Mental health hearing for KM set for 5/5/17.
This is large! I foresee “not guilty by reason of insanity” defense. This is an indication that she will not rat. By implication, it portends that the alleged masterminds are off the hook.

No way! How could this woman ever be shown to be insane? Seems she knew exactly what she was doing.
Money brings her the things she so desperately needs and feel are important. Bust enhancement, cars
(specifically an Escalade), new home furniture etc. This woman is NOT insane. Greedy, unloyal, unfaithful, cunning, and a murderer for hire (without having to pull the trigger.)
This is a joke and everyone knows it!!

I think that a mental health hearing is common practice to determine competency in FL murder trials but I could be wrong...?

This all just sounds like buying time to me - and another diversion.
Even if it is something that has to be done anyway, I have a suspicion she will be very well trained in verse by the time she fronts for a Mental Health assessment.

And listening to the Sound Cloud conversation between SG & KM is weird - their personal connection to each other, beyond the bounds of kids, seems very clicky and together - he calls her 'love'.

<mod snip>

This case has been so....infuriating for as long as most of us have been on this thread that sometimes, you just have to laugh and poke fun at the absurdity of it all. I'm a woman and I have a hard time reconciling the fact the KM is of the same gender. Or maybe I should say of the same species.

Given the prominent role they may play in this case, will attempt to treat the subject(s) with greater dignity.

Prosecutors are seeking medical records that show Dan Markel’s former brother-in-law paid half the cost of breast enhancement surgery for the girlfriend of one of the law professor’s accused killers.

Prosecutors say Charlie Adelson paid for half of a $6,000 to $7,000 breast implant surgery done by Dr. Leonard Roudner, also known as "Dr. Boobner," in October 2014, roughly three months after Markel’s killing.

Prosecutors say the procedure is significant to the homicide investigation but is not the only record they are seeking.

“You can spin it any way you want to about who paid for the augmentation and what that means,” said Assistant State Attorney Anna Norris in court. “But if Charlie Adelson paid for it, that’s very significant when there is a homicide investigation where there is a conspiracy between him and Ms. Magbanua.”

A state’s witness provided Roudner’s name, the address of his Coral Gables practice and how much was paid for the procedure. Prosecutors say there are social media photos of the breast enhancements.

Just for studying criminal defense, let us see where this move could go. Everyone is innocent until proven guilty, as the saying goes. KM is innocent until proven guilty. If she is mentally ill, she cannot be guilty. She needs not to rat any alleged masterminds, if applicable, if she were not guilty.

“Reputed Cosa Nostra boss Vincent “The Chin” Gigante deceived “the most respected minds in forensic psychiatry” for years by malingering schizophrenia.” (Newman A. Analyze this: Vincent Gigante, not crazy after all those years. New York Times, April 13, 2003.)

The literature reports many cases of false positives in malingered psychosis. Among other tests, the MFAST appears to be the strongest but it has been defeated. (Jackson RL, Rogers R, Sewell KW. Forensic applications of the Miller Forensic Assessment of Symptoms Test (MFAST): screening for feigned disorders in competency to stand trial evaluations. Law Human Behav 2005;29(2):199-210.)

Besides economic gain such as disability benefits, the most common reason for malingered psychosis is criminal cases. (Miller HA. Examining the use of the M-FAST with criminal defendants incompetent to stand trial. Int J Offender Ther Comp Criminol 2004;48(3):268-80.)

If vast resources are at the disposal of people, and if they have access to the best minds in criminal defense, I could imagine people escape prison for bad or for good, for year. As of financial price, it is always expensive to buy the best defense in any country. When the price is right, criminal defendants could be off the hook when incompetent to stand trial.

she doesn't seem schizo.
Wonder what this is all about tho.
What are other possibilities - lawyers?

LR apparently has a mental illness, but it does not seem to be of relevance in his case.imo
Surprised SG did not try to play the crazy card, KM must have already ear-marked that one, imo, speculation.

Rivera was convicted in five separate drug cases before he was 17 and spent most of his youth on drugs, federal court documents say.

“Luis Rivera is uneducated, cannot read or write and has been on the streets with little family guidance since before his teenage years,” his attorney in the racketeering case wrote. “He further was diagnosed with schizophrenia since he was aged 10.”
The federal case alleged he used his gang ties to defend his family and business aspirations from rivals who had moved into his territory.

How much are her lawyers paying for gas and hotel stays plus food to do all of that back and forth traveling to represent her and prepare her for trial?

Do they have a Tallahassee associate that does the basic local footwork for them or what?

Thanks in advance.

IMO -

1. a lot - more than KM and her "immediate family" can afford.
2. doubtful.

If I was facing a life sentence while having paid lawyers. Then I would want to to see them in jail 3 times a week to go over things .

So why is KM picking lawyers that lives 5 hours away?

I agree with you, and the unstated reasons why these attorneys are defending her. For emphasis, Google Maps puts the one way drive from Miami to Tallahassee at closer to 8 hours. My guess is that KM is probably buying plane tickets for her private defense team.

Actually, it's closer to 7 hours according to Google maps - that's without taking into account stops for gas, restroom breaks and meals. Or you could fly, but the return airfare is at least $500.

Agree with both.

So I guess it would be safe to say that her family can't afford all of this for the travel time and travel cost alone.

So who is really paying her legal fees.

Plus I want to know what does she buy in jail for her commissary account?

Because we seen what Casey Anthony and Mark Sievers were buying while locked up.

So hopefully the news reports if she has alot of money on her commissary account.

But anyways. I doubt her family has the money to truly visit her, yet alone be able to afford 2 lawyers that need to travel to visit her as well. Jmo.

,Regarding KM's mental health, I can't make a diagnosis but I do observe in her some hallmarks of Narcissistic Personality Disorder. From Psychology Today:

The hallmarks of Narcissistic Personality Disorder (NPD) are grandiosity, a lack of empathy for other people, and a need for admiration. People with this condition are frequently described as arrogant, self-centered, manipulative, and demanding. They may also concentrate on grandiose fantasies (e.g. their own success, beauty, brilliance) and may be convinced that they deserve special treatment.
<snip> https://www.psychologytoday.com/conditions/narcissistic-personality-disorder

Obviously, KM has no empathy for others if she is so coldhearted as to set up the hit of someone who poses no threat to her. I don't know if she even met Dan. If she did, I could see her feeling he was a threat to her perception of her own brilliance and success. The breast enhancement exemplifies her need for personal admiration and perception of beauty. She could have rather saved up the money for her children's college education. Did she spend any of the money on her kids or only on herself? Certainly the majority she spent on herself which shows immense selfishness, but then she demonstrated immense selfishness when she considered another person's life worth taking in exchange for material assets and a breast enhancement for herself. Also, she does not appear to have a conscience, exemplified by setting up the hit and, so far, refusing to admit her role and to testify against the A's.

Just anticipating that these will be the findings of a psychiatrist, how could a diagnosis of a Personality Disorder affect KM's case? I'm especially interested in hearing from lawyers/former lawyers who post here. TY

Think she was living for the moment as it applied to her. Very self centered indeed with little planning for the future.
