, we like to think of ourselves as old-fashioned America.”

“Even if he comes out of this not guilty, he won’t be able to live in this town,” the bartender said. “There’s no way. They will run him out of here.”

Updates from inside the courthouse will be sparse. A judge has banned any live-reporting from the trial, including the use of Twitter to report on testimony.

Reporters will be able to file dispatches during just a few windows during testimony: morning break, lunch break and afternoon break. Anyone leaving to alert the public to breaking news — or to use the bathroom — will be barred from reentry until after the next break.

In this town of 1,200 people, some people wonder if jury summonses issued across Teller County for the trial could outnumber the town’s population.

Previously, prosecutors in the case said they wanted a jury pool of 250, noting that it may be difficult to seat a jury due to the publicity of the case. The defense, which had similar concerns, asked for 300, according to KOAA .

Twelve people will be picked for the jury, in addition to four alternate jurors.

Colorado judicial spokesman Rob McCallum said opening statements will begin no earlier than Friday, as they are expecting the jury selection to take several days.

The trial is expected to last three weeks. Prosecutors whittled down the number of witnesses from 255 to a significantly lower number in order to accommodate the trial, which was originally scheduled for three months, according to KOAA .

One of every 14 people in Teller County was expected to receive a summons for the trial, said Rob McCallum, a Colorado judicial branch spokesman.

In all, 1,750 jury summonses were sent to Teller County residents — 500 more than the entire population of Cripple Creek, the gambling town hosting the trial.

Of them, 12 jurors and four alternates will be chosen to rule on Frazee, 33, who faces several felony charges in connection with the killing.

Of the 85 potential jurors who came to court on Monday morning, 32 were dismissed by the lunch break for personal or financial restrictions. During the afternoon, the prosecution and defense individually questioned each of the remaining potential jurors, a process called void dire.

A vast majority of the potential jurors had seen some sort of news coverage of the case, be it on the local news, network shows such as 48 Hours, or on Facebook. This alone did not immediately disqualify anyone; instead, the prosecution and defense seemed more concerned about whether this coverage swayed their opinions about Frazee’s guilt, and if they could be impartial despite what they know.

Most of the 14 jurors who were dismissed after lunch Monday afternoon said they already believed that Frazee is guilty. Others openly said they didn’t want to serve on the jury. One member of the pool graduated from the same high school class as Frazee and had worked with him. He too was excused.

The trial is scheduled to last 18 days. Sells told jurors he anticipated it ending by Nov. 22, but that it could extend into the week of Thanksgiving.

- Do you have a strong opinion?

- Can you be impartial?

- Have you or someone you know gone through the justice system?

- Do you think the suspect is guilty?

- What makes you think the suspect was guilty?

- Does critical thinking make someone a good or bad juror?

- Has there been anything in particular that you’ve read about in this case that has kind of stuck with you or bothered you?

- Would you like someone like you on the jury if you were accused of something?

- Do you see the forest through the trees or the tree in the forest?

- Do you think the media always gets it right?

- Do you believe everything you’ve seen in media?

- Do you want to be on this case?

- What are your hesitations to being a juror on this case?

- Do you have a gut feeling one way or another?

How Berreth's disappearance evolved into a murder trial
Kelsey Berreth, 29, was last seen publicly on Nov. 22, after a quick trip to a grocery store in Woodland Park. The mother and pilot, though, wasn't reported missing until Dec. 2, when her mother, Cheryl, called Berreth's fiancé with questions.

The case took a turn toward the criminal realm, publicly, on Dec. 14. Law enforcement — including the Federal Bureau of Investigation, the Colorado Bureau of Investigation, the Teller County Sheriff's Office and Woodland Park Police Department — served a search warrant on the 35-acre Frazee Ranch in Florissant.

Search warrant returns revealed they found teeth and bloody sheets among dozens of other items, though it's unknown if any of that related to Berreth.

"We are asking Patrick to sit down with investigators since he is the last person to talk with Kelsey face-to-face, based on our investigation," De Young said on Dec. 14.

He faces eight total charges — two counts of first-degree murder, three counts of solicitation to commit first-degree murder, one count of tampering with a deceased human body and two counts of a crime of violence.

"Patrick kills Kelsey in a horrific manner, with a bat in the back of the head, as Kelsey is sniffing candles with a blindfold over her eyes," said Jennifer Viehman, lead prosecutor for the case.

Berreth's body still has not been found. Jury selection for the trial began Monday, and the trial will begin after the jury is seated. It's expected to last around three weeks.

Hundreds of potential jurors will walk through a tiny courthouse built in 1905. Here’s what that looks like.

Handling all of these would-be jurors has required the Teller County Courthouse to call in reinforcements. Some of these volunteers had a relatively short drive from neighboring El Paso County, but others came all the way from Adams County — a roughly 2.5 hour drive through sometimes windy mountain roads in wintry conditions.

The three prosecutors — including Fourth Judicial District Attorney Dan May — are seated directly in front of Judge Scott Sells. A clerk seated in front of the judge is tasked with writing what was said during the proceedings verbatim, which could amount to up to 90,000 words a day.

Frazee has not visibly shown emotions during this part of the proceeding, though he has intently watched all of the questioning.

All of the people who have been asked to return to final selection have been told to return to the courthouse by 8:15 a.m. on Friday, with a hope 12 jurors and four alternates can be seated that day.

The court plans to call back 90 jurors on Friday. Thirty five people were told to return on Monday, and jury selection is scheduled for until Thursday.
