oh my God, he was so precious :(

If you go to the funeral home website, he's listed with lots of family pics of Chance . It seems like moms family is listed first in the obit. Not sure if that means anything , maybe they made arrangements ? I think Chance needs his own Thread . Mods ?
Also , it is a public funeral but media is not permitted. I can't copy or share from this phone. Many who never knew Chance are posting how sad they are .

ugh at their charges being reduced. I hope they get prison justice the both of them.

The picture of him in his crib brought tears to my eyes, to think of him lying there for days after his parents harmed his little body.

And am I wrong or did I not read that he was just 7lbs at 9 weeks? His birth weight according to those photos was 6lbs, 13oz. Or am I thinking of Duane being 7lbs at his death?

Where is the crib picture?

That doesn't make a lick of sense

It could be there is not enough evidence. It's definitely a case of he said/she said. And neither of the parents are going to be credible witnesses, IMO.

Walsh’s criminal history started as a teenager when he escaped from a juvenile facility in Okeechobee. By his mid-20s, Walsh was raising seven children with his first wife and becoming well known to law enforcement:

He was charged with aggravated assault and battery in 2002. The charges were later dropped.
He was charged with attempting to strangle his wife’s friend in 2004. Those charges were also dropped.
Walsh became a felon in 2006 after pleading guilty to aggravated assault with a deadly weapon. Walsh was on drugs when he jumped onto a kitchen counter top, lunged at his mother-in-law and attacked her with a kitchen knife, according to court documents.
In 2007, Walsh was charged with assaulting his wife. Those charges were dropped.

Much more at the link. I've been waiting for more news to come out since the charges were reduced. Hopefully a legal analyst will be interviewed soon and explain what's going on.

Can someone explain the reduced charges when Chance was murdered then left to decay? Isn't this heinous enough?

I was physically sick when I read the posts earlier today. Needless to say, I am outraged at the reduced charges.

Why no "neglect" charges against egg donor? Why no "indignity to a body" charge for both of them???

Poor little Chance was failed by so many during his short life. Now it looks like the justice system is failing him once more. Precious Chance never stood a chance in life nor death.

ETA: God help us all if this vile women ever procreates again.

R.I.P. Chance :rose: :rose: :rose:

This is appalling. :(

I'm flummoxed too. I don't know why Walsh wasn't charged with felony murder in the first degree - F. S. 782.04(2h)

Felony Murder

Felony murder occurs when a person kills another human being while engaged in the commission, or attempted commission, of the following statutorily enumerated felonies, regardless of whether they intended to kill anybody:
...
Aggravated child abuse,

http://www.leg.state.fl.us/statutes...ing=&URL=0700-0799/0782/Sections/0782.04.html

Maybe it's just wishful thinking but I remember reading in the Teresa Sievers case that the perps are charged with second degree murder also because only the Grand Jury can indict on first degree. In that case it's expected that the charges will be upped.

So, if that's true then maybe we'll see a change in Walsh's charges at some point:

WHAT IS A GRAND JURY?

The grand jury serves a very special function in Florida’s criminal courts. The only charge a State Attorney cannot file based on his or her constitutional authority is first degree murder. All first degree murder cases must be presented to a grand jury. In this section you will read an overview of what the grand jury is as well as certain functions of the grand jury. Additionally you will find investigative reports and indictments by the grand jury.

I so hope that's the case here. Second degree murder has a mandatory minimum and a maximum of life but I want to see a mandatory LWOP for this creep. I never want to read that he's up for parole!

Thank you for that MsMarple. It makes me feel a little better.

here in CA killing a child while abusing them is a qualifier for LWOP. why the hell isn't it in FL?

Well, it actually seems to be the case in Florida too and it's called felony murder (as opposed to premeditated murder, which requires evidence that the murder was planned beforehand). So what we're missing right now is why the current charge is murder in the second degree.

One possibility is that the Grand Jury has to bring a murder one indictment and it hasn't been convened yet. Another possibility is that the prosecutor is looking for a "soft" win but right now I'm not buying it. I'm waiting for msm to explain what the hell is happening...

Seriously, WHY did this guy's charges keep getting dropped? WHY was this guy free to hurt another person? (-this time a little innocent baby). It's crazy.

Sometimes it's because the victim drops the charges, ie refuses to testify against the person, so there's no case.

Good question...For Florida (and I'm new here, so I hope these links are acceptable sources):

http://statelaws.findlaw.com/florida-law/florida-first-degree-murder-laws.html

"For a charge of first degree murder based on a premeditated killing, the prosecutor must show the defendant's specific intent to kill. The prosecutor often must establish an advance plan or design formed to carry out the homicide. To establish premeditation, the prosecutor may need to present evidence about the defendant's activities or steps taken to prepare for the killing." (Doesn't look like they have this evidence.)

2nd degree: No premeditation on JW's part. http://statelaws.Florida state laws permit the prosecution of second degree murder when the killing lacked premeditation or planning, but the defendant acted with enmity toward the victim or the two had an ongoing interaction or relationship. - See more at: http://statelaws.findlaw.com/florida-law/florida-second-degree-murder-laws.html#sthash.qmLrOHeM.dpuf

Manslaughter: Culpable negligence. KB didn't prevent it or report it, and engaged in drug use ("reckless behavior"). http://statelaws.findlaw.com/florida-law/florida-involuntary-manslaughter-laws.html

I think these charges are more likely to get a swifter conviction and max sentence with the evidence (and I'd rather see appropriate charges than an over-charge of 1st degree resulting in no conviction..... JMHO....).

Justice for Baby Chance

(Sorry for the multiple copy/pastes! Getting accustomed to a new laptop, Windows 10, and WS website... I think I should change my User Name to "JustTechnicallyChallenged".....GAHHH.)
