Police have now been at the Sky View property for five hours searching the house, walking the property and then calling in dogs and septic tank company. Similar to searches of other properties they did last year but not this one.

Attorney: Michelle Troconis banned from retrieving personal belongings

The attorney representing Michelle Troconis says his client has not been allowed to retrieve personal belongings from her former boyfriend’s home.

Christopher Hug, an attorney who was appointed by the Farmington Probate Court to be the administrator for Fotis Dulos’ estate, has prevented Troconis from taking her items from the Jefferson Crossing property, according to court documents filed Wednesday.

Hug has gone to “extraordinary steps to interfere with the ability of Ms. Troconis to retrieve her property from a separate location where he has no legal interest,” said her attorney Jon Schoenhorn, who is arguing that Hug should be removed as administrator.

A representative for the five children was allowed access to the Jefferson Crossing home last month to retrieve their belongings, while Troconis has not been afforded the same opportunity, Schoenhorn said.

“Mr. Hug has interfered with the orderly and lawful transfer” of Troconis’ property, “despite production to him of proof of ownership, while demanding an unreasonable degree of exactitude,” Schoenhorn said in documents filed with the probate court seeking Hug's dismissal.


The denial only benefits Hug’s financial interests by “creating unnecessary and almost ludicrous hurdles over Ms. Troconis’ personal property without justification, while seeking to pad his own fees and insisting on litigating trivial sums,” Schoenhorn added.

Attorney's complaint: Probation officer conducting 'unlawful' interrogations in Jennifer Dulos case

STAMFORD — The attorney representing Michelle Troconis in the Jennifer Dulos homicide case has filed a complaint with the state Judicial Branch, accusing a probation officer of conducting “unlawful” weekly interrogations of his client.

According to attorney Jon Schoenhorn, his client has “illegally” been required to show pay stubs and provide information about meetings related to her defense strategy.

“This is unlawful and unconstitutional custodial interrogation, and must cease immediately,” Schoenhorn wrote in a letter obtained by Hearst Connecticut Media.

The letter was sent July 22 to Gary Roberge, executive director of the Court Support Services Division, which oversees supervision of defendants who have been released on bond with conditions.

Judicial Branch officials declined to comment on the letter.

In the letter, Schoenhorn cited the probation officer assigned to oversee his client’s electronic monitoring and other terms of her release on $2.1 million bond.

Schoenhorn contends in the letter that the probation officer is acting “under the mistaken impression that Ms. Troconis is a probationer or guilty of some offense."

The probation officer has required weekly in-person meetings, which are now conducted remotely, and questioned “the reason for legal meetings that take place outside my office,” Schoenhorn said.

“I witnessed his call come in last month while she and I were meeting in Farmington, and he asked her what we were doing,” Schoenhorn said. “If he incorrectly believes that he is acting in accordance with the law, I ask you to put a stop to this practice.”

Schoenhorn also contends that if the probation officer is sharing information on Troconis’ whereabouts with law enforcement, it would “constitute a direct interference with my representation.”

Schoenhorn is calling for the probation officer to turn over any notes about Troconis’ activities and he wants the practice of sharing information with police or prosecutors halted “immediately.”

Jennifer Dulos case: A new bail hearing has been ordered for Michelle Troconis as coronavirus shutdowns delay court proceedings

With shutdowns due to the coronavirus pandemic creating backlogs in the court system, the state Appellate Court has ordered a bail hearing in the case of Michelle Tronconis -- accused of conspiracy to commit murder in the disappearance of Jennifer Farber Dulos.

Troconis’ attorney, Jon Schoenhorn, has been seeking to have the conditions of her $2.1 million bond modified. But he said in a motion that he was unable to get a hearing because of the on-going COVID-19 pandemic that closed most state courthouses for several months.

Schoenhorn turned to the Appellate Court to demand an expedited hearing, which has now been set for August 28 at Stamford Superior Court. Troconis was supposed to be in court on Aug. 6 but it was postponed until Oct. 1. The Stamford court was particularly hard hit with several COVID cases including a death of a court employee.

Schoenhorn has said that he believes the initial restrictions placed on Troconis when she was initially arrested in June of 2019 were too restrictive for the charges she is facing. She has been wearing an GPS-monitored ankle bracelet since her initial arrest.

But he has been unable to get judges in Stamford to hold a hearing so instead he went to the Appellate Court seeking an order. The court initially denied his request but last Friday issued an order late last week saying that the Stamford court must hold a hearing before Sept. 4. The hearing has now been set for Aug. 28.

“This order should not be construed as directing the manner in which such hearing is to be conducted nor as expressing an opinion on those merits of the motion,” the court order said.

Schoenhorn said Tuesday his client is happy to finally get a hearing and is hopeful a judge will lessen the restrictions on her bond and remove the ankle bracelet since she has had no issues with probation officials since her initial arrest.

STAMFORD — Michelle Troconis will not have to wait much longer for a judge to hear her attorney’s argument for the removal of the electronic monitoring device she has been required to wear since being charged in the Jennifer Dulos case.

Attorney Jon Schoenhorn was notified Monday that his client’s appearance in state Superior Court in Stamford has been moved up to Aug. 28 when a judge will address the series of motions he has filed in recent months

The notification came after the state's Appellate Court ordered the lower court to schedule the motions for a hearing before Sept. 4.

Schoenhorn filed a second request when his client’s August court date was postponed to Oct. 1, asking the Appellate Court to order Judicial Branch officials to remove the electronic monitoring until a Superior Court judge can hear the motions.

The Appellate Court issued an order Aug. 7, granting Schoenhorn's request to have the hearing on the bond conditions held in a timely manner. The Appellate Court did not rule on the motions. The hearing in Superior Court will now happen later this month.
 
