I'm just wondering if they've officially ruled this an accidental drowning? I'm really curious about the shoes being in the creek and not on Nain when they found him.

I'm curious about him still being alive. I don't understand how that's possible.

This source says yes. I can't find any other sources confirming this update though, which seems odd. I'm kind of surprised they have concluded the investigation so quickly.

The El Paso County Sheriff’s Office shared new information on the death of Nain Dominguez, a toddler who went missing in Colorado Springs on March 17 and died at a nearby hospitals hours after being found on the morning of March 18. “Our Sheriff’s Office investigation is complete. There doesn’t appear to be any criminal element. It is an accidental drowning,” Jacqueline Kirby, the Office’s information officer told PEOPLE CHICA. “It’s a horrible tragedy and our thoughts and prayers go out to the family. I can’t imagine what they are going through at this time.”

None of this answers how they missed him in the initial search. Very surprising as to the speed of this conclusion.

I think it may be because they are not dead until they are warm and dead. (I am sorry if that is too blunt. :( )

Indeed that is the rule for winter/water and winter/hypothermia events. One is not declared until the core body temperature has been brought back up to level. Many a persons have been successfully revived in such situations, some with no long term health effects -- especially when entire body is submerged very quickly and experiences a sudden, rapid decrease in core body temperature.

Moving water pulls clothing and shoes off of bodies :(
