Nov. 22, 2018: What Patrick Frazee, Kelsey Berreth were doing on the last day she was seen alive
Prosecutors spent Tuesday morning building a nearly minute-by-minute timeline of what surveillance video shows Kelsey Berreth and the man suspected in her murder were doing on the last day she was seen alive.

Footage from the camera attached to the ATM at the ENT Credit Union shows Frazee pulling up at 12:42 p.m., according to Courtney. He spent eight minutes at the ATM. At 12:46 p.m., it snapped a photo of him looking at the machine with his baby daughter visible in the front seat.

Courtney said Frazee is next seen going into Walmart at 12:52 p.m. He left the parking lot at 1:13 p.m. Surveillance video from the furniture store shows Frazee’s truck headed toward Berreth’s condo at roughly 1:18 p.m.

At 4:20 p.m., Frazee is seen at the house once again holding the child. He’s also seen in surveillance footage at 4:24 p.m., 4:26 p.m., 4:27 p.m., 4:28 p.m., 4:29 p.m., and 4:30 p.m. During cross-examination, the defense attorneys pointed out that in the surveillance photos shown in court, Frazee isn’t seen with a black tote box. This piece of evidence is significant, since it is the container that prosecutors allege that Frazee used to store Berreth’s body after the murder occurred.

Courtney said Frazee was last seen in surveillance images at the furniture store headed toward Florissant from Berreth’s apartment at 4:34 p.m. She claimed that the tote box appeared to have moved in the bed of the truck, something the defense disputed during cross-examination.

The next piece of evidence about Frazee’s whereabouts came from his brother, Sean Frazee. He said that he had gone to his and Patrick Frazee’s mother’s home in Florissant for Thanksgiving, arriving at around 2:30 p.m. He said Patrick Frazee wasn’t there, and the family ate without him.

During her testimony, Cheryl Berreth — Kelsey Berreth’s mom — said she had never heard that the two had broken up. She said during one of her last conversations with her daughter on Thanksgiving morning, Kelsey Berreth claimed she had been with Patrick Frazee at his ranch in Florissant and gone to buy him medicine at Walmart. Cheryl Berreth said her daughter didn’t get home until around 4 a.m. on Nov. 22.

At the end of Tuesday's testimony, Slater said Patrick Frazee was paying Kelsey Berreth $700 a month in child support, but hadn't made a payment since July. This was not formalized with the courts, Slater said.

In addition, Slater claimed he found custody paperwork dated in August 2018 in Frazee's home that had not been filed.

CRIPPLE CREEK, Colo — Prosecutors spent Tuesday morning building a nearly minute-by-minute timeline of what surveillance video shows Kelsey Berreth and the man suspected in her murder were doing on the last day she was seen alive.

That day was Nov. 22, 2018 — Thanksgiving. Kelsey Berreth wasn’t reported missing by her mother until Dec. 2, seven days after her cellphone last pinged near Gooding, Idaho on Nov. 25, 2018. Patrick Frazee, Berreth’s fiance, was arrested in late December and is now standing trial for first-degree murder, solicitation to commit first-degree murder and tampering with a deceased human body.

Earlier in the day, Investigator Chad Mininger testified about footage collected from Berreth’s neighbor’s motion-activated security cameras. This footage, according to Mininger, showed Frazee outside of Berreth’s front door at around 1:23 p.m. Berreth is carrying roses, and a baby carrier was seen in photos shared in open court.

Mininger said this was the last time Berreth would be seen in any surveillance photo obtained by law enforcement. According to Colorado Bureau of Investigation (CBI) Agent Chris Adams, the last Google search on her phone was at around 2:20 p.m. for sweet potato casserole. In the arrest affidavit, investigators said Berreth texted Frazee and asked if he wanted sweet potato casserole that morning.

Mininger said Berreth’s neighbor’s surveillance camera had been activated by motion 27 times on Nov. 22. Frazee was in 11 of the images. During the days before and after her disappearance, Mininger said the camera had only been activated three or four times.

The next piece of evidence about Frazee’s whereabouts came from his brother, Sean Frazee. He said that he had gone to his and Patrick Frazee’s mother’s home in Florissant for Thanksgiving, arriving at around 2:30 p.m. He said Patrick Frazee wasn’t there, and the family ate without him.

