As we sit here waiting, I was just reading an article about not anticipating a conviction or acquittal based on the length of jury deliberations.

"Valerie Hans, a law professor at Cornell University who has studied juries, cautioned against assuming that multiple days of deliberations always results in an acquittal."

"Hans said juries typically opt for either a verdict-driven approach, where each juror announces their position at the beginning and discusses the evidence supporting their views, or an evidence-driven approach, where they don't immediately discuss verdicts and instead discuss evidence more broadly. Verdict-driven approaches are more likely to result in hung juries, according to Han."

Totally agree with you on the day in question - it was warm day and a fire imo made zero sense.

I was responding to your general question about spring fires in CT.

What MT was doing IMO on the day in question that was unseasonably warm made zero sense. But it was her leaving the house with those fires that made even less sense to me and signalled I thought that other things were happening beyond have a late afternoon latte in front of the fire!

Who can forget this one:

Fire:
The way I thought about the fire issue was specific to the weather on that day in 2019 when it was quite warm. That day was warm and sunny and I can recall being in Waveny and noticing that for the first time in awhile that the sun had actual warmth to it. So often in Spring you can have sunshine but it doesn't generate much warmth which is why some people have fires throughout Springtime depending on the temp and chill or damp factor. After walking in Waveny in the morning that day it wouldn't hit me as a day for a fire at all as by the afternoon it was almost hitting 70 degrees iirc. Just me.

The other issue iirc was that for some reason which I could never understand which was 4Jx got its heating from propane vs natural gas or petroleum/heating oil or electricity. I seem to recall ages ago someones estimating that the then cost to fill up the propane tank at 4JX was in the range $8,000. The house was 10,000sf too. We know FD died owing money for heating iirc in the range of $11,000 or so.

Perhaps MT was simply burning fires to keep warm as they couldn't afford to heat the house (I'm not saying this is what she was doing on the 24th as that was a warm day) but my guess is that house with all the brick and marble could be a damp tomb in the winter and into the early spring and keeping it warm expensive and a challenge.

4JX - Info:

Heating and Cooling

  • Cooling Features: Central Air
  • Heating Features: Heat Fuel Type: Propane, Heat Type: Hydro Air
  • Heating Fuel: Propane
  • Number of Fireplaces: 4

CT Spring weather can be all over the map and we have had some wild snow or ice on Easter and I can remember having a big fire for easter some years and other years not needed. Recent weather patterns have generally trended warmer so by May, fires I wouldn't consider typical at all indoors but some use fire pits outdoors. The other thing is that springs in CT can be chilly and damp and so depending on what is going on a small fire might be nice imo as fire can take the damp and chill away from the house.

But, the other tip off to me about the MT fire scenario is that most people would NEVER leave their house with an active fire. There have been so many horrific house fires with active fires or even completed fires with inappropriately handled ashes.

On the FD/MT not getting along:
I think you highlighting this issue is 'spot on' as to what most likely was going on in the relationship at the time. Lots of bickering and MT constantly reminding FD that it was 'tick tock' on the issue of divorce and custody etc. I can imagine FD simply checking out and scrolling his phone for the names of other folks. When did he 'reconnect' with Anna Curry? I bet LE knows. I doubt MT knows!

Given the Family Court situation based on 'reality' vs 'Horn and Mini Horn" I would have bet the couple was really arguing alot. FD had lied to MT about being at 69 Welles and that sounded like an incendiary situation to say the least. My guess things were really tense money wise too as FD was strapped for cash and trying to figure out how to pay the heating bills and other bills needed to survive. My guess FD didn't even have the cash to cover the monthly requirements of his houses as we saw him slipping behind in his mortgages during this period. CT taxes can be oppressive depending on location so I simply don't see how he was covering things. Looking at how his estate settled it looked like he wasn't.

IDK if anyone felt that the "New Beginnings aka Murder Eve Dinner Party" was quite odd and FD and MT seemed somewhat disconnected to each other and doing their own thing that evening. I do wonder if MT was annoyed at having people over and I do wonder if seeing FD leave the party to do a "Meat Run" and speak to or see KM ticked her off. OR, was she simply annoyed that she worked hard to sell Mr and Mrs Bland some pony rugs to keep the lights on at 4JX and they told her 'she didn't have the colours that we needed' and so this ticked her off? IDK, dynamic of that dinner party where the participants all used the word "HAPPY HAPPY HAPPY" over and over to describe the event had me scratching my head and wondering if the vibe was not in reality far from that?

