Judge denies bid to ease bail restrictions for Curtis Reeves in theater shooting case

A judge has denied a request to ease bail restrictions for Curtis Reeves, a retired Tampa police officer accused in the fatal shooting of a man in a Pasco County movie theater.

Reeves' defense attorneys had asked last month that he be released from the requirement he wear an ankle monitor as a condition of his release from jail. They also asked that he be allowed to move freely within the Tampa Bay area and to have his son take custody of his guns.

In a terse order issued Friday, Pinellas-Pasco Circuit Judge Kemba Johnson Lewis denied Reeves' request.

PASCO COUNTY, Fla. — It’s something you don't get to see often in court, but recently Pasco County posted two hand-written letters. Both were sent to the judge overseeing the murder case against Pasco movie theater shooter Curtis Reeves.

The two letters both ask why it's taking so long for the Reeves case to go to trial, and even question whether there's favoritism being shown.

Reeves claimed he was standing his ground, but a judge rejected that defense.

Then, two years ago, state legislators changed the Stand Your Ground law to shift the burden of proof to prosecutors. Reeves and other defendants argued they deserved a new stand your ground hearing based on that change.

Since then, the case had been in legal limbo.

But on Thursday, Florida’s Supreme Court issued a ruling that could finally send the case to trial.

TAMPA, Fla. (WFLA) – A change made to Florida’s controversial stand your ground law in 2017 is not retroactive, the state Supreme Court ruled Thursday.

The 2005 law allows people to “meet force with force” rather than retreat if they feel they are facing a reasonable threat. Defendants would then have to prove in a hearing they were entitled to immunity.

However, in 2017, the burden of proof was switched and placed on prosecutors.

Thursday’s Supreme Court ruling means defendants whose cases were pending during the switch will not be entitled to a new hearing.

That includes Curtis Reeves, the retired Tampa police captain who shot and killed Chad Oulson in a Wesley Chapel movie theater in January 2014. Reeves claimed he was in fear for his life during an argument over texting.

The trial has been on hold because the judge has been waiting for the Florida Supreme Court to review the stand your ground law.

Cannot believe it will be six years in January. Reeves was responsible for taking Chad Oulson's life, and wasting many more. All over some spilled popcorn.

Before the judge and lawyers settled on the October trial date, Escobar fought to keep the case off the trial calendar. He suggested they reconvene in six weeks, after Escobar had a chance to talk with witnesses and figure out when they might be available. There are more than 127 witnesses listed, he said.

He also rattled off a list of other trials he has scheduled between now and the end of the year.

“I think this case should take precedent,” said Assistant State Attorney Glenn Martin, who had asked the trial be set for the spring. “We’re all busy.”

The judge agreed to set the trial date so Escobar would block off the time. No sense waiting six weeks when his calendar could be even fuller, she said.

“This is a priority case in this circuit and I understand that it needs to be tried," she said. "And it will be.”

After the hearing, TJ Grimaldi, the attorney for Oulson’s widow, Nicole Oulson, said it was clear Escobar was trying to delay.

“I think it’s almost reprehensible that this thing is still going on six years later," Grimaldi said. "'I think it’s an absolute joke to continue to say that they need more time to do things.”

First, off, SeesSeas, thank you for all you have done to keep us advised on the progress of this case on its zig-zagged path to trial. Very confusing -- and time-consuming!

In reading the article you posted here, SeesSeas, I failed to home in on the fact that Richard Escobar, the defendant's attorney, sought to have the trial date set for January 2021.
Response by Circuit Judge Kemba Lewis: “This court is not inclined to go into 2021. Really and truly it’s not.”

I think I can see where Escobar is going with this. He knows that once this case finally goes to trial, his client is going to prison for the rest of his life. Buying him additional time, outside prison walls, is the best he can do.

We can live with a two-week delay in the trial date. I still shake my head in utter disbelief about this case. What a tragic end, all around, to so many lives on account of Curtis Reeves' actions!
