As Special Counsel Jack Smith’s appeal in the classified documents case against President Donald Trump gets underway, a federal judge here in Atlanta has set a date for Smith to file his opening brief in the case.

Smith must file his brief by Aug. 27. Trump’s attorneys then have 30 days to respond to that brief. Following that, Smith had 21 days to file a reply.

If the appeals court rules in favor of Smith, then that would result in the reinstatement of the indictment against Trump and even conceivably the reassignment of the case to a different judge.
 
Donald Trump is set to sue the Justice Department for $100 million over the classified documents raid on his Mar-a-Lago estate, according to reports.

A retired federal judge is among those asking an appeals court to reassign former President Trump’s indictment on charges of mishandling classified documents case to a new judge.

In documents filed with the 11th Circuit Court of Appeals, two groups of legal experts and former government officials say U.S. District Judge Aileen Cannon should be removed from the case. They’re seeking permission to file an amicus brief.



Their reasons are explained in the article ... Cannon ignored the plain text of the Appointment Clause, and her defiance of Supreme Court precedent. They want her ruling reversed and for her to be removed from the case.