Michelle Troconis Case Pushed To Oct. 1; Her Lawyer Files Appeal

NEW CANAAN, CT — The attorney for accused murder conspirator Michelle Troconis appealed to the state appellate court this week after his client's case was pushed to Oct. 1 in the ongoing saga over the disappearance of Jennifer Farber Dulos.

Troconis, who faces a conspiracy to commit murder charge, was scheduled to appear in Stamford Superior Court on Aug. 6, but due in part to the continuing coronavirus pandemic, her scheduled appearance was moved to Oct. 1. Kent Mawhinney, a Hartford area attorney who received the same charge in the case, is scheduled to appear in court on Sept. 3.

"The defendant seeks expedited review of the latest continuance order, entered without her consent," Schoenhorn wrote in the appeal. "She was scheduled to argue her modification motions on August 8, 2020. The defendant requests either (1) an order requiring immediate review or (2) suspension of the nonfinancial conditions until and unless a court entertains her pending motions."

Attorney releases video of Michelle Troconis interview with police in Jennifer Dulos case

STAMFORD — Michelle Troconis described waking up and showering with her former boyfriend Fotis Dulos and later having lunch with him the day Jennifer Dulos vanished in one of the notes police have dubbed as their “alibi scripts.”

But Troconis’ attorney is now questioning the accuracy of this evidence in his bid to get his client’s electronic monitoring removed.

Schoenhorn contends that judges, and even Chief State’s Attorney Richard J. Colangelo Jr., have required Troconis to be on electronic monitoring based on what he claims are false assertions made by state police investigators in warrants and in conversations with his client.

According to Schoenhorn, Troconis was instructed by her former lawyer, Andrew Bowman, to write the note, which lists everything she claims to have done the day Jennifer Dulos disappeared.

However, Bowman said any suggestion he was involved with Troconis creating “alibi scripts” is untrue. Bowman said in Troconis’ first arrest affidavit investigators determined the creation of the timeline was suggested by a family attorney working for Fotis Dulos. Bowman said the notes were created before he met Troconis.

Since replacing Bowman as Troconis’ attorney in February, Schoenhorn has filed a series of motions, many of them related to having the electronic monitoring device removed.

His motions have remained pending as most court proceedings have been halted due to the COVID-19 pandemic. Schoenhorn filed an appeal with the state Appellate Court, which ordered a hearing for Friday.

Schoenhorn plans to cast doubt on the state’s case and the need for 24-hour monitoring by pointing out what he believes are inaccuracies in court documents and in conversations that were recorded for his client’s case.

“Ms. Troconis prepared a one-page timeline to account for her whereabouts during the day on May 24, 2019, at the behest of her attorney,” Schoenhorn said.

The note and a timeline drafted by Fotis Dulos were dubbed “alibi scripts” by investigators, which Schoenhorn said was an inaccurate and derogatory description.

The paper, which says she showered with Fotis Dulos sometime after 6:40 a.m., contradicts video police obtained showing a red Toyota Tacoma pickup truck police believe Fotis Dulos was driving at that time to New Canaan, according to arrest warrants.

The note also contradicts Troconis’ later admission to police that she never saw her former boyfriend the morning Jennifer Dulos disappeared and didn’t have lunch with him at noon as the missive states.

Attorney Wants Court to Remove Bond Conditions on Michelle Troconis

The attorney for Michelle Troconis is calling for the removal of some of the non-financial bond restrictions on his client.

In a memo filed in Stamford Superior Court ahead of a hearing scheduled for August 28, Attorney Jon Schoenhorn argues that the GPS monitoring and 24-hour house arrest imposed on Troconis as part of her bond conditions are excessively restrictive, violate her constitutional rights, and that they were imposed based on inaccurate evidence presented to the court.

They were conditions placed on Troconis after being charged with conspiracy to commit murder and tampering with evidence in connection to the disappearance of Jennifer Dulos last year. She posted a total of $2.1 million bond in the case.

Schoenhorn is calling for the removal of the ankle bracelet GPS monitoring, to end his client's participation in the Intensive Probation Program, house arrest and curfew requirements. He is also asking the court to lift travel restrictions within the US and the requirement that his client report to a probation officer or CSSD official while on pretrial release.

Currently, Troconis is not allowed to leave her apartment except for meetings with her attorney, religious services, medical appointments, and court.

Schoenhorn says he struggled to get a hearing on the matter in Superior Court due to the ongoing coronavirus pandemic and that also adds to an undue burden on Troconis. He previously filed a motion to have the bond conditions altered with the Connecticut Appellate Court.

He says Troconis is not a flight risk and that she has close ties to the Hartford area. She has pleaded not guilty to all of the charges.

He also argues that his client was arraigned in the wrong courthouse in the wrong judicial district, and therefore the conditions of release were determined improperly.

Schoenhorn claims evidence against Troconis doesn't support the bond conditions. He argues state police falsely stated the number of stops Troconis made along Albany Avenue in Hartford with Fotis Dulos in the arrest warrant alleging the pair discarded evidence in trash cans there. He also argues that video evidence shows that Troconis never assisted Fotis Dulos with the removal of anything from the vehicle during the time in question.

Colangelo is now asking for sanctions on Schoenhorn for sending evidence to media without getting the okay from the prosecution. Schoenhorn sent out several pieces of discovery including videos showing Fotis Dulos disposing of evidence.

Schoenhorn: nothing that was released to the media was not part of his memorandum of law, hence no violation. Also calls out Colangelo for not giving him the courtesy of a heads up that he has an issue with what was released. Calls this “a stunt” and expects an apology.
