According to a motion of dismissal document obtained by FOX31, Morphew sued FBI Special Agents Jonathan Grusing and Kenneth Harris. Morphew is seeking damages from the agents’ personal assets through the U.S. Supreme Court case Bivens v. Six Unknown
Named Agents.


In that case, the Supreme Court ruled that federal courts could award financial damages in cases where a person’s constitutional rights were violated by the FBI.

Morphew is allegedly invoking the Bivens case as a reason to seek damages. However, the FBI agents’ attorney cited the 2007 Wilkie v. Robbins case and said “…the right to maintain a claim for damages against a federal official under Bivens ‘is not an automatic entitlement . . . and in most instances [the Supreme Court has] found a Bivens remedy unjustified.”

According to the dismissal document, Morphew filed a lawsuit and asserted the following claims against Grusing and Harris:


  • Count 1: Malicious prosecution and unlawful detention
  • Count 2: Fabrication of evidence
  • Count 3: Franks claim
  • Count 4: Conspiracy
  • Count 6: Failure to intervene
  • Count 7: Reckless investigation]
This ruling makes my day!

ETA: I guess this isn’t a ruling but a motion to dismiss. I’ve been waiting for this and I’m happy the motion was filed. I’m hoping there is a ruling soon to dismiss!
Maybe this will bring a new criminal charge of murder sooner rather than later against Morphew.

So much that is odd about this case !
BM is fighting so hard to prove he's an innocent, 'railroaded' man.
Busy, busy, busy showing how LE and the system are against him.

Even those who may have had doubts earlier, must be seeing him for who he really is ??
BM's going to continue losing Suzanne's money (I think he seized as much as he could from her assets !), suing people who have done nothing except work for justice for his wife.
I still believe BM was responsible for her death, in some way.
Hope he goes broke in his frantic accusations against nearly everyone trying to bring this case to a close.

Justice for Suzanne and answers for her devastated loved ones !

Once it was apparent that JL wasn't signing on to whatsapp, it's pretty evident that she changed clothes. Hung up the bikini. Did she shower? Was her phone charging?

I wish we could pinpoint precisely where she was when Barry pulled in....

Laundry room?

Isn't that where Barry first went, the back patio? Did he fire at her and miss? He never misses... when he's taking down large game.... but Suzanne? Did he fire in and around the breezeway? And that's what alerted Suzanne and she ran through the house systematically locking all the doors, including finally the bedroom door, in an attempt to buy enough time to call 911?

Did she grab her phone, pulling the charger with it, and try to hide in the closet? Is that where Barry overtook her?

Had she been wearing those bike shorts? Her bikini was hung up neatly. But not her bike shorts. Who removed them from her?

Is there any way, without her actual phone, to know if there was any activity in and around 2:46/7? Touch screen light up? Charging stop?

I think Suzanne missed Barry's calls not out of defiance nor apathy nor JL. JL was IMO not available during that critical time period. I think she was busy. I think it was Barry himself who ascribed meaning to her not taking his calls -- then realizing she may have already left on her bike ride (signaling that he did know she wasn't a morning rider!).

I don't find Barry to be clever. I don't think he concocted the bike ride from thin air. I think Suzanne was in fact gearing up for it and was dressed, dressing, half-dressed or had help against her will undressing for her ride, and that's what gave him the idea.

Because the girls were camping, he knew he had time to himself to get rid of everything that might implicate him or indicate a rocky marriage, including Suzanne's body.

I hope LE scoured every wall and door jamb on that house for a errant dart nick in door, wood or drywall. That substance which was negative for blood, was that BAM? From a miss?

The question remains -- Barry, where's your cooler?

He might dodge arrest in 2024 but it's coming.

I think Barry's chipmunk run corresponds with entry points, leading me to believe that Suzanne was frantically locking doors as barricade. Barrycade.

She was in the laundry room.
Was in the daughter's bedroom -- if she saw him raging toward the house with a weapon on hand, what choice would she make?
Was stepping put of the shower
Was dressing in her bedroom/closet

Daughters might know her habits and whether she typically locked her bedroom door...

That it was locked tells me she was not in her room when he arrived, retreated to it, locking herself in and hoping to lock him out. From there, did she go to her closet? Go for her phone? Go for a weapon?

I'm not sure what residual evidence would help LE pinpoint any of that. Unfortunately.

JL and Suzanne weren't in HS anymore. They engaged in an affair as consenting adults and IMO, he had an obligation as a decent human being to disclose any facts that might have helped LE in their investigation once he knew she was missing. Suzanne had told him of BM's past temper and threats. Yet he set back and did nothing for months, and only did so then when LE identified him as the spy pen guy.

Maybe LE still could have recovered evidence from the landfill(s) where he dumped all that stuff on his 5 garbage runs had they known of the affair right away? I'm sure he was scared, embarrassed and worried about losing his family, but Suzanne lost her life for wanting to be with him. Not a man of honor IMO, but each of us react differently to moral dilemmas.

BM showed little to no affection for Suzanne and hadn't for a very long time, preceding their move to Salida, Colorado. Suzanne was living a loveless life in Salida but I think she was lonely well before they moved from Indiana.

Barry was not around the PP house very often. He didn't go to her cancer treatments or do anything especially kind. They had not spoken by phone in months before her murder. They'd only started back texting recently but no phone calls between them for a considerable amount of time. He knew she was leaving and he intended to stop her because he's selfish and greedy so he took her money, her house, her girls and her life.

Barry could have been reasonable and civil minded about their divorce but he chose a different path. Suzanne's bones have been found. Proof of death. May her sweet temperament, quiet disposition and soft spoken ways resonate in Salida always. AJMO

The BoCC noted that to add to this news, DA Linda Stanley does now have a court date set with the regulatory commission and the Colorado Supreme Court for performance violations, on which Ark Valley Voice has previously reported. But that that session is not until June, 2024, which means it is probable it may not be done before the end of her term.

According to the BoCC discussion, there are also reports that she’s not providing leadership at the office, and not showing up at work but rather is working from home.

“Most of her work has to do with the lawsuit filed by Barry Morphew,” added Felt. “It’s something for us to think about.”

The BoCC suggested that they may need to get on the record with their perspective on this situation. “We might need to pull together the four counties again and consider potential actions that we could take,” suggested Felt. “That may or may not be effective. I’m very frustrated by it.”

That appears to be a stock photo from a 2022 article, but I would sure like to know if he's lost any of his bluster. But also, where is any renewed outrage to find her killer? Where are the billboards seeking fresh tips? Where is a new reward? Newly minted infomercial?

I believe someone ripped it from the bedroom nightstand, cord and all.

I can't decide if it was Suzanne, in frantic and panicked move to call 911, or Barry, to stop her from doing so.

It having been plugged in makes since to me. Suze used up the juice on JL and needed a full charge for her Saturday afternoon ride.

That both the phone and charger are missing suggests to me that they left PP as a compound item, regardless of who ripped it from the wall.

Colossal mistake by the murderer.
