DADE CITY — The case of the retired Tampa cop accused of shooting a man in a Pasco County movie theater in 2014 won’t go to trial this fall.

Curtis Reeves had a three-week trial date set for October, but in a brief court hearing Tuesday morning, lawyers and a judge agreed that uncertainty arising from the COVID-19 pandemic will likely make it impossible for the trial to happen as scheduled.

”When we made the October date, we didn’t think the world was going to stop spinning for six months,” prosecutor Glenn Martin said in the hearing, which was conducted by telephone.

April 5, 2021?! A six-month delay? By that time, the world will have been at a standstill for 13 months (+/-). This is unbelievable to me. But, it is what it is (!#&%).

Defense attorney Richard Escobar said a trial won’t be possible in the Reeves case until a vaccine for the coronavirus becomes available.

Pinellas-Pasco Circuit Judge Kemba Johnson Lewis agreed to reset the three-week Reeves trial to begin April 5. She left three days scheduled to handle pretrial matters in October.

I can understand the reasoning but at the same time it's like the defense is playing out time so Reeves dies before a trial can start. Frustrating and heartbreaking for Oulsons family.
 
We are closer to May than April 5th. Any idea? The Oulsons child/children will be off to college before this gets going. They just keep letting this guy slide. Who wants to get if he's going guilty he won't get prison time due to his age, and I'm sure failing health by then.

It was the beginning of three days of motion hearings for Curtis Reeves. He's charged with shooting Chad Oulson to death in 2014.

Could Curtis Reeves movie theater shooting case finally go to trial?

Looks like trial is scheduled to begin on Monday, Feb. 7, 2022 -- God willing, and the creek don't rise. Trial is expected to last three weeks.

“We are pushing to make that our trial date,” said Pinellas-Pasco State Attorney Bruce Bartlett, adding that the case has become “an embarrassment to the criminal justice system.”

But Thursday’s status check hearing was another signal that the trial might just happen this time, set to start Feb. 7. Barthle scheduled hearings for next week to resolve 19 outstanding motions and discussed a 20th motion pertaining to a defense expert witness that will be heard at a later date.

She also set the parameters for the jury pool: The clerk of court will summon 250 East Pasco residents to be considered for the six-member panel. They’ll be broken into groups of 50 people per day over five days of jury selection.

DADE CITY, Fla. — A judge in Pasco County is hearing several motions in the case of Curtis Reeves.

Judge Susan Barthle has made it clear that she wants these legal issues cleared up in time for jury selection, which is slated for Feb. 7.

Among the motions being heard are whether to exclude the testimony of defense witness Michael Knox, who testified during Reeves' stand your ground hearing, saying surveillance tape surveillance video from inside the theater doesn’t tell the whole story.

Prosecutors say Knox has a conflict of interest.

The state is also asking Judge Barthle to exclude character witness testimony from Reeves’ wife, Vivian, and his daughter Jennifer – as well as Vivian‘s testimony about being scared at the time of the shooting.

“You can’t prove somebody else’s emotional state – by someone who’s not in the same shoes,” argued Prosecutor Glenn Martin.

But Reeves’ defense lawyer Dino Michaels disagreed.

“It’s proper for the court to consider the individual sitting next to him, and in front of Chad Oulson, to be able to say that she felt scared or frightened,” said Michaels.

Reeves’ defense lawyers have motions of their own. They’re asking the court to allow them to address Oulson’s widow, Nicole, as an adverse party as well as witnesses from the Pasco sheriff’s Office. The legal distinction would allow the defense to use leading questions at trial.

A fifth possible juror was dismissed. She said she saw news coverage back in 2014, and she thinks Reeves was wrong and could've just walked away from the disagreement. She told Judge Barthle she didn't think she could set that aside if on the jury.@BN9

Fourth prospective juror was dismissed. She told the judge she's seen coverage of this case during the past week, including footage from a surveillance camera in the theater. She said she was a victim of gun violence and wouldn't be able to set those feelings aside.

A third potential juror was dismissed. She said she recently moved to FL and saw news of the case on TV last night. She told the judge her reaction was that Reeves should've known better, and she thought that would be in the back of her mind during trial.@BN9

Attorneys have gotten through 4 possible jurors in 90 minutes. Judge says she understands need to be thorough, but also stresses need to move it along. Reeves's attorney, Dino Michaels, said he's not trying to go slowly, but there are 8 years of memories to wade through.@BN9

A juror was just removed for cause after telling the judge he has strong feelings about the case. He told her he feels the shooting never should have happened and Reeves should've shown restraint.@BN9
 
This case represents everything that is wrong with our justice
system, a system that allows the defense to exploit its weaknesses
and delay the trial for 8 freaking years-- it is obscene!!!
It is despicable, although there were significant legal tangles with "stand your ground" issues. The Reeves' defense certainly seems to have played this in favor of their defendant who isn't sitting in jail for 8 years. But the injustice is too often from the prosecution, as in the Keetley case in a nearby county where the defendant has been in jail for 11 years:
