As far as I can recall KM was drinking heavily in the days before and after Jennifer went missing. That’s when he “fell” down the stairs and broke his phone - tried to evade police by heading towards the mass border on Rt 84W etc.
Below are excerpts from the article regarding the domestic violence charge by the wife.
Seems like maybe a pattern emerges of two Kent’s - perhaps one sober and one not sober.
It’s hard to say what type is shape he might be in now IMO. Also maybe he agreed to testify and has changed his mind.
I would assume they taped whatever they have from way back when but if he is not willing to stand behind it not worth much.
Also unless he has “receipts” he’s not too credible it seems. JMO

Link attached below :

“Kent Mawhinney - charged in the death and disappearance of Jennifer Dulos - was given a five-year suspended prison sentence and three years of probation on a domestic violence charge following an emotional court proceeding Friday afternoon.
..,,,
"He made me feel special and loved," she said. The woman agreed to quit her job so she could be a full-time mother to her own children and his three kids, she said.
They eloped in 2013 and continued an idyllic lifestyle until Mawhinney began drinking frequently and often frightened the children with his behavior, the woman said in court.

Mawhinney is also required to have no contact with his ex-wife for five years, seek mental health and substance abuse
evaluations and attend domestic violence

counseling.

Thanks for gift, @waldojabba. Man—those Alford pleas! Yep, IMO due to the history of alcohol abuse (and possible early recovery status) and rap sheet, he’s a wild card, one to not play unless absolutely necessary. My own projection; alternately angry, then sad/sincere (and possibly remorseful? I dunno) in various court appearances. Then the ankle monitor tampering, then that one time he got (IMO) haughty with the judge: (from Fox 61, around 3:10)

Testimony of others & hard evidence will play a big role in the decision to put him on the stand. Not to mention possibility of self incrimination—MOO. And I’d sure have a hard time looking at him if I were one of JFD’s loved ones.

Does anyone think that Marisela Arreaza will be a defense witness, and if she is, will she also need a translator?

"Svengali" defense? Doesn't appear that way to me--from JS's motions, etc.

I was thinking more like JS would use Mama A’s testimony to defame the police and their investigation immediately following Jennifer’s death, specifically regarding the search of the house. Less about fD…
And if it has to go to appeal, JS will say the trial court and the AG improperly denied MT's right to the transcript from the family court hearing that he insinuates will show JFD capable of staging her own disappearance--implying FD wasn't involved.

He sure will-that’s why he flogged that issue so hard.

I think they have a credibility issue with Michelle’s Mother taking the stand.
She has had her own past run ins with the law as outlined previously in these threads.
Iirc it was Medicaid or Medicare fraud aka deceit/ falsehoods/big lies done in FLA. imo.
Also she is the parent of the defendant. Many parents will easily lie for their children imo.
Does not mean JS does not put her up on the stand. But imo if he does use the mother, it doesn’t mean much except that he does not have much of a defense.

All eyes will be on a Stamford courtroom this week as the trial for Michelle Troconis, one of two people still facing charges in the disappearance of New Canaan mother Jennifer Farber Dulos, is set to begin on Thursday.

She is charged with conspiracy to commit murder, tampering with evidence and hindering prosecution.

1/8/24

[Michelle] Manning will have to prove that Troconis engaged in an agreement between two or more people and one of them committed an overt act to further the crime to get a conspiracy to commit murder conviction, Hussey said.

"That's going to be tough for the state to prove," Hussey said. "This is a circumstantial case."

In arrest warrants, investigators believe they pieced together how Fotis Dulos killed his estranged wife and tried to get rid of evidence on the day she vanished. Arrest warrants also detail how investigators believe Troconis and Mawhinney may have played a role in the death.

[..]

Troconis is accused of trying to create an alibi for her former boyfriend the morning of the disappearance, first by being in his office to answer a phone call from Greece while Mawhinney was also there and by having her photo taken with "Marty," a robot at a nearby Stop & Shop grocery store, arrest warrants said.

Troconis also initially lied to police that she had been with Fotis Dulos in bed that morning and then later changed her story, saying she didn't know where he was until he arrived that afternoon at one of his properties associated with his real estate development company, The Fore Group, the warrants said.

Hussey is suggesting that MT may have been afraid of fD? Hmm-so that is what kept her protecting him, even after he killed himself? Because the worst thing she said about him since the murder was “I don’t know if he was capable of doing what he is accused of, but in retrospect, it may have been unwise to trust him”. She has had much worse to say about the victim, Jennifer Dulos. She even claimed to have been afraid that Jennifer was coming after her. Was Dulos still mesmerizing her after they both were arrested and told not to contact each other? Was he mesmerizing her from beyond the grave? By the way, it might have been smarter for her family not to claim that she was a smart and independent, and talented entrepreneur for her entire life, if they were going to also claim that she was too weak to escape Dulos’s power over her, even after he was dead (and moved on with another, more attractive, woman).