Given that MT was very much up in FD business, I wonder if the move to CO was to lower expenses as the couple could no longer afford to live in Farmington area?

On the Petu comment of MT going to CO. Petu never clearly explained (by design) if MT was going by herself or with FD. My guess is that if they were still together as a couple by that time CO made sense for them as the apt was small and not expensive vs Farmington.

On the topic of disingenuous Defence witnesses (yep we see you Petu), the other person in this category was the lawyer who hit the stand in the Troconis trial claiming that, "FD was winning"!

Perhaps on Mars imo as Rose had been FD atty for just a couple of months, submitted iirc 5 motions (custody, financials, visitation and a couple of harassing motions directed at JF her atty) to Judge Heller and Judge Heller DENIED THEM ALL. YET, today searching out the cesspit that is the local MSM news who pops up but NONE OTHER THAN Atty Rose with hair poofed up bigger than ever and in full makeup and chatting about the case! The Atty Rose testimony that I found probably in the category for being a contender for "Biggest Whopper on the Stand by a Defence Witness" was the entire gyrations Schoenhorn and Rose (two longstanding compadres imo in the smear campaign against JF) to distance MT from the FD divorce/custody drama (this was BS imo as MT and Mama Troconis etc. had been all over the process for years to the point of reading the discredited Herman report and drawing up 67 questions for a psychologist to see if 'she was safe' nonsense from JF). Anyway, my point was the laughable comment from Rose on the stand about FD not wanting to talk to him about the divorce in front of MT. Total whopper but it oddly makes sense as Rose HAD NO GOOD NEWS TO SHARE and if MT were already crazed at FD and wanting things resolved then of course FD wouldn't want Rose speaking in front of MT imo!

But, I do say, seeing members of the CT Bar, hit the stand with one Whopper after another was disappointing to say nothing of disgusting. There was NO 'light at the end of the tunnel' for FD and MT and "All was not good and the parties were NOT happy" either as there was no good news in Family Court and the money was literally up in smoke. It was imo even more GROSS to see Schoenhorn refer to Meehan and Rose as 'the Professionals or Experts" in his Closing as if to give them some kind of veneer of respectability or even creditability. Just can say, "Whopper to that' Jon Schoenhorn. All I can say is if any of these three alleged professionalsare in your orbit, WATCH YOUR WALLET and EXIT STAGE LEFT PRONTO.

I won't post the Rose TV clip from today here as between GAL Atty Michael Meehan or Atty Michael Rose, I'm not sure who told the bigger whoppers on the stand in this case and these guys are hitting the airwaves simply for a few extra moments in the spotlight? I think they both told one whopper after another on the stand and not surprisingly they are hanging their slimy shingles out next to professionals of similar calibre imo to themselves in the form of Jon Schoenhorn and the person whose name I never recall but think it might be Audrey Felson. Gotta love the CT Bar and Corrupticut.

Long answers to some interesting issues!

ITA with the belief that Fotis and Michelle planned to downsize to Vail. Suck FORE dry, declare bankruptcy, disappear Jennifer, and live off of child support, trust funds, the glory of their offspring's achievements, and start up some new business there.

It's just a theory...not sure it matters...but that is what I gather from the testimony of the defense witnesses. They very successfully help me understand a clearer possible motive of this murder.

But we don't have to know the motive. At trial all the matters is evidence and crime elements.

MOO

Ok, I'll give you another one. I'm not techy enough to do a side-by-side, but I think I'm just struck how Jennifer's love and humanity shows in her face. In MT's face I see only the reflection of a dark and empty soul.

