There's no comparing KM's conspiracy (alibi effort) compared to MT's actions, and probably why the State was willing to cut him a deal in exchange for being a state witness against MT. Glad they didn't need him -- he's slime, and not credible.

For MT, prosecutors had an alibi script in her own handwriting! She wasn't very smart.

I believe KM would have been in more trouble here if FD survived -- that's who could have hurt him. If FD was going down, he was taking the team with him. JMO

 
I'm recalling from the State pushing to do Jury selection in Nov/Dec long before the trial date in part because MT did not waive Speedy Trial whereas KM did. IMO, that's likely the jest of it. I think it would require KM making noise before this matter budges. IMO, he'd rather be free on a bracelet than not. JMO

I suppose so (free with a bracelet than not). I wonder what leverage he has (location of Jennifer, stay silent on connecticut legal corruption) he has to be completely free of electronic monitoring and reinstate his law license. Something's fishy to me.

He would certainly prefer to be free on a bracelet. It’s my opinion that this is why he waived his right to a speedy trial. Especially knowing how it went down with MT. They can’t hold off indefinitely, though-but I’d be ok with it if the authorities were actually pulling together more evidence in the interim. I’m not saying they aren’t looking; just not finding.

Yes, I agree with this. And while I think both co-conspiritors were relieved initially when Dulos died, only one really benefitted. MT figured she was automatically off the hook, while KM (smarter and more knowledgeable) knew that the one who could hurt him was gone. MT hurt herself plenty.
 
You would think the Troconis Clan would be harassing the prosecution on a daily basis to speed this up because, in their mind, KM "coerced Michelle into answering the phone the morning of May 24th" (the Venezuelan Newspaper Article) and they are he##bent on the truth to be told to clear up their family name and support a possible appeal approval. IDK. It'll be 5 years in January that he lost his license to practice law. Where is Jennifer, Kent?

Although I recall there being discrepancy between the defense and the State as to why KM did not testify at MT's trial, I don't think I'd ever read that Judge Randolph had an opinion on the matter...

STAMFORD, CT — Though he was expected to testify, former attorney Kent Mawhinney did not take the stand for the prosecution during the Michelle Troconis trial in the Jennifer Farber Dulos disappearance and death case.

There is reportedly some confusion whether Mawhinney invoked his Fifth Amendment privilege by not testifying, though his attorney, Jeff Kestenband with Butler, Norris & Gold, told Patch, no.

"Kent Mawhinney has not invoked his Fifth Amendment right," Kestenband wrote in an email to Patch. "That is all I am willing to say on the record at this point."

The Stamford Advocate reported that Stamford Superior Court Judge Kevin Randolph, and Assistant State's Attorney Sean McGuinness, both seemed to indicate that Mawhinney invoked the privilege.
 
If the State is only willing to go to trial with the charge they know they can prove, they have MW fulfilling his role as the alibi witness at the office -- suggesting MT answer the incoming phone call from Greece.

Is this part of the prosecution delay, and why they are dragging their fee?

Maybe KW is the deceptive one and he did invoke his 5th Amendment Right in advance of MT's trial, and now the State doesn't know what to do with him?

What a mess... Where is Jennifer?

Here's the contact for his attorney (Jeffrey Kesterband). IMO, any inquiry to the State Prosecutor would probably be met with "this is an ongoing investigation"...and no comment.

Alfred Branch from "The Patch" might be willing to follow-up with KM's attorney Jeff for any update on his client's trial date since his last story on February 22. (Post #172).

 
For Comparison, I'm also following the case of Jose Morales in Milford court where the court site also reads "On the Trial List, To Be Scheduled," and the status date is stuck at 7/30/24.

Morales rejected a plea deal for murder of Christine Holloway, and his baby daughter Vanessa Morales is still missing but JM has not been charged in the daughter's case. News12 CT reported last summer that with the trial on the 'trial wait list,' the defendant (Morales) will get 24 to 48 hours’ notice before jury selection begins.

The only difference here between Morales and KM is that Morales is in custody and not on bond release. In other words, I guess this 'wait and see' trial thing is part of the judicial process in CT and not limited to KM's case. Very strange -- nonetheless. JMO
 
Why isn’t Kent chirping to remove the ankle monitor? Something is up.

IMO, either KM can't argue he's been a model citizen in the last 12 months on pretrial bond release, or he fears the State will counter again to raise his bond, and he'll end up back in jail. KM's bond is currently only $246K after a huge reduction was made a couple of years ago when it seemed KM would be a witness for the State. At this point, not having testified for the State, and with no trial date, I think the only reason KM hasn't attempted to flee is because his parents home is the collateral for his low bond. MOO

KM last appeared in court to hear a defense Motion requesting to remove his GPS ankle monitor on Nov 3, 2023. At the hearing, his attorney argued he'd been compliant for better than two years, and it caused him embarrassment. The State did not agree, requested the Motion be denied, and also requested his bond increased.

Court records show that Judge Gary White denied the motion in a hearing on Friday and also rejected a bond raise requested by the state.
