The victim is described as a Caucasian or very light-skinned Hispanic male, approximately 5 feet, 4 inches to 5 feet, 6 inches tall, weighing between 180 and 200 pounds. The victim was less than 35 years of age and by all indications an agricultural or ranch worker. The victim was of a "stocky" build and appeared to be in good physical condition. The victim was wearing blue jeans size 36 inch waist and 30 inch length as well as a pair of brown lace Ariat work boots, size 10 1/2.

Russell Britton was formally charged with first-degree murder and four other felonies today in connection with the shooting death of Nathaniel Tallman, the Lafayette man who was missing for nearly two months before his body was found in Wyoming last week.

Boulder Assistant District Attorney Ryan Brackley said that in addition to the felony murder count, Britton is being charged with accessory to murder, robbery, possession of marijuana with intent to distribute 5 to 100 pounds of marijuana, and possession of marijuana with intent to distribute 5 to 50 pounds of marijuana.

Boulder prosecutors ID third suspect in Nathaniel Tallman murder case
Boulder prosecutors this morning charged Russell Britton with first-degree murder in connection with the death of Nathaniel Tallman, while revealing for the first time that a third suspect is alleged to have been involved in the drug-related killing.

Charging documents filed by the Boulder County District Attorney's Office allege Britton, 58, "unlawfully and feloniously rendered assistance to Daniel Ortiz and Moises Mendez, with intent to hinder, delay or prevent the discovery, detection, apprehension, prosecution, conviction or punishment of Daniel Ortiz and Moises Mendez for the commission of a crime, knowing that person committed the crime of murder in the first degree."

Boulder County District Attorney Stan Garnett this morning declined to discuss Ortiz's alleged involvement in the crime, but confirmed that he has not been arrested at this point.

One of the suspects in the shooting death of Nathaniel Tallman, of Lafayette, has been extradited from San Diego and will be held at the Boulder County Jail on a $1 million bond on suspicion of first-degree murder, according to officials.

Moises Mendez, 26, was extradited at about 7 p.m. Friday, according to a news release from Sgt. Henry Trujillo of the Boulder County Sheriff's Office.

Nate's obituary.
Nate Tallman, 25 of Lafayette, Colorado, has passed away. He was born in Boulder, Colorado to Kevin and Sherry Tallman. Nate graduated from Monarch High School in 2006 and attended Otero Community College and Aims Community College. Nate had many passions, family, friends, sports, and music at Red Rocks. He loved the N.Y. Yankees, Green Bay Packers, and the Florida State Seminoles. He loved his dogs Frosty, Aspen and Freda. "Kirk Sturgeon has not been sleeping well lately — since he found the body of Nathaniel Tallman.
"I remember so many things about this," Sturgeon said. "I walked down past his feet, and when I seen his face, that is when I realized that it was a body, a human body, and I'll tell you what, that's the worst feeling I have ever had in my life.

"I figured he had to have been killed somehow and thrown out there, like a bag of garbage."

Tallman's body was clothed but had no coat. No shoes were on his feet, but one was nearby. There was no evidence of the gunshot that killed him. Sturgeon said at first glance, it could have been mistaken for a mannequin."

"Mendez, 26, was scheduled to make his first appearance in a Boulder County courtroom today after being extradited from San Diego on Friday night, but that hearing will now take place Tuesday morning after prosecutors filed a motion to file charges directly to Boulder District Court."

"The charges against Britton allege that he "unlawfully and feloniously rendered assistance to Daniel Ortiz and Moises Mendez, with intent to hinder, delay or prevent the discovery, detection, apprehension, prosecution, conviction or punishment of Daniel Ortiz and Moises Mendez for the commission of a crime, knowing that person committed the crime of murder in the first degree."

Well, I didn't come right out and blast Nate's family, but I sure was feeling very snarky towards them when they didn't answer questions on the "donations" page. I now feel like a jerk, which is kind of par for the course. I think what happened was LE knew almost immediately who was responsible for Nate's disappearance. Then Nate's family got his cell phone records and saw the ping in Berthoud, and put that information out to the public. I think LE didn't want to tip the suspects off, and had to share some of what they knew with the family to get them to remove it. I am so sorry I was being judgmental about family and friends going through the worst ordeal of their lives. I do believe justice is coming for this psychotic trio. Stan Garnet has proven to be a very good DA, very unlike his predecessors.
 