My Friday rally song for the jury (to the tune of "This is How We Do It" by Montell Jordan):

This is how we do it
It's Friday here in this jury chair
The party is here down in Stamford
So I reach for my pencil and I pick it up
Designated jury wading through all this muck
Evidence here is filthy
People on the 'net yelling, "Yo, she is guilty!"
It feels so good in my hood tonight
Unanimous verdict for Michi Troconis
Glad we got to her since we can't get Fotis
You gotta fill that sheet out to make this woman pay
So tip up your cup and throw your hands up
And let me hear the jury say

I found her guilty and it's because (This is how we do it)
This jury does it like nobody does (This is how we do it)
To all the Farbers, justice for Jennifer (This is how we do it)
To jail she's sent, now we're gonna do Kent (This is how we do it)

ETA: Adding the video for those unfamiliar.

Yes, my response to the content of both questions was “Wha?” Why focusing on those particular things? Speculation: maybe a… concrete thinker in the bunch, perhaps weird & irrelevant focus on “mitigating circumstances” or something, as well as what you say.

Yeah, juries… still holding out. The hope, that is.
If I had to put my money in a battle between following the letter of the law Mr Easel here and a make it up as you go along rules are for other folks slacker type that we might have, my vote will all go to Mr Easel man as typically Easel folks will fight to the mat and have no patience with the other folks nonsense. Sad if this is happening as I’ve seen it in real life and it’s so counterproductive.

If what so many here have said they see is what is actually happening, then stay close by as the jury will just keep coming back to Papa Judge to keep order in the jury room imo.

I am hanging on to the belief there is an engineer-type who insists on dotting every i and crossing every t and that is what is slowing things down.
I added Mr Easel to my prayer list as they will need all the help they can get if you have folks in the jury room that want to make their own rules. Moo

I really can only imagine that they’re just going through each charge carefully but I’d find it mind blowing if they didn’t find her guilty on all charges.

Just a few pesky details I’m hoping the jurors ponder…

The lies she hand wrote in clear English in her alibi script and continued to regurgitate….Not one lie, not once. Multiple lies on multiple occasions.

What do her persistent lies on paper snd in-person prove?

She just happened to remember that she wore black leggings, black Adidas and a black sweater but she didn’t remember that she didn’t actually shower with Fotis, because he was in NC brutally killing Jennifer Dulos.

Oh but strangely she didn’t write that she went to Hartford in her alibi script to dump construction garbage as she claimed.

She says she didn’t know what was in those garbage bags, but she knew every detail of every other thing that she loved to describe in explicit detail for so long that LE had to refocus her each time.

She knew how many pairs of jeans Fotis had and all of the brands of his sneakers including Golden Goose as she mentioned in the police interview, she knew all of the Fore property addresses and names of the buyers but she had memory issues and had to fly in an expert memory specialist as her witness to explain her memory issues. Oh she had no trouble telling you exactly what they had for dinner on the 23rd but the other crime-related details, sorry, no memories.she was confused, tired, can’t understand English….needed a linguistics expert as a witness…. If you need to know about the ugly flowered furniture in her storage unit that she hated, you’ve got it but whether Fotis was home that morning, nope, can’t remember. Selective entries, selective memories.

Isn’t it just so strange how Michelle conveniently had Fotis’ phone all morning on 24 May and carried it around the house unlocking it at different times and only answered the alibi call, no other calls no texts, but the one preplanned the night before. You saw Fotis on cameras at Starbucks, he was glued to his phone. So it’s just a coincidence he left it at home all morning.

What does her maneuvering and answering this one call prove?

Just normal behavior from an extremely jealous girlfriend whom hated her boyfriend’s smart (Jennifer and Fotis attended Brown) and beautiful and rich, wife. Yes, Jennifer had the money that they were about to lose completely. Don’t forget that she called Jennifer a bleepimg bleep and thought she should be buried next to the dog.

What does her hate for Jennifer and desire to continue living this extravagant life that Jennifer was putting an end to (by cutting off the money) prove?

Michelle just so happened to bring the exact items: gloves, mop, sponge, bucket, etc. to 80 mountain spring road, to clean. She didn’t clean her own house (actually it’s Jennifer’s House) but anyway, but she was going to clean 80 ms for a showing. Another coincidence. Are we supposed to just believe that when they usually have a cleaning lady and she happened to name her in her interview?

What is a coincidence that the same items were covered in Jennifer’s blood, then found in the bins during the trash dump that she was on with Fotis and her dna on one but right, we are supposed to believe her word that she had no idea what was in them as she doesn’t have X-ray vision (she is so believable with all of her lies we must ignore and just take her word for it.)

