Maybe they can do a charging document that doesn’t rely on something they got from something she said. They’re not stupid. They wouldn’t have asked her something that would lead to something they really needed. There is still that text asking if Dan will be home. There are cell tower records showing her driving by the scene. There is her police interview.

What did she say on the stand that gave them anything? They’re not going to go out and find additional evidence based on what she said. JMO. Again, they’re not stupid, and they anticipated this. They know what derivative use is.
I think there is plenty against her independent of any testimony she gave at trials. However, maybe the calculation will be they don't want to get bogged down in the expense and the time of Attorneys in litigating those issues through appellate courts. The case against her is far from a slam dunk. They have way more easily against DA

And it is I'm sure part of the tactic in WA & her team leaking that information out there to dissuade them from arresting her. But I do think it is an uphill battle to prove the case against her beyond a reasonable doubt.
 
And she’s definitely the type to be manipulative like that! I’m having a hard time believing she was stupid enough to discuss such things on a jail phone call!
Agree. It is very confounding that either of them would talk and say that on a recorded line. That then made me start thinking that really, included in her saying those other things, was her probably trying to plead her story that they are innocent, they were being extorted, and she just doesn't know what else to do. Crying and manipulating and hoping that at least one or two jurors feel sympathy for her. I mean look at the first KM trial. The one woman knew she was guilty, but decided to nullify her responsibilities as a juror and let KM go because she didn't want their kids to have no parents.

Wish I knew someone who worked at Miami airport, terminal S, gate H10! Bet there is security camera footage of the arrest!!!

I flew in late last night and we got held up on the jetway to the plane in Dallas after we checked our boarding pass with the attendant for our connecting flight home. We stood there for a good 15 minutes on the jetway waiting for the cleaning crew to finish up. There was a lady in the front of the line screaming at the top of her lungs and TSA came and got her off the jetway and hauled her off. People had their cellphones out filming the drama and cracking jokes! There has to be footage of Donna’s arrest! Lol I want to see it!

I wonder where Harvey is in all this? We don’t know much about his personality. I doubt he continued on to that plane to Vietnam. Gotta wonder what’s going on in his mind today and if he’s further shifting around funds, or if he’s considering offing himself. I wonder if Donna and Harvey put all their assets into a family trust that Wendi and the boys will eventually receive?

There are so many thoughts going through my head I can’t organize them.

Like…if they were fleeing forever- what about all their properties, their home, their responsibilities, bills… etc …was Wendi going to handle a that? Cause she can’t even handle her own life!
GYPSY ROAD I always look forward to your posts..well grounded (pardon the pun.) Yep, have wondered about all of that, too. When we had to "walk away from everything" with zero notice...I could handle it because I had my spouse by my side. Maybe in their minds, flying off together made it tolerable/viable option.
 
Is Donna on suicide watch in Miami-Dade? Does this mean she is watched 24/7?

It would be a horrible thing if she hung herself and didn’t face consequences for Dan’s murder.
Well, if she's already in a turtle suit and she's discussed ' a suicide' on recorded calls, she's going to end up trying to sleep with the lights on & potentially being woken throughout the night.

Poor Donna.......

I would like to see a video of HA after the arrest....was he just free to continue onto the plane,,,go with them and his wife or just return home or what?
 
Given the very strong case against DA, the family dynamics, and the weaker case against WA (though without a doubt she was a co-conspirator and guilty of FDM), I believe this will end up with deal forced down WA's throat by CA with threat of his testimony aga. her resulting in a plea deal involving lesser crimes/sentences for both WA and DA.
This makes a lot of sense.
 
@amicuscurie -- I just posted the article as an example. I'm not saying it's the same! And of course her investigatory interview is fair game and not covered by the use/derivative use immunity rule. I think you're misunderstanding what we are saying. We're not saying it would be impossible to prosecute her because of the use/derivative use immunity rule.
I think Jansen is making it out to be a bigger deal than it is. It does indicate she is worried about being charged. They can take their shot. But I don’t see this as a Kastigar situation, sorry.

He has a history of violence*, tax avoidance, and all sorts of stuff.

ETA - Judy had also said that Floridian law makes it easier to protect assets but hopefully somebody knowledgeable can flesh that out further ( I recall her reffing points about OJ moving to FLA as an example)

If she'd been super smart wouldn't she have consulted a specialist before the first trial she testified at?

Homestead in FL. It's also what doctors do partly to avoid medical malpractice cases. There is no medical malpractice insurance required in Florida.
 
Yeah but the more WA testifies under oath, the more they have to work with to find a lie. And as soon as they find a lie she made under oath, that immunity deal can be challenged. And there's probable cause for an arrest, maybe, because she's committed perjury.
Hi SLICK762, nice to see you here! I think the "lie" lies in the WhatsApp questioning. IMO WA committed perjury on that point. From my memory, it was quickly brushed aside, after GC warned WA the prosecution had recordings/records, DR objected, judge ordered a sidebar and then never addressed again. (Just my memory of how it happened, Hmmmm)

I think the real issue has always been do they have enough evidence to prove a potential charge against Wendi BARD.
