Probable Cause (PC) for a search warrant (SW) requires showing that there is a substantial probability that items searched for are:

(1) Connected with criminal activity, and;
(2) Likely to be found on the premises.

How do the police persuade an impartial magistrate that there’s a substantial probability of items connected with criminal activity and that such items are likely found on the premises? In the warrant application, criminal investigators will submit sworn statements listing their reasons for believing both (1) and (2) are the case. The affidavit cannot say, “In my considered judgment as a criminal investigator, there is a substantial likelihood that there are items on the premises connected with criminal activity and they are likely to be found on the premises.” Instead, the affidavit must assist the impartial magistrate in making an independent judgment that both (1) and (2) are true.

A FRIEND of a missing mom who supposedly disappeared during a bike ride on Mother’s Day has claimed “nobody saw her on her bicycle.”

Suzanne Morphew, 49, hasn’t been seen since May 10, when a neighbor reported her missing after she apparently didn’t return home after a bike ride.

But her daughter’s friend’s mother claims “nobody actually saw her on her bicycle, sadly,” according to Crime Online.

“The neighbors up there are spread pretty far apart but the only reason they found out [she was missing] is because the girls called the neighbors and said, ‘We never heard from mom — can you go check on her?'” the friend’s stepmother said.

But, per the report, no one actually saw Morphew, who lives in Colorado, on a bike.

The Chaffee County Sheriff's Office has been searching for her with help from the Colorado Bureau of Investigation, as well as the FBI.

CHAFFEE COUNTY, Colo. (CBS) – Video taken by Copter4 on Thursday shows Suzanne Morphew’s home and the remote part of Chaffee County she was believed to be biking in before she disappeared. Morphew, 49, was last seen on Mother’s Day, May 10.

Morphew’s husband was in Denver, her family says, and a neighbor reported her missing when she didn’t return from her bike ride. Morphew’s bicycle was recovered but investigators have not said anything about its condition. Investigators are now following up on tips — and holding her home.

“…the house continues to be held by law enforcement during this open investigation through a search warrant that has been sealed by the court,” the sheriff’s office stated.

Chaffee County Sheriff John Spezze stated that it is not unusual in these types of investigations to start at the home and extend outward, in an effort to seek clues surrounding the disappearance.

Members of the Chaffee County Sheriff’s Office, with assistance from the Colorado Bureau of Investigation (CBI) and the Federal Bureau of Investigation (FBI), continue the missing person search for Suzanne Morphew.

Ms. Morphew is a Chaffee County woman reported missing on May 10, 2020.

On Thursday, May 21, investigators continued to review and follow-up on tips reported to the Chaffee County Sheriff’s Office. As reported yesterday, there have been approximately 200 tips reported to the designated phone line for information about Ms. Morphew’s disappearance.

The public is asked to continue to report any information about this case by calling (719) 312-7530.

Chaffee County Sheriff’s Office will release information related to the investigation as it becomes available.

The Colorado Bureau of Investigation has announced that based on information developed during the Suzanne Morphew missing person case, investigators with the Chaffee County Sheriff’s Office, Colorado Bureau of Investigation (CBI) and Federal Bureau of Investigation (FBI) are conducting a search at a residential property on the east side of the Salida.

The property owner is fully cooperative with law enforcement and is not connected with the disappearance of Ms. Morphew. No details about the search are being released at this time. Additionally, it is not known how long this search will take law enforcement.

According to CBI Communications Director Susan Medina, the CBI says that there will be no updates during the search, but an update will be provided at the conclusion of the search.

SALIDA, Colo. (CBS4) — A residential construction site is now the focus of the search for Suzanne Morphew, a Colorado woman who was reported missing from her Chaffee County home on Mother’s Day. The property owner confirmed to CBS4’s Rick Sallinger that Suzanne’s husband was hired to lay dirt on the riverfront land, located east of Salida.

The search will resume Saturday morning. Investigators said Friday night Suzanne had not been found and no arrests had been made.