What does her bringing the exact cleaning supplies to 80 ms and helped “clean” there that happened to be found covered in Jennifer’s blood in the trash bins that she accompanied Fotis to dump prove?

Michelle just loved social fires said her friend, Petu but strangely she was alone at 4jc while her love, Fotis was at 80 ms for hours cleaning the blood off the truck but she lighted them anyway to enjoy alone for a few minutes in between her 5 trips back and forth to 80 ms after Fotis killed Jennifer. Yes, we have the surveillance and phone records but we just have to believe Michelle as she is so trustworthy.

What does Michelle’s 5 trips back and forth from 4jc and 80 ms prove? With the same cleaning supplies.

Michelle took a bloody paper towel from Fotis after he cleaned the seats in the Tacoma she said he said it was coffee even though she said it didn’t smell like coffee. We know she knows what coffee smells like after all they love Starbucks,

What does Michelle taking paper towels from Fotis as “he” cleaned the Tacoma’s seats prove? What does her being there to clean the bathrooms prove? Did she have time during her quick jaunts there to clean all of those bathrooms? Big house, not much time.

She was right there with him after he returned from nc after murdering Jenifer. Remember those same seats she said he said had coffee on them tested positive for Jennifer’s blood. Another coincidence?

Where did all of those rolls of paper towels go???? The ones Lauren the Nanny just bought at Costco and lined up in Jennifer’s pantry shelf.

Is it really just a wild speculation that Michelle brought them on one of her trips back to 4jc to burn? She just loves a fire in the daytime in May that she had mere minutes to enjoy as she was busy driving back and forth with those supplies.,

She just took the dangling keys from PG’s truck side door and drove away with them just for the heck of it. Is it really speculation that she took them so PG couldn’t take his bloody truck home as they needed more time to clean it? Michelle is innocent and was just a clueless girl in love? She wouldn’t do that they said. She had no idea what he was capable of but that’s okay with all the coincidences that day she just kept in lockstep with him and living with him and loving him.

What did Michelle purposely taking PG’s keys and driving away with them when PG just called.saying he was coming for his truck prove? We have the phone records.

Why did Michelle drive to the car wash to pick up Fotis to get cash to pay for a full detail of PG’s truck without his permission. She just wanted to be nice and help him sell it after she sold him
her motorbike, took his money and then stole it from him? Yes, we will again just have to believe it was a nice gesture on her part and forget about the “spilled Coffee.”

I do hope those jurors think about all those coincidences… is she really just a clueless girlfriend that happened to be in all the wrong spots from the beginning, during and after the murder of a woman she despised?

I wonder if they reached their decision late yesterday and maybe decided to sleep on it. Also, and this really shouldn't play into it, but what if they thought "tomorrow is Friday, let's wait so we don't have to go into work (our real jobs)"? Like if they waited to announce they reached a verdict mid-morning today, they would have a free afternoon.

2/29/24 Thursday Trial Day 31/Verdict Watch Day 2: Jury started deliberations at 10am. . At noon the jury sent a note to the court with two questions. 1 - Can we please receive clarification as to the verbiage of count 3, specifically in order to constitute tampering does the defendant need to have physically altered, destroyed or concealed an item or thing, ie: “physical contact.” The judge told the jury “No. It is an accessorial liability 7 does not require physical contact”.
2 - The jury had a question about the term “accessory” in the jury instructions. Judge: Accessorial liability & Tampering. Judge says he will read count 3 again and indicate that in 3 and 5 they will see CT 53a-155-a1 and 53-8a referring to accessorial liability. Concerning 1 question - Count 3 charged as accessory - So court, is not going to indicate other than explaining that it is accessorial liability that physical contact is needed. She is charged as an accessory. Court will ask if that addresses you question. Accessory can be charged as principal - in response to JS who expanded beyond the jury question. Court doesn't want to go beyond. Accessorial liability doesn't require physical contact. That is the response. So rather than just say no.
jurors have deliberated for 11 hours since closing arguments concluded on Tuesday afternoon. The jury will return to the courthouse in Stamford tomorrow at 10am to continue deliberations.
