The defense tried this angle during the hearing -- 'If I take the parents off the witness list, can this whole thing go away?' and the Court was not having it and ruled subpoenas would be issued and he would consider contempt charges if they did not honor them.

I really hate it when any side makes a mockery of the Court and/or its Orders! If true, why put the parents on the witness list to begin with-- other than the defense was relying on the Discovery deadline of 9/22/23 per the Case Management Order and thought they could pull this over the prosecution citing a technicality!

I trust Georgia Cappleman's chess gamesmanship. She's going after as many as she can, so if it serves her better to not deal with 5th pleadings and immunity offers to get the rest of the Adelsons, and she has enough against Charlie, then....

Sort of off topic, but while being transported and traveling up to Tallahassee, I wonder if SG will ponder at all what he did and if feels any remorse at all? And will he finally tell the truth?

Have all of his appeals been exhausted? Or are they still going through the court system?

10/15/19 Update: Judge gave jury instructions. Closing arguments done. Jury sent to deliberate @ 10am ET. After about 30 minutes of deliberations the jury came back with LWOP. Judge sentences Garcia LWOP for 1st degree murder & 30 years for conspiracy charge.
11/4/19 Update: 11/4/19: Motion to Withdraw as Counsel: Mauricio Padilla; Motion to Withdraw as Counsel: Saam Zangeneh
8/24/23 Update: Motion for Post Conviction Relief filed by Garcia. Relief based on ineffective assistance of counsel during trial & appeal. 8/29/23 Update: Order to Show Cause. Ordered & adjudged that Office of State Attorney for the 2nd Judicial Circuit of Florida shall now show cause within 60 days of the date of this order why a hearing should not be held on Defendant's motion signed by acting Circuit Judge Jason L. Jones.
9/6/23 Update: State's response to defendant's 3.850 Motion & request for hearing. The State requests for the foregoing reasons that the Court set the defendant's motion for post-coviction relief for an evidentiary hearing filed by State attorney Jack Campbell.


So - I have nothing after 9/6/23 with no date set for this evidentiary hearing - unless I missed it....

No bond (denied bond 4/26/22). Bond release denied (9/9/22).
Jury selection set to begin on 10/23/23. (3 to 5 days for jury selection to 10/27).
Trial set to begin on 10/31/23. (thru 11/9/23).
Judge Stephen Everett presiding. Prosecutor Georgia Cappleman. Defense attorney Daniel Rashbaum.

10/12/23 Update: Judge Everett schools Donna & Harvey Adelson's lawyer. Denies their motion to dismiss. Denies a stay so they can appeal. Said that if they aren't produced for the investigative interview on 10/17/23, it will move into contempt proceedings.
10/16/23 Update: Judge Everett DENIES defense’s motion to suppress (wire taps). Next pretrial hearing on 10/20/23 @ 9am.
10/17/23 Update: Investigative interview for Donna & Harvey Adelson on 10/17/23. Word via an inside source (who has an inside source) that they were dropped from both witness lists & did not do any interviews [per katiecoolady].
*Katharine Diana Magbanua (32/now 38) – 5/27/22: Found guilty on ALL charges Sentenced on 7/29/22 for murder LWOP & for conspiracy & solicitation two 30 consecutive years in prison. 8/4/22: Magbanua has transitioned to the FL Department of Corrections Women's Reception Center in Ocala, thus ending a very lengthy six-year stay in the Leon County Jail.
*Sigfredo Garcia (34/now 40) – 10/10/19: Found guilty of 1st degree murder. Guilty of conspiracy. Not guilty of solicitation. Sentenced to LWOP for murder plus 30 years for conspiracy charge. 11/4/19: Motion to Withdraw as Counsel: Mauricio Padilla; Motion to Withdraw as Counsel: Saam Zangeneh. His appeal was denied.
*Luis Rivera (33/now 39) charged with 1st degree murder. Took a plea deal (Oct. 2016) & plead guilty to 2nd degree murder. Testified against Garcia & Magbanua. Will receive 19-year sentence to run concurrently with his 12 year Federal time, which he is already serving.
POIs: Wendi Adelson (ex-wife of Markel), her mom Donna Sue Adelson (68) & father Harvey Adelson. Investigators have not charged any of these people in the Adelson family in connection with Markel’s death, except Charlie; but say Adelson’s mother & brother – Donna & Charlie Adelson – paid $100K to have Markel killed following the couple’s contentious divorce so their two young sons could move to South Florida.

Following KM's mistrial Sept 2019, this is what CA's attorney had to say about his client Charlie and his family:

In a statement, Charlie Adelson's lawyer, David Oscar Markus, had this to say about the outcome in the Dan Markel trial:

"My first reaction is that I hope the Markel family feels some sense of justice and relief that Garcia was convicted. This trial must have been so hard and taxing on them. My second reaction is that the prosecution couldn’t prove its theory on Katie after 3 years of really thorough investigation and preparation. This is why they have not charged Charlie and his family — the case simply isn’t there. We don’t charge people based on podcast and internet speculation. The prosecution rightfully understood that it couldn’t prove a case against Charlie before this trial. After the hung jury, its prospects have gone down not up."

I have mixed feelings about SG testifying here. First, I don't think this guy is very bright. He did absolutely nothing to save himself during his own trial --knowing that his childhood friend, LR, who witnessed him shoot Dan twice, was testifying against him. With an eye witness to his crime, SG attempted to appeal his conviction based on ineffective counsel! What? IMO, the jury saw the same and spared him death.

Does the state really need SG to convict CA? I worry for the children of KM and SG and the impact this has on them-- especially coming of age where they realize their dad was their mother's pawn. I also think testifying endangers the life of an inmate like SG and the state is aware of this.

I feel differently about KM -- if not for her, neither SG nor LR would not have been involved in the brutal death of Dan. I think she derived pleasure from her role. IMO, she needs to finally come clean on her role and her motivation: $$$$ and the attention of CA. MOO

High-quality pre-trial video of this morning's pre-trial meeting, via Tallahassee Democrat, ~25 minutes.
Starting with a pool of 50 jurors on Monday morning, adding 50 more in the afternoon, repeat the following day(s) until 12 jurors + 3 alternates selected. Judge estimates jury will be seated by Thursday or Friday. Judge set trial hours to be 9:00 AM to 5:30 PM and he is reserving the first few rows on his left for media and cameras.
