Berreths seek justice; Frazee supporters optimistic ahead of trial

Frazee murder trial expected to start Friday
The trial of a Florissant man charged in the murder of his fiancé is expected to begin Friday.

A group of 91 people was chosen to participate in group voir dire. Voir dire is the process of questioning jurors from a larger pool to seat a jury.

No hearings are scheduled for Thursday. Friday morning, the court plans to begin group jury selection and anticipate that being complete to begin the trial Friday afternoon.

Each side would get an hour for an opening statements. Courtroom discussions show the state plans to call Cheryl and Clint Berreth, Kelsey's mother and brother respectively, to the witness stand Friday, according to NBC News.

The attorneys have whittled down the 1,750 people who received a summons for the trial in the Kelsey Berreth murder case to about 90. They're coming back on Friday for final jury selection, where 12 jurors and four alternates will be chosen. Reporter Jennifer Meckles was in the courtroom and is breaking down the process.

Kenney primed for key witness role in Frazee murder trial
At a Dec. 10 press conference announcing her daughter Kelsey was missing, Cheryl Berreth delivered a passionate plea.

"She doesn't run off, and someone knows where she's at," Berreth said.

She was right, and that person was Krystal Kenney.

"They want to tear down her credibility as much as possible, and what better way to do that then to say she's more involved in this crime than she's going to say, and that gives her the motivation to fabricate what the defendant, Patrick Frazee, did," Longo said.

FRAZEE TRIAL: "No body" murder trials carry high conviction rates
Tad DiBiase worked as an assistant U.S. attorney for more than a decade in Washington D.C. He said having evidence of the victim's body is a pivotal piece to solving a murder and charging the suspect responsible.

"The body is really the best piece of evidence in a murder case. When you have the body, you typically will know how the murder happened," DiBiase said.

However, statistics show it's not as much of a problem for prosecutors as one might think.

The Bureau of Justice Statistics reports so-called "no body" murders carry a conviction rate of 88 percent. That's compared to just 70 percent for murders where the victim's body or remains are included in the evidence.

DiBiase said the high rate, though initially surprising, is partially explained by the prosecutors' case selection.

"When a 'no body' case goes to trial, a prosecutor is only going to take the strong cases to trial, because there's such an obvious defense if you don't have the body," DiBiase said.

That's why the cell phone data used as evidence will be key, just as Mark Pfoff, a former El Paso County detective, told News 5 days before Frazee's arrest.

"Back in the 60s, finger prints were huge in helping to solve a case. In the 80s and 90s, DNA," Pfoff said on Dec. 18. "In the 21st century, cell phones and technology are the new DNA."

Frazee trial expected to begin Friday, what we know so far
Opening statements in the Patrick Frazee murder trial could get underway Friday.

The judge is not allowing any cameras, live reporting or sketch artists in the courtroom. FOX21 Daniela Leon will be giving updates when available.

The trial is expected to last at least three weeks. Frazee’s former girlfriend is expected to testify against him. If convicted, he faces life in prison without the possibility of parole.

Patrick Frazee, the man accused of beating his fiancé Kelsey Berreth to death with a baseball bat on Thanksgiving, will not be subject to the death penalty. Police believe Frazee was the last person to see Berreth alive.

The murder trial for the Colorado man who allegedly killed his fiancee last Thanksgiving is set to begin Friday, and the focus will be on the testimony of his girlfriend from Idaho -- who says he confessed to the crime.

Prosecutors have two hurdles in getting a guilty verdict. For one, Berreth's body has not been found since she vanished Thanksgiving Day near Woodland Park, a city between Denver and Colorado Springs.

Second, the main witness in his trial is an Idaho nurse named Krystal Lee Kenney, who was romantically involved with Frazee and is herself implicated in the case. After initially lying to FBI agents, she told investigators Frazee killed Berreth and that she helped clean up the crime scene and get rid of the body, according to a criminal affidavit.

For the past five months, staff at the 115-year-old Teller County courthouse have prepared for chaos and unprecedented crowds that a high-profile trial would bring to the historic building in this small casino mountain town.

The trial of Patrick Frazee — deemed the “trial of the century” by the local Mountain Jackpot newspaper — has drawn national media attention. Reporters from CNN, NBC News as well as staff from shows like 20/20 and Dr. Phil are expected to attend...

The storms that caused courthouses and government offices across a large swath of Colorado to close earlier this week did not prompt any change to the Teller County courthouse schedule. Court clerk’s office workers stayed in hotels in town Sunday night to make sure they’d be able to get to work Monday morning, Griffin said. A jury was sworn in on Friday afternoon, for the Patrick Frazee trial at the Teller County Courthouse in Cripple Creek. The process began Monday.

Each of the 90 potential jurors who were asked to return to the Teller County Courthouse following individual questioning earlier this week gathered in the Div. 11 courtroom Friday morning for probing by both the prosecution and defense. Fourth Judicial District Attorney Dan May asked multiple jurors whether they could believe a witness if they took a plea bargain.

Adam Stiegerwald, one of Frazee’s public defenders, asked the potential jurors repeatedly if they had seen media coverage of the case, and if that would impact their impartiality. At this point, all of the information released to the media has come from the prosecution, including the arrest affidavit and multiple search warrants.

“Do you think people who haven’t seen the news would give a fairer trial?” Steigerwald asked the potential jurors.

Over and over, potential jurors in Patrick Frazee’s murder trial said Friday they grappled with the enormity of the decision they would be asked to make if selected for the case.

The future of a man’s life hangs in the balance, one potential juror said. Another said the case had invaded his dreams since being called for duty.

The potential jurors on Friday were asked an array of questions, including how Frazee can have a fair trial with so much publicity surrounding the case and their thoughts on circumstantial evidence vs. direct evidence. The potential jurors were also asked if someone was killed, would their first thought be that the suspect may have been the victim's spouse?

Frazee, who in previous court appearances has worn the standard county jumpsuit, appeared Friday in a blue and white striped button-down shirt. He paid close attention to the jurors as they answered the questions and leaned in to hear them speak. In prior court appearances, Frazee looked down most of the time.

Jurors also expressed an array of concerns: the major time commitment for the trial, health problems, the overall enormity of the case, with such significant consequences for the people involved. Many of the jurors said they had not paid attention to media coverage of the case or didn't believe what media has reported.

I've been in Cripple Creek all week for jury selection for the trial for the murder of #KelseyBerreth. Regardless of the outcome, this is a sad situation all around. A positive that stuck out to me this week was how seriously the people in Teller Co. have taken their civic duty.

Lots of people didn't necessarily want to serve on the jury: it's a three-week commitment, and the jurors will only get $50 a day to hear all of the details about a tragedy. But, no one said this would stop them from serving.