When I read that quote by Hussey, all I had to do was look to the bottom of the article and see the identity of the author.

Yes, maybe weeks after the murder I'd buy MT was uncertain of her safety but LE was very clear in their interviews that she could speak freely about fD. Some might say they implied police protection -- and all was said in front of MT's attorney.

IMO, the jurors viewing her police interviews, will also conclude MT was no victim fearing for her safety. Not then, not ever. MT's a worldly woman, she can handle herself. Despite her language barrier.

When she couldn't disclose whether he was at their Farmington home at the time of Jennifer's disappearance, one detective tried to encourage her to spill anything she knew about his movements by touting it as a 'golden ticket' to save her reputation.

'Have you looked at the news at all? Have you seen your face plastered (everywhere)?' he asked Troconis as she sat beside her attorney Andrew Bowman on June 6.

'I'll be honest with you. You're probably one of the most hated woman in America right now. And I'm not being mean. So this is like the golden ticket.

https://www.websleuths.com/forums/t...-canaan-24-may-2019-arrests-57.698903/page-14

12/20/23 Update: Judge Kevin Randolph has denied motions to suppress Troconis’ police interviews & to suppress DNA evidence. Randolph’s conclusion: “The search warrant for defendants DNA was facially valid & did not lack probable cause. The defendant knowingly, intelligently & voluntarily waived her rights when she spoke to the police on June 2, June 6 & August 13.” “She had the assistance of competent counsel before & during the interviews. Though police used, at times, deceptive tactics her will was not overborne.” See post #113 page 6. Pretrial hearing set on 1/4/23 per court site @ 10am.
1/4/24 Update: Judge Kevin Randolph said during an emergency hearing at the state Superior Court in Stamford Thursday that the juror in question had contacted the court earlier this week after he unexpectedly was fired from his job Dec. 31. Citing “adverse financial circumstances,” the juror had asked the court to excuse him from the jury so he could begin searching for a new job, according to Randolph. The juror’s dismissal, however, leaves only 6 regular jurors & 2 alternate jurors for Troconis’ trial. Additionally, one of the eight remaining jurors already has contacted the court to inform them he contracted COVID-19 over the New Year’s holiday weekend. Schoenhorn also asked that the case be dismissed due to the three-day delay & was denied. ** 6 men/4 women, now 4 men/4 women. The jury selection will happen on Tuesday, 1/9/24 & Wednesday, 1/10/24 with the trial now beginning Thursday, 1/11/24.

Darien-New Canaan Probate Court judge declares #JenniferDulos dead. Dulos’ mother Gloria Farber petitioned for the decree in October 2023 in order to help protect Jennifer and her children’s assets.

What could she specifically mean, protecting the assets-and from whom? I didn’t think there were really any assets for the children, from either of the parents, unless they mean from some kind of trust fund of Jennifer’s, if she had one, or bequest from Gloria Farber, if she died. Who would they need to protect the assets from? Not fD’s family…? I mean, we already know they have no problem taking things that don’t belong to them (furnishings), but would they dare?

YES. Couldn’t have come at a better time.

1) I absolutely wouldn’t put anything past the FD family, given past behavior and willful blindness. The sticky fingers and an attempt to insinuate themselves (possibly financially) are a risk as long as the children are alive, IMO. What a forward-thinking gift to the children from their loving grandmama. Also, I remember that MT took a little NY jaunt to take a look at some Farber financial records, if I’m not mistaken.

2) Also, if JfD is declared deceased, what happens to a GGirl strategy? I didn’t think this is going to be the approach. The defense’s attempt to unseal JFD’s health records unnerves me, though.

Pawel Guimenny, who owned a red pickup truck that investigators said was used by Fotis Dulos in a plot to kill his estranged wife, will take the stand against Troconis with an agreement that he will have immunity from any criminal charges.

Guimenny is listed among about 250 people who may be called to testify or whose names could come up during the trial, which begins Thursday...

The list of potential witnesses and people whose names may come up at trial includes Gloria Farber, the mother of Jennifer Dulos who has been caring for her grandchildren since the disappearance.

The list, which was obtained by Hearst Connecticut Media Group, also includes judges and attorneys who have been involved in the case and the contentious Dulos divorce, as well as friends of Troconis and her family.

Supervisory Assistant State's Attorney Michelle Manning's list of potential witnesses includes dozens of state troopers, police and investigators, two of the Dulos children and their babysitter Lauren Almeida who arrest warrants show told authorities the night of the disappearance that she believed Fotis Dulos may have done something to his estranged wife.

While not everyone on the list will end up testifying, Guimenny has been issued a subpoena to take the stand, his attorney said.
