Estranged husband Fotis Dulos & girlfriend Michelle Troconis were just arraigned in connection to the disappearance of Jennifer Dulos. The judge kept both bonds at $500,000 despite requests from their attorneys to lower bond. @News12CT

Just put conditions on any bond release. It must be posted at the courthouse, passports must be surrendered, and both must submit to GPS monitoring. @News12CT

Attorney for Troconis is Andrew Bowman
. He says she will post bond today. Attorney for Fotis Dulos is Gene Riccio. Riccio says he doesn’t think Dulos will post bond today. @News12CT

One another note: case was transferred to Stamford, which is typical for more serious crimes. If Fotis Dulos doesn’t post bond today, he will have to do so at the courthouse in Stamford and there must be a bond hearing there beforehand. @News12CT

Michelle Troconis, the girlfriend of Fotis Dulos, who is also charged with hindering prosecution and tampering with evidence is being represented by Westport Attorney Andrew Bowman. Her parents are in courthouse awaiting her arraignment.

Courtroom cleared of all other cases and both attorneys are back in court so expect arraignment of Dulos and Troconis to begin soon.

7:48 AM - 3 Jun 2019 pst

Looks like Fotis Dulos will be arraigned first as his attorney Eugene Riccio is at the defense table. Riccio is no stranger to high profile cases he represented Kyle Navin, the Easton man convicted of killing his parents.

When Jennifer served him with divorce papers on June 20, 2017, Fotis was ordered to “maintain existing” family medical coverage.

But by November of that year, Jennifer complained in a court filing that the family’s health insurance lapsed “due to defendant’s [FD’] failure to pay” and that she was “unable to take the children to certain medical appointments” — to which FD allegedly replied she should “pay out of pocket.”

Divorce litigation and custody:
In March 2018, the court denied FD access to the children, saying there was “an immediate and present risk of psychological harm to the children if they have unrestricted and unsupervised contact with the defendant, as well as a risk of physical danger.”
The court also said he had a history of lying under oath and had encouraged the children to lie on his behalf.
However, the court reversed its decision and found it in the children’s best interest to implement supervised parenting time.
After the court granted FD supervised visitation this February, he and JD could not reach an agreement on a schedule. In March, Judge Donna Heller granted FD supervised visitation every other weekend, starting March 30. He was allotted seven hours on Saturdays in Fairfield County and six hours on Sundays in Hartford County, which could take place at the Farmington house. FD was also granted three hours of visitation on Wednesdays in Fairfield County.

New court documents reveal more about the search for Jennifer Dulos

STAMFORD — Jennifer Dulos’s family filed a motion for default after her estranged husband, Fotis Dulos, and his company, the Fore Group, Inc., failed to appear at a deposition last Wednesday.

The notice of that deposition was given to his attorney almost two weeks before the scheduled date, according to court documents, and this is the second time he and his company have failed to appear at a deposition related to the case, which involves the estate of Jennifer’s late father, Hilliard Farber.

Answering a question from the previous thread by @MrFixit .... pertaining to why NP would hire a PI ... it’s my speculation that since the warrants have been sealed this poses a problem for NP to start his defense hypothesis... so he hired a PI a sleazy one at that IMO .... to follow the breadcrumbs LE May have left behind in order to see what they may have on FD

Can you imagine what it could be like if FD gets those children back? They will be ruined. I am just afraid that FD has had enough time with them already. Hopefully, GF will manage beautifully with them.
The one thing that comforts me greatly on the settlement of the custody issue is the VAST file of documents in the divorce case in Family Court available to GF and her pitbull attorneys to make one brilliant argument after another as to the total unfitness of FD as a father and a derelict human being IMO (the present criminal charges of tampering and hindering will be just icing on the cake of the reasons why FD doesn't qualify for custody IMO).

