A hearing scheduled in probate court was abruptly canceled last week, and Simovitch filed a motion alleging that Deschamps was trying to obfuscate various matters concerning the estate, court records show.

Simovitch, in Tuesday’s motion, details what she calls a litany of “red flags” that the court should consider alarming about Deschamps. It said Deschamps has in recent days worked against Simovitch in the lawyer’s effort to find out what the estate is worth and to share that information with the court and public defender.

Simovitch’s motion alleges that Deschamps “had scolded counsel for not probating the estate quick enough prior to the arrest of Nikolas’’ and “even if Nikolas Cruz has assets available to him from his mother’s estate, which would require him to retain private counsel ... she would never agree to him being represented by anyone other than the public defender.’’

“A court squabble has erupted over the handling of Nikolas Cruz’s inheritance from his late mother — a fight that could determine whether the school shooter is entitled to be free representation from the public defender or must hire a private lawyer.

Boca Raton attorney Audra Simovitch filed an amended petition in Broward County probate court this week, alleging that Rocxanne Deschamps, a friend of Cruz’s mother who cared for Cruz and his younger brother after their mother died, should not be appointed to represent the estate. Simovitch is asking the court to appoint an independent personal representative.

Simovitch was retained by Nikolas as the probate attorney for the estate of his mother, Lynda Cruz, on Feb. 13 — one day before the Feb. 14 shooting rampage at Majorie Stoneman Douglas High School in Parkland.

Simovitch alleges that Deschamps will not allow her to visit Cruz at the Broward County Jail unless Deschamps is present. She has also “refused to provide the registration or title to a 2015 KIA believed to be one of the assets to Cruz’s mother’s estate, according to the motion.

Deschamps, who could not be reached for comment, filed an emergency petition on Feb. 15 in which she accused the public defender’s office of misconduct. Deschamps nevertheless has indicated she still wants the public defender to represent Cruz, Simovitch claims in her March 6 motion.

Its not clear how much Nikolas and his brother stand to gain from the estate. His mother had been hospitalized with a respiratory illness prior to her death on Nov. 1. Their father, Roger Cruz, died in 2004. At the time of her husband’s death, the estate was worth an estimated $1 million, according to court records. In addition to his wife and two adopted sons, Roger Cruz also had four other children from a prior marriage.”

Its sad that Zachary is defaulted to being in the middle of this while in a most vulnerable time. No one else to come forward to act in his interest.

Deshamps has no right to not allow Simovitch to visit Nikolas in jail without her present. He is not a minor and she is not a guardian in any way. The attorney just needs to make an appointment to visit Nik in jail and go.

Prairie, thanks for the insight. I’m hoping that someone can intervene before anything else takes place. The article is detailed with other factors that can answer your question. I can’t and I’ve only briefly read through it.

If no one else is objectively speaking to Zachary I imagine he is subject to Deschamps motivation. Without a neutral person he is clearly in harms way.

KDG, you had her well and truly sussed ages ago!

HOW did she get so very far in this process and why did nobody look at her records?

This is awful.. too awful..he was very shook on that phonecall he made to the police or ambulance on the night he left her home.. his photo of his mother went missing.. he lost the rag.. what the hell else went on there and what is her hold over Zachery?

These people had nobody genuine in their lives.. like some towering karmic debt- a black cloud of isolation over each member, for different reasons..
It's beyond astounding..

I noticed that public defender for her kindness to him.. she was very gentle and she witnessed his break down following his massacre..

Is there a whole other element in his life we know nothing about?

How has Rocxy gotten this far? I’m shocked that it hasn’t been recognized from the earliest of red flags. Who knows what hold she has on Zachary? Unfortunately in his fragile mind he probably thinks she appears to care.

I had seen kdg's earlier posts and I was having trouble understanding this alleged close friendship she said she had with Linda.. age difference, lifestyle difference..
I wonder how long they lived beside them, how well they knew Linda's kids.. what kind of a surface relationship did they all appear to have..

Obviously, I am wholly speculating, and quite wildly, but my mind is driving me hard in this direction..

Nik and his brother grew up Catholic.. The only reason I mention it is that I am getting a feeling of 'cult', but I have seen nothing to support this feeling, nor have I researched it, yet.

I’m interested in how the Snead’s are going to navigate from here. To date there are 3 or 4 different accounts in their statements. Someone mentioned early on that James Snead was on the school board. I haven’t found anything to confirm that. Anyone know more on that, or where he is employed?

They had voluminous info to go on for the consideration of taking him in with caution. They chose to overlook it for whatever reason.

was cause of death on it.. i know you mentioned it, but lengthy article you posted couple of days ago seemed to suggest a progressive illness and that cause of death was unknown??
