Because the judge knows that it's a jury's decision. CO has "lesser included" charges which will shape the trial. Many things can happen between now and trial. And I doubt that this judge has looked at the 4Tb of evidence when he didn't need to.
I do think the prosecution needs to get its game together - they were disjointed. etc (for reasons, I'm not throwing shade).
By the time of trial, hopefully they will have lots of witnesses (actual witnesses like CC and MG and maybe even GD, but certainly other witnesses - like the Ritters and perhaps one of the daughters). There were no witnesses of that type at the PH - just LE investigators.
They'll have actual expert witnesses at trial.