Much of the narrative about the alleged crime hinges on the testimony of Kenney, a nurse from Idaho who claims she had been having an affair with Patrick Frazee. Kenney told investigators that he had asked her to kill Kelsey Berreth on three occasions, but she’s didn’t go through with it.

Kenney has pleaded guilty to tampering with evidence after admitting to disposing of Kelsey Berreth’s cellphone. In exchange, she is expected to testify during the trial, but prosecutors have not publicly said when that will be.

Sean Frazee said he was with his brother when an investigator asked him to give them his cellphone.

“I told Patrick to hand over his phone,” Sean Frazee said.

Investigators said in court that it was cellphone records that helped break the case.

Frazee's possible financial problems become focus of testimony
Sean Frazee, the defendant's brother, testified that he and his siblings are still in a legal battle for their late father's assets with an estimated value of $400,000. Combine that with documents seized from the Frazee Ranch showing Patrick essentially defaulted on a $70,000 loan, and other papers showing a possible custody arrangement, a picture emerges of money problems.

A separate look at Kelsey Berreth's financial records shows Patrick sent her $700 a month in child support from October 2017 until July 2018, but the last payment was $150 short. Prosecutors haven't said verbatim, but it sure looks like they're pointing to struggling finances as a key player in the case.

... Photos entered into evidence show Frazee at Berreth's door, first carrying a child and then him carrying an unidentified object.

The prosecution argues while the images may be distorted, it could show Frazee carrying a black tote container he's accused of using to transport Berreth's body. However, the defense argues you cannot see a tote in the images, pointing out shadowing on the camera that offers a distorted perception of the images.

Patrick's brother said he was with Patrick at Five Guys in Colorado Springs when police seized his phone. When asked by the defense why they were together, Sean said it was to deal with legal issues regarding the estate.

About seven minutes later, Frazee headed south on Fairview with a white dog carrier and black box in the cab. Later on using surveillance from the ENT ATM, the cab is determined to have a dog carrier and black tote.

Surveillance from the furniture stores shows the black tote in the back of Frazee's truck was moved between noon and 4:30 p.m. on Thanksgiving Day.

We also heard from a CBI agent. They were well aware by early December that #kelseyberreth phone pinged in Idaho. On Dec 4, 2018 they confiscated #Frazee phone and found it interesting he made several calls to an Idaho number- it allegedly belong to Krystal.

Star witness expected in trial of man accused of killing fiancée
A Colorado man accused of killing his fiancée in a vicious assault in her home is now on trial for her murder, and the prosecution, which has already called the defendant's brother to the stand, is still expected to bring its star witness: the accused's ex-girlfriend, who claims she was called to help clean up the alleged murder scene.

Kenney, who has not yet been called to testify, has claimed Frazee summoned her to clean up Berreth's home after the alleged crime.

She has also claimed Frazee had three plots for killing Berreth, including one that involved Frazee asking her to poison Berreth's favorite Starbucks drink, a caramel macchiato, an investigator testified. Kenney claimed she and Frazee discussed potential drugs that were easy to access because Kenney was a nurse, an investigator said.

David Felis, a Verizon store employee, testified Monday that Patrick Frazee came into the store on Dec. 4 asking questions about security of phone accounts and how information could be retrieved. Felis described Frazee as "extremely frustrated and upset."

PATRICK FRAZEE TRIAL: Cellphone records rebut rancher's claims, witnesses say

Cellphone records show that Patrick Frazee spent hours with Kelsey Berreth — or at least her phone — on the day she went missing last year in Woodland Park, further rebutting the Florissant rancher’s initial claims about his movements that day.

Prosecutors introduced the records Wednesday morning as they continued to nail down a timeline showing that Frazee, 33, spent far more time with Kelsey Berreth on Thanksgiving Day than he previously claimed.

Frazee's and Berreth's phones were together for at least the next 24 hours or so, as they traveled between Florissant, a ranch southwest of Cripple Creek, south to the Westcliffe area and back up to Florissant.

The records also showed calls between Frazee and his mistress, Krystal Lee Kenney, the beginning Thanksgiving evening and into the next day. Kenney was in Idaho on Thanksgiving Day and began driving to Colorado on Nov. 23.

Kenney arrived in Colorado on Nov. 24 and stayed less than a day before driving back to Idaho. She arrived in Idaho on Nov. 25, the records show.
