Kelsie Schelling murder: Police present more Donthe Lucas interviews

A potential mistrial was averted Thursday morning in the first-degree homicide case against Donthe Lucas.

The trial has been underway for 12 days, in which prosecutors have called dozens of witnesses to tell jurors of the disappearance and likely death of Kelsie Schelling, who was 21 and pregnant at the time of her disappearance from Pueblo in 2013, and of Lucas’ possible involvement in the case.

However, on Wednesday news broke that an endorsed witness for the prosecution, Roxann Martinez, had been shot to death in a neighborhood in Denver, where she lived. Judge Thomas Flesher, who is presiding in the case, asked the jury if any news reports had crossed their paths. In answer, four jurors indicated they had seen information outside of the courtroom.

After a lengthy break to allow for questioning of those jurors and ensure that there was no need to dismiss them or call on alternate jurors to take their seats, the trial resumed.

A videotaped interview of homicide suspect Donthe Lucas speaking to Pueblo police detectives in November 2017 was played on day 13 of his trial on Friday and showed Lucas admitting to moving the vehicle of his alleged victim, Kelsie Schelling, to St. Mary-Corwin Medical Center.

For years prior to this admission, Lucas had maintained in statements to police it was not him who had moved the vehicle and was not him seen on grainy surveillance tape parking the vehicle in a parking lot adjacent to the hospital on Feb. 7, 2013.

During two interviews with Purvis and Wager on Nov. 14 and Nov. 15 of 2017, Lucas said he and Kelsie were still “pretty twisted” from consuming drugs and alcohol the night before — he stated he had snorted “two or three” lines of coke, smoked marijuana and drank Crown Royal and Schelling had consumed prescription pills — the night before his mother, Sara Lucas, came to pick up his grandmother and confronted him about sneaking Schelling into her home on Manor Ridge Drive.

He said Sara Lucas “cussed me out” and then left with his grandmother, seemingly, he said, to either pick up or take Lucas’ younger siblings somewhere.

He stated after his family members left, he laid down while Schelling, took a shower and when he woke up, Schelling was gone.

I can't fathom how frustrating it must have been for investigators to listen to these lies -- over and over again!

“She’s not texting anyone else, sje’s not calling anyone else, she’snot going to see anyone else. There’s no other possible suspect in the five years other than the person she’s calling up.” investigators told Lucas in an interview from 2017 played for jurors on Friday.

Investigators then asked Lucas about discrepencies in his story in the Schelling case – specifically regarding her phone

“These are some problems,” one investigator said. “Evidence like phone stuff shows the phone was with you for days and when we say that, that’s bad. You tell us all this stuff, then it clocks out at the moment we feel she died.”

For several days, from the early morning hours on February 5, 2017, until Schelling’s phone stopped pinging on February 7th, it would constantly ping in the same area as Lucas’ phone but, at the Canon National Bank for instance, Lucas was seen alone while taking $400 out of Schelling’s account.

“I’m just trying to wrap my head around,” Lucas responded. “I made it very clear I’m not 100 percent on everything like times,” Lucas said he and Schelling used marijuana, cocaine, and alcohol the last night he saw Schelling and said cocaine was the surprise for Schelling.

A long list of friends testified that Schelling never used drugs, hardly partied or drank alcohol and her mother Laura Saxton testified, was only on medication for her mental health.

In the series of two two-and-a-half hour interviews following his arrest at DIA in 2017, Lucas admitted the two never went to Parkview Hospital, a key part of his story to investigators in five statements and interview given to law enforcement in 2013.

Instead, Lucas said, the two were trying to get drugs. No text message conversations support the story.

Jury deliberations are now underway in the murder trial of Donthe Lucas, accused of killing his pregnant girlfriend, Kelsie Schelling, who has not been seen since February 2013.

Monday's proceedings started with the expectation of the defense calling witnesses in favor of Lucas. However, the defense rested without calling a single witness.

Prosecutors then started closing arguments by reminding the jury of texts, surveillance video, and witness testimony already presented in the trial. The team argues there was plenty of time to effect a cover up between the last time Kelsie Schelling was last seen and the first time police interviewed Lucas.

During closing arguments, a defense attorney told the jury "this (case) is the biggest stretch in Colorado’s history". He questioned whether Kelsie Schelling is really dead, since no DNA was found.