IMO FD will be hung by his near perfect 2+ year track record in Family Court as a deadbeat dad, absent husband and father, perpetrator of domestic violence against JD, person who threatened GF, person who had impressionable children under the age of 10 LIE ON HIS BEHALF and a person of no conscience with zero respect for the law as demonstrated by repeated non compliance with court orders. The list could go on and on and on and it would be truly hard to compile a TOP 10 list of the many wrongs of FD that he pepetrated against both his wife and his family. Its like shooting fish in a barrel!

Let's see how the FD legal strategy of 'winning at all costs' against a JD who was paying for everything in his life, plays to a group of people on a jury that actually have to work for a living, work hard to feed their families and keep a roof over their heads! I'd actually buy a ticket to sit in the jury deliberation room to hear their assessments of 'winning is the only thing' FD!

These nearly 500 motions and rulings in the Family Court file tell a story and IMO that story is crystal clear! Those documents tell anyone that wants to read them who exactly FD is on many levels. I won't rehash what we have learned through reading so many of the documents here. But my strong suspicion is that if any of these documents somehow made it into a criminal proceeding that the jury hearing the case would not even have to hear witness testimony directly from FD in order to convict!

I do hope that any custody case hearings get a new judge or perhaps get moved entirely to another court as IMO Judge Heller is why the Dulos v. Dulos case ended up where it is today unfortunately. I don't think that most people in CT reading about this Dulos divorce action are satisfied that the Family Court system worked for anyone in the case and certainly not the children. Totally MOO!

The State of CT judiciary is under a microscope on this Dulos custody situation and again IMO isn't looking too solid going into the entire case based on its handling of the divorce action and extensive fumbling and tentative action that we have seen from Judge Heller on the past few rulings and no action from Judge Heller on several pending rulings. I think a strong argument could be made that a fresh set of judicial eyes would serve the Dulos Custody case well!

MOO!

Silver Alert - CT - Jennifer Dulos, 50, New Canaan, 24 May 2019 #14 *ARRESTS*

Nah. They can't get it. Medical information can only be disclosed in limited circumstances:

To respond to a request for PHI for purposes of identifying or locating a suspect, fugitive, material witness or missing person; but the covered entity must limit disclosures of PHI to name and address, date and place of birth, social security number, ABO blood type and rh factor, type of injury, date and time of treatment, date and time of death, and a description of distinguishing physical characteristics. Other information related to the individual’s DNA, dental records, body fluid or tissue typing, samples, or analysis cannot be disclosed under this provision, but may be disclosed in response to a court order, warrant, or written administrative request (45 CFR 164.512(f)(2)).

  • To respond to a request for PHI about a victim of a crime, and the victim agrees. If, because of an emergency or the person’s incapacity, the individual cannot agree, the covered entity may disclose the PHI if law enforcement officials represent that the PHI is not intended to be used against the victim, is needed to determine whether another person broke the law, the investigation would be materially and adversely affected by waiting until the victim could agree, and the covered entity believes in its professional judgment that doing so is in the best interests of the individual whose information is requested (45 CFR 164.512(f)(3)).

Where child abuse victims or adult victims of abuse, neglect or domestic violence are concerned, other provisions of the Rule apply:
    • Child abuse or neglect may be reported to any law enforcement official authorized by law to receive such reports and the agreement of the individual is not required (45 CFR 164.512(b)(1)(ii)).
    • Adult abuse, neglect, or domestic violence may be reported to a law enforcement official authorized by law to receive such reports (45 CFR 164.512(c)):
      • If the individual agrees;
      • If the report is required by law; or
      • If expressly authorized by law, and based on the exercise of professional judgment, the report is necessary to prevent serious harm to the individual or others, or in certain other emergency situations (see 45 CFR 164.512(c)(1)(iii)(B)).
      • Notice to the individual of the report may be required (see 45 CFR 164.512(c)(2)).
  • To report PHI to law enforcement when required by law to do so (45 CFR 164.512(f)(1)(i)). For example, state laws commonly require health care providers to report incidents of gunshot or stab wounds, or other violent injuries; and the Rule permits disclosures of PHI as necessary to comply with these laws.

