This gets tricky, and varies by state. Generally when you have someone like a psychiatrist and they tell you about their desire to harm themselves or another, the psych has a duty to warn. There is a very famous case on this: Tarasoff v University of CA Regents, if anyone is interested.

It's even trickier when we get to priests; there is religious "law" versus our LAW laws and there have been different rulings over time. I'd have to look into CO law to see if, hypothetically, PF had confessed to his pastor, would that pastor be obliged to report.

Ahh, flashback to James Holmes.

What I don't understand is IF KK is talking and working out a plea deal- why isn't she already arrested? How long can that take? They served warrants in Twin Falls Dec 15th. Something glitchy here.
Maybe she ran to Safeway and then came back and jumped in the shower.
It was when she was in the shower, that PF and/or the killer(s) ambushed her.

Crime scene investigators removed some big pieces from her house. One
appeared to be a big curved piece that could have come from her shower.

IMO
Not wearing running gear. I can't imagine anyone running with baby carrier. That would be awfully awkward for the runner and probably not too comfortable for the baby, either. MOO.

Well, that's a question I have per the wrongful death filing- are the Berreth's saying that the abuse mentioned (emotional, suffering, etc) occurred only shortly before/during her homicide? Or are they saying that
there was a history of abuse throughout their relationship?
yes
I wonder that too

I lean toward ongoing.
you don't scheme up killing someone without some kind of precursor.

I agree! And, the death row cell block affords nicer amenities, often times. Single cells is one plus. San Quentin claims DR is the least problematic housing unit. Few inmate v inmate fights, etc.
Scott P seemed very chipper in the recently released video on Radar.

SP looks great, unfortunately. I know an investigator from out of state who had to go to San Quentin to escort a prisoner back to Virginia who was going to be prosecuted there for a murder. He said he saw SP and the guy looked happy, healthy, and was playing basketball with his friends, as if he was at summer camp without a care in the world.

I was thinking about when murderers confess their crimes to a priest or therapist. Is it that they have a duty to warn LE if the crime has yet to take place? Must they tell LE about the killer's confession if the murder did, indeed, happen?

Ugh....IIRC if confession is done during the sacrament of confession than no, the priest will violate Canon Law and will be excommunicated.

I would with the carrier attached to the stroller... but makes me question, where was her stroller. I would just put my groceries in the bottom basket of the stroller.

He's gonna wait to see if PF pleads guilty; I don't believe he's been arraigned?

He's got 63 days after that to announce. At this point, the 1/29 date has been vacated and prelim is scheduled for 2/19, so he's going to have to enter his plea at some point before prelim. I thought I read somewhere that in CO advisement is the same as arraignment? I don't recall him entering a plea yet though, so I'm a tad confused on that.

I don't see a reason why May would announce this now when he has nine full weeks after the entering of the plea. They have time to gather more evidence and really decide if this is going to be a DP case or not.

Thanks for your response, rio! So if the prelim hearing on 02/19 is the arraignment, the DA will have until somewhere around 04/24ish to announce whether the state will be seeking the DP.

He will enter his plea before prelim, not on the day of. I am not sure when. I need to look into this for CO law and get back to you.

But yes, 63 days from when he enters his plea.

ETA I'm seeing some articles saying he was arraigned last Monday? Is this true?

Why doesn't this surprise me at all? Not one bit.

I have not heard that PF has entered a plea yet, either!

Amazing, huh? Not really, tho. I’ve studied a lot on life in prison. I’ve posted my opinion. It’s not as bad as we think. It’s almost a military like environment. The guys adapt. They have no choice. I think few ever think about their crime. They create a new life amidst men that are in the same predictament.
PF might be like SP, preferring to be the innocent, wrongly accused man. I think SP could not plead because he could not utter “guilty, your honor” in front of his family.
MOO

I'm just thinking out loud here.....so PF ses to KK, You come for Thanksgiving. Then x happens (did she even know?), and you (KK) leave, taking this phone with you that I want you to turn on in Gooding. And then pitch it.

All while riding in an Uber? (I'm still having a hard time figuring out the Uber connection)

How is this not conspiracy? Even if KK didn't know why the phone was given to her. Like as if PF said, I can't tell you, if I tell you, I'd have to kill you.

This plot. Too thick.

How did she come to CO? Another Uber?
Expensive. Something doesn't add up.

the dump trip interests me a lot.

-the depot rang the cops
- the cops were already watching him
- PF was aware the cops were watching him.
-he doesn't touch any of the rubbish disposed at the dump.
- two mates do all the dirty work.
- 2 days later PF is arrested.

there we have 3 people on LE radar as part of his narrative.

moo
Maybe he just didn't want to get out of the truck since he knew the media was there. I'm sure they questioned the two others. Imo

If he was so stupid to dispose of evidence, he should have jumped out of his truck & put his hands behind his back, moo
