Camera spotted Frazee at Berreth's place 11 times on day of alleged killing, investigator testifies

CRIPPLE CREEK • A neighbor’s surveillance camera “captured” Patrick Frazee at his fiancee’s front door 11 times on the day she was allegedly beaten to death in her living room, an investigator testified Monday.

Only the jury can decide if it’s a smoking gun, however. In each case, the man had his back to the camera — leaving 4th Judicial District Attorney’s investigator Chad Mininger to essentially assert that the person is Frazee.

The images were recorded between roughly 12:30 and 4:30 p.m. on the day Berreth, 29, went missing — lining up with claims by Frazee’s mistress, Krystal Lee Kenney, that Frazee killed Berreth before showing up for Thanksgiving dinner at his mother’s house that afternoon.

At roughly 1:30 p.m., the man investigators say is Frazee, 33, entered the home with Berreth, who was carrying poinsettias, and their infant daughter, Kaylee.

“This is the last image I ever recovered of Kelsey Berreth, period,” Mininger said. Investigators say she was never heard from after that.

And when the man leaves later that afternoon, he is seen carrying the baby, Mininger said. The person on camera is wearing a light-colored T-shirt and ballcap.

Mininger was the last of 13 witnesses to testify Monday, and he hasn’t been cross-examined, so the defense hasn’t had a chance to poke holes in his analysis. That’s likely to happen when he resumes the stand on Tuesday morning.

The footage was captured by a home surveillance system installed by a neighbor, Mininger told the jury. To preserve memory, the system deletes the videos it records after seven days. But in this case, Mininger said he managed to obtain still images from the neighbor’s cellphone — left behind in the phone’s “cached” memory by automatic notifications she received through an application.

Mininger is expected to resume his testimony about the neighbor’s surveillance pictures at 8:30 a.m. Tuesday

Frazee Trial: Testimony to continue with forensic expert
Testimony will continue Tuesday morning in the murder trial of Patrick Frazee with the court hearing from a forensic expert with the District Attorney's Office.

The forensic expert will testify about surveillance photos from Kelsey Berreth's neighbor that he says shows Frazee was spending a lot of time at Berreth's home on Thanksgiving Day last year.

The last witness to testify Monday was an investigator from the @4thJudicialDA. He testified he was able to look at a neighbor’s security system which allegedly caught #Frazee at Berreth’s front door multiple times Thanksgiving 2018- day she went missing

DAY 3 LUNCHTIME NOTES:
- Defense Attorney Adam Stiegerwald was calculated in his cross-examination of a DA’s office digital evidence expert. He points out the neighbor surveillance video never once caught Frazee carrying a black tote or with blood on his clothes. Stiegerwald then tried casting doubt on the photos, as the shadows shifted dramatically, sometimes within the same minute. The expert, Chad Mininger, said it’s possible that cloud cover was responsible, though he isn’t an expert on that.

- The state called Sean Frazee, Patrick’s brother, to the stand, and his testimony was very interesting. His demeanor showed he really didn’t want to be here: quick, short answers and a subtle shyness. He says the kids (him, Patrick and Erin) are still in a legal battle for their late father’s assets, which he estimated at $400,000 including property. DA Dan May says that will come into play later. Sean detailed some parts of Thanksgiving Day, saying Patrick parked on the side of the house rather than out front. He also provided context on the time he was with Patrick on Dec. 4, when police took his phone. Sean asked if they had a warrant. They said no, but that they were getting one, so Sean told Patrick to give it over. When Sean was excused, I saw him look at his brother, turn his head and roll his eyes. He says they haven’t been close over the last 2-3 years and that he never knew Kelsey.

- Another DA’s Office investigator, Stephanie (spelling?) Courtney, has testified about her work tracking down Frazee’s whereabouts the day of Nov. 22. She analyzed video from Walmart, Ent Credit Union and the Williams Furniture Store (all in Woodland Park). The Williams video shows the black tote move in the back of Frazee’s pickup. It faces on direction before facing another four hours later.

Those are the main points that stand out to me. Again, I’ll shoot for a Facebook live around 8 p.m. (MT) or so.

Prosecutors have been working to establish a timeline of where Patrick Frazee was on Thanksgiving 2018 and what he was doing. We've gone through a lot of surveillance footage today that show him at #KelseyBerreth house a little after noon and then again around 4 p.m.

Kelsey Berreth murder case: Patrick Frazee's brother, a Colorado police officer, takes stand in murder trial
Patrick Frazee’s brother – who is a Colorado Springs police officer – took the stand Tuesday morning in Frazee’s murder trial and said he didn’t know what to think when his brother’s fiancé disappeared because he didn’t know her that well.

Sean Frazee, a spitting image of his brother albeit with a mustache, described his relationship with his brother as distant.

“I don’t know that we’ve been on bad terms, we just haven’t been close,” Sean Frazee said of his brother.

Sean Frazee said he arrived at the Florissant ranch about 2:30 p.m. on Thanksgiving. Patrick Frazee and did not arrive at the house until about 5 p.m., after the family had already eaten, he said. Patrick brought his and Berreth’s daughter, Kaylee, with him, Sean Frazee said.

Patrick Frazee previously had told his brother that he and Kelsey Berreth had separated, and on Dec. 3 Patrick Frazee told his brother that Berreth’s mother had reported her missing, Sean Frazee said.

“He explained to me that her grandmother was sick and that she may have been visiting her sick grandmother,” Sean Frazee said.