'Nate had a good life': Hundreds gather in Lafayette for Nathaniel Tallman's funeral

LAFAYETTE -- As mourners sat in Immaculate Conception Church today for the funeral of Nathaniel Tallman, eulogy speaker Aaron Allen asked those in the crowd to close their eyes and remember him.

"It only takes a moment to bring a smile back to my face when I think about that young man," said Allen, a family friend.

Attorneys for Daniel Ortiz and Moises Mendez — two of the three men charged with murdering a Lafayette man in a drug deal gone awry — expressed skepticism Tuesday about the credibility of the third suspect, who told police about their involvement in the death.

Russell Britton, the third person charged in Nathaniel Tallman's shooting death, has told police that Ortiz and Mendez arrived on his property with the victim's body.

Lafayette police Detective Scott Robinson took the stand Tuesday in Boulder District Court during a preliminary hearing for Ortiz, 38, Mendez, 26, and Britton, 58.

Russell Britton, one of the three men charged with murder in the drug-related killing of Lafayette's Nathaniel Tallman earlier this year, took a plea deal late Monday, and attorneys said investigators for the first time in the case believe they know where the shooting took place.

At a scheduled preliminary hearing for Britton, 58, and the other two suspects -- Daniel Ortiz, 38, and Moises Mendez, 26 -- Boulder Assistant District Attorney Ryan Brackley said Britton pleaded guilty to being an accessory to murder and robbery and was sentenced to 15 years in prison at around 5 p.m. Monday...

Among the new pieces of evidence was new testimony by Britton that Tallman, 25, was shot and killed on his Berthoud property, according to defense attorneys.
 
September 2015, trial begins...

Daniel Ortiz, 38, and Moises Mendez, 26, are both set for a joint three-week trial starting Monday on charges of first-degree felony murder, robbery and aggravated motor-vehicle theft...

"The essence of felony murder lies in the fact that if you commit a serious crime and somebody gets killed, it really doesn't matter if you had a hand in the homicide, you are culpable," said Denver defense attorney and former prosecutor Craig Silverman. "If prosecutors can show that Mr. Ortiz or Mr. Mendez participated in the robbery, than it is likely they will be convicted."

Sept 17th:

Britton appeared in court dressed in a yellow prison jumpsuit and shackles, and, on questioning from Assistant District Attorney Ryan Brackley, confirmed that he received the plea deal and will get a letter to the parole board in exchange for his truthful testimony at trial...

Britton said he had previously told Ortiz — who even made two runs to North Dakota with him previously — knew Tallman wasn't "cloak and dagger," and that he showed up to the deals alone.

At that point, Britton said Ortiz told him, "We need to jack your guy."...

Britton said Ortiz did not reveal any details of the robbery or tell him what he planned to do to Tallman.

Sept 18th:

Wednesday's testimony ended with Britton on the stand testifying that Ortiz contacted him about needing money and planning to rob Tallman when he became aware that Tallman would be delivering marijuana to Britton's Berthoud property so Britton could sell it in North Dakota.

On Thursday morning, Britton said Tallman showed up alone to his barn at 7 p.m. Jan. 21, 2014. Britton said Tallman came into the barn and set the bag of marijuana down, saying, "I have good news and bad news."

Then, after a long pause in his testimony, an emotional Britton said, "I remember a shot. ... It was very loud."

Britton said a man he only knew then as Ortiz's brother-in-law, and who prosecutors claim was Mendez, came toward him with a gun, leading him to fear for his life.

Sept 19th:

During cross-examination Friday, Connell — an attorney for Ortiz — made a tally mark on his "UNTRUE" poster board every time Britton admitted on the stand he had been dishonest with law enforcement or Tallman's friends or family in the days after he went missing.

By the end of the day Friday, Connell had more than 80 tally marks and had to start a second page he titled, "UNTRUE page 2."

Connell pointed out that Britton's original story was that he had never met Tallman...

Connell said it appeared Britton would tell a story until he was confronted by evidence, then would change the story...

When he was arrested, Britton claimed Ortiz and Mendez suddenly showed up on his property with Tallman's body...

But Britton also acknowledged that story was not true.

"It was all fake; it was all a lie," he said.
