In a surprise development, the class-action litigation over the collapse of Champlain Towers South has been settled, a federal judge was told Wednesday, with plaintiffs expected to receive just under $1 billion. The comprehensive settlement announced in Miami-Dade Circuit Court Judge Michael Hanzman’s courtroom effectively closes the litigation phase of the case. Still to be decided is the share each victim or their survivors will receive.

“We have gotten $997 million in proposed settlements before you — and it could be a billion before the end of the week,” said Harley S. Tropin, a lawyer representing the plaintiffs. “We will be done. The money will be distributed. These victims will get some measure of relief.”

So just under $100 million per death if distributed equally. Which is a good amount, but then they are also going to be hit with taxes and it puts them into a whole other tax bracket so I feel that it will be much much less.

SURFSIDE, Fla. — Fast asleep and unaware of what was about to happen, the residents of Champlain Towers South had no reason to question their safety the night of June 24, 2021.

After all, they were living in paradise — right on the Atlantic Ocean in the relatively quiet town of Surfside, just north of Miami Beach.

But in the middle of the night, their sense of safety along the shore violently evaporated as the building's pool deck suddenly collapsed. Half of the 12-story structure would follow minutes later.

Millions of Floridians live in high-rise condos, so the deadly collapse in Surfside left many people wondering just how safe they really are in their own homes.

State lawmakers promised in the immediate aftermath to do whatever was necessary to prevent another tragedy, but their proposed bills went nowhere in Tallahassee — at least not until last month.

During a special session to address the unrelated property insurance crisis, Florida's House and Senate passed legislation to ensure residents are living safely in similar buildings.

All Florida condos three stories or taller must now undergo a structural integrity inspection before 2025, and their associations must keep enough money in reserve to fully fund all necessary repairs.

1 year after Surfside collapse, local officials still working to ensure buildings are safe

The devastation at Champlain Towers South was -- quite literally -- a wake-up call for many.

"I couldn't believe it. As a structural engineer, I could not believe that a building could just collapse without any external force," said Dawn Lehman, a professor of civil and environmental engineering at the University of Washington retained by the Miami Herald to help the newspaper investigate the collapse.

"There wasn't a hurricane. You know, there wasn't a wind storm. There wasn't a flood," Lehman said. "So I was very concerned. And I said to myself, 'I don't ever want to see this happen again. And I want to do everything that I can to prevent it from happening.'"”

In the wake of Champlain Towers South's collapse, there was a rush to reexamine the safety of other buildings in the area as government leaders pledged their agencies would do what was necessary to give their residents peace of mind.

It would be $1 billion divided by 98 fatalities would be $10.2 million per deceased person. The families who have lost a family member will not receive as much as this because this amount is to compensate the loss of everyone who tragically died, provide compensation for the survivors who have been injured and compensate for the financial loss of the value of each apartment.

I’m glad the families will not have to spend years in court with expensive and extremely stressful litigation when they continue to deal with the long term trauma of the devastating tragedy and loss they have experienced.

There must be mixed feelings in the community about a new condo building going up on the site. The developer is going to need to be sensitive to the victims families feelings and people living in the community because it is the place where their loved one(s), friends, neighbours and Co-workers tragically died in a traumatic and devastating way and not a means to make a lot of money with a fancy condo building like the one next door. I’m sure there will be a permanent memorial for the victims near the site. It must be difficult for the community to see the empty lot where the building stood for years on a daily basis. Even when the new building is up all the victims who lost their lives and the horrific tragedy which occurred on that terrible night will not be forgotten.

It was the bang of roadside construction equipment along I-595 that did it. Suddenly, Nichole Notte wasn’t behind the wheel of her Jeep, she was back on the pile at Surfside with her search and rescue dog, Dig.

She could smell the dust of the crushed concrete and hear the shouts of her fellow first responders as they frantically — and fruitlessly — sifted through the rubble for survivors.

BEEP BEEP BEEP. Her forward-collision warning snapped her out of it. Notte slammed on the brakes, her suddenly tear-stained face bathed in the red brake lights of the car she nearly hit.
[...]
A Broward Sheriff’s Office Fire Battalion Chief and longtime member of the vaunted South Florida Urban Search and Rescue team, Notte was the first person on the scene with a canine that morning at Champlain Towers South condominium.
[...]
By her own assessment, she turned from a swaggering, veteran firefighter with confidence and ambition to a lonely, anxious person plagued with nightmares, panic attacks and a crippling identity crisis.
[...]
When she first came home, Notte was supposed to go back to work within three days. She knew that wasn’t going to happen. As a battalion chief, she made difficult calls for a living. She was the one who decides whether to enter the burning building, and after Surfside, she didn’t trust herself to do that anymore.

Hearing report of building next door / nearby being evacuated.

“MIAMI — Residents of a Miami Beach building on the same street where a condominium collapse killed nearly 100 people were forced to evacuate on Thursday evening after officials determined the structure was unsafe and gave orders to leave.

Miami Beach spokesperson Melissa Berthier said around 4 p.m. Thursday that the city planned to post an unsafe structure notice and order residents of the 14-story Port Royale building to vacate immediately. Around 5 p.m., the condo board sent residents a mandatory notice to vacate by 7 p.m., the Miami Herald reported.”

Seems to be a cautionary evacuation.

Something to watch closely.

Engineers have recommended additional "shoring" to reinforce areas needing repair be installed in the Port Royale's garage to support a damaged beam. Officials said they expected the reinforcement to be in place within 10 days, the Miami Herald reported.

MIAMI BEACH, Fla. – Good news is coming for people living in the Port Royale building on Collins Avenue in Miami Beach: they could be back in their homes as soon as early next week.

“That will secure the structure and I think probably by Monday we should be able to tell the people they can come back,” he said.

Update - Is it permanent or temporary fix?

Engineer temporarily fixed damaged beams at condo and now will do a more in-depth analysis to recommend a long-term solution Miami

November 14, 2022 05:35 PM

Brian Calderone, the condo board-hired contractor who is with Fort Lauderdale-based engineering firm WJE, said the next step will be to do “a more in-depth analysis” to find out the underlying cause of the issue and figure out a permanent fix. But currently, “the structural condition of the subject beams are such that the building can be reoccupied,” Calderone said in a letter to the city sent on Friday.
The 14-story building was evacuated on Oct. 27 after another contractor, Inspection Engineers, which had been overseeing garage repairs at the 51-year-old building, told the board of “continuous deterioration” of a “main beam” in the garage, adding that one of the main beams had moved roughly half an inch from its original position.

Surfside safety reforms could spell trouble for Florida condo market

December 27, 2022
From retirees looking to downsize, young professionals trying to snag a starter home or snowbirds in search of a winter getaway, condominiums have long been a staple for anyone seeking a slice of Florida real estate on a budget. But safety legislation that passed earlier this year in the wake of the deadly Surfside building collapse could plunge the condo market into turmoil.

For years, condo associations across the state have deferred routine maintenance and put off budgeting for future repairs in order to minimize costs for unit owners.
[...]
Any building that’s 30 years or older must undergo an inspection before Dec. 31 2024 and then every 10 years after. From that point on, condos must perform professional reserve studies every 10 years. They’ll also be barred from waiving reserves.