  • To alert law enforcement to the death of the individual, when there is a suspicion that death resulted from criminal conduct (45 CFR 164.512(f)(4)).
    • Information about a decedent may also be shared with medical examiners or coroners to assist them in identifying the decedent, determining the cause of death, or to carry out their other authorized duties(45 CFR 164.512(g)(1)).
  • To report PHI that the covered entity in good faith believes to be evidence of a crime that occurred on the covered entity’s premises (45 CFR 164.512(f)(5)).
505-When does the Privacy Rule allow covered entities to disclose information to law enforcement

It isn’t going to be easy for GF, though...at least the oldest of the kids (13 year olds) have been molded by FD into kids who know to lie and manipulate to get what they want. I hate saying it, but I think it’ll be an uneasy household for at least a while. JD had relatively little authority in that household up until 2 years ago, when she left Farmington with the kids. I mean, she couldn’t even demand to have a nanny who was fluent in English, because FD didn’t want one. I hope she was able to reset the kids and their expectations in the past 2 years, and that they will all get through this. I am encouraged by the statements by people who have said that the children obviously loved their mother, and that they were a wonderful addition to the NCCS.

Just MOO but thinking about what others like the principal have said in mainstream media about how close JD and her kids were and then the one report in court that mentioned one son’s issues with FD and the waterskiing, plus how FD himself said he had gone without contact with the kids for weeks (not now; earlier in his “unfair to me” comments to the judge before all of this) when IMO kids as old as the older ones in the family could have found a way to contact him if they’d wanted, I do not believe that it’s likely (MOO) that FD is a person these kids ever wanted to emulate. It’s my opinion only again but looking at the totality of what we’ve heard and seen, I feel very sure that JD was the protector of these kids and the warmth and light in their lives, and they grew up saying under their breath probably, “When I grow up, I never want to be like him.” As a kid, I’ve been there and I’ve seen it often in similar situations. JD had, in my opinion, power but tried to keep peace and pick her battles as she knew when she chose to use it—really use it—, things were going to be unpleasant for the kids who would be natural targets for him especially as they were her heart, based again on what we’ve seen and read, and in my opinion only. GF, again, is a strong woman based on what we’ve read and heard, and FD has done her daughter and grandchildren very wrong not to mention betrayed the trust GF’s husband seemed to have in him. I don’t know GF but I feel as though I know her spirit and strength. MOO.

Has there been a custody settlement? What is it?
None yet. But it looks like both sides are gearing up for debate on the issue. Wish we could bring in your prior response on the custody question from the last thread as it might make people feel a bit more comfortable with understanding the issues. Not sure how to bring it back here but I found it very helpful in framing the issues that will most likely be discussed in court.

On the sister, I know that somewhere in mainstream media, she did say something about JD and it was very loving. MOO but I can’t see that anyone would blame JD, by all accounts from people other than FD, a kind and gentle person for the mess that FD caused. Yes, JD married him but I can’t think she knew exactly who or what she married. Like JD, JD’s sister also has money and she would thus be able to get quality help with the kids so it would not be just her alone. I’m not at all saying I think she should feel as though she should do it; I’m just saying that in MOO, she will WANT to do it.

I feel sure that if JD had to have a psych exam, so did FD.
I agree, I was involved in a very long and difficult custody case. I can say that we both had to take one as well as all of our children. IMO it would also depend on WHO requested the evaluation. Did the judge order it because of the vast accusations being made? Because of some prior history? Or did one of the attorneys request it?

Regarding the school issue, my opinion only (MOO) again but I feel sure that room would be made for these kids somewhere. They already attended via technology at the end of the year and that, too, could be an option. I just think that where there’s determination—and I believe JD’s family has that—, there’s always a way to find a solution especially if a lack of money is not hampering you. If ever we had a doubt, this case illustrates that while money does not necessarily bring happiness, it CAN pay for armed guards, good lawyers, and other things that can help keep these kids safe. I’m very glad that these resources are there to help these kids.