Patrick Frazee trial: Frazee's brother takes the stand as picture emerges of day Kelsey Berreth went missing

Sean Frazee said his brother, Patrick, arrived late — about 5 p.m. — to their mother's house and missed Thanksgiving dinner.

His testimony matched up with surveillance camera footage taken from outside Berreth’s townhome, which allegedly captured Patrick Frazee nearly a dozen times between 12:30 p.m. and 4:30 p.m. that day. It takes about 20 or 30 minutes to drive from Woodland Park to Frazee's mother's ranch in Florissant.

At the family home, Sean Frazee described a nice evening with his kids and his brother’s toddler, Kaylee.

“He brought Kaylee in and we played with her," Sean Frazee said.

He added that sometime before Berreth was reported missing, Patrick Frazee had said he and his fiancee were separated.

“He just said that they had not been together for a while,” Sean Frazee said.

Her mom, Cheryl Berreth, took the witness stand to describe her daughter’s childhood on a farm in Washington, with dreams of becoming a commercial pilot. Her brother, Clinton Berreth, said because of this upbringing, the two developed a close relationship.

“She was incredibly diligent in taking her time in making sure that what is a thorough process was completed correct,” said Raymond Siebring, Kelsey Berreth’s boss at Doss Aviation. “I’m referring to grade sheet requirements, flight requirements, and it seemed like it was something as stressful as it was — and it’s meant to be stressful — that it was handled well.”

“When a student graduates, part of their out-process is creating an end-of-course critique,” Siebring said. “She received plenty of accolades and positive reinforcements from students who just loved to fly with her.”

Frazee trial: Defense questions timeline of surveillance photos

When she sat down with Frazee, Huber said he told her he had last seen Berreth on Nov. 22. They had talked the day before about breaking up, but were both good parents to Kaylee. He said he gave Berreth her belongings back. As far as visiting her Woodland Park condo, he explained he had gone to the home on Nov. 22 to pick up Kaylee, but Kelsey wasn’t there, so he ran some errands and returned later that day. They exchanged the child in the alley, he told Huber. He then left, Huber said.

Frazee told her he didn’t have contact with Kelsey later that day, or around 4:30 p.m., Huber said. They talked on the phone later that day — Nov. 22, 2018 — as well as the following three days.

A few days after Thanksgiving, Frazee received a text from Berreth asking, “Do you even love me?” he told Huber. She said Frazee told her that he tried to reply, but later learned his text didn’t go through.

Court went into recess at 10:16 a.m. before returning at 10:35 a.m. Reed continued with Huber's testimony.

Huber explained retrieving surveillance video of Frazee and Kaylee in the local Walmart. She said she noticed large crates in the back of his truck.

Around 4:30 p.m., Patrick called the ranch’s landline and said he was coming but would be late. Sean said he arrived with Kaylee around 5 p.m. and made some food for himself and Kaylee. Afterward, Patrick went outside for some chores and to feed the horses, Sean said. After he came back inside, the family had dessert and Sean’s family left around 7:30 p.m.

When asked, he said he wasn’t sure if Patrick was on his phone throughout the visit. When May asked if Sean saw anything in the back of his truck, Patrick said it was parked out of sight, so he didn’t notice, but it wouldn’t have been out of the ordinary to see a black box in the back of the truck.

Sean and Patrick’s father passed away on Aug. 28, 2018 and his children were still going through his estate at the time. They still are, Sean said. About $400,000 is at stake, he said, including property.

May asked when Sean first heard that Berreth was missing, and he said Patrick told him over the phone on Dec. 3. Patrick mentioned that her grandmother was sick, so she may have gone to visit without telling anybody. He also mentioned that she had alcohol issues and had sought help before so she may have gone away to seek more help, but again, without telling anybody. ...

During that call, Patrick also said he’d received a call from Doss Aviation about canceling Kaylee’s health insurance because Berreth hadn’t been working enough.

When Sean was dismissed from the witness stand, he looked over at his brother, turned his head and rolled his eyes.

JM walked to the witness stand and introduced himself as a sales and delivery employee at Williams Furniture in Woodland Park. Memmer said he’s also in charge of cameras.

Just after 11:30 a.m., Investigator Stephanie Courtney with the 4th Judicial District Attorney’s Office was called to the witness stand. She’s worked with the DA’s Office for seven years and works in the special investigations unit. She was assigned to the case on Dec. 6.

He used an ATM between 12:42 p.m. and 12:50 p.m., Courtney said. A second photo from the ATM surveillance showed the back of his trunk, which also showed the dog carrier and black tote. The tote has silver clasps on the front.

Courtney said he doesn’t show up on the surveillance video until 4:34 p.m. as he drove south on Fairview. She noted that the tote in the back of his pickup was now in a difference position. He’s seen on surveillance video taking a right onto Highway 24 to head north toward Florissant.

The expert who compiled the images, Chad Meninger, said the method he used to find and timestamp the images meant things could be slightly out of order, but would be accurate within a few hours. Steigerwald also pointed out that none of the photos show Frazee carrying a large black box, which prosecutors alleged Frazee used to carry Berreth’s body out of the condo.

But footage from an ATM that Frazee visited just after noon on Thanksgiving Day showed a large black box in the back of his red truck, an investigator from the 4th Judicial District Attorney’s Office testified.

The investigator, Stephanie Courtney, also said that a surveillance camera at a local furniture store showed the box in the trunk. The various images also showed that the box moved or was repositioned in the trunk between 1:30 p.m. and 4:30 p.m. on Thanksgiving Day.
