Ok, I am going to watch this from the beginning, but how can it be 1st degree murder if it technically not pre-meditated? Sounds like a rage case.

Such malice is a required element to prove first degree murder. 2) a general evil and depraved state of mind in which the person is unconcerned for the lives of others. Wow! I just woke up and my head is still cloudy. I'm actually happy with this verdict, right now. The first two counts should definitely be retried even though MD will be in prison for the rest of his life. They have to, IMO, just so the GP can understand the difference between premeditation and non premeditatiion. JMO
 
I would love to hear how Dunn felt threatened by Tommie Stornes going into the gas station to purchase a pack of cigarettes & a pack of gum then driving away while Dunn was firing shots at his vehicle.

Yes, Angela Corey has already stated at this point, the state will retrial Dunn for 1st degree murder of Jordan Davis. They will speak to the victim's family to make sure they would like to proceed as well.

I have a question for one of our verified attorneys. I sure hope one will be weighing in on this.

If MD is retried on Count one - murder of Jordan. And if he successfully is acquitted under the self defense defense, does that mean he acted lawfully? If he acted lawfully in discharging his weapon under that defense, then how can he have attempted to have murdered the other young men.

Because this is what I think the jury was confused about. They saw the event as one linked event so had a hard time separating the counts.

Could the defense attorney be eyeing an appeal on that basis and if so what would that appeal look like?

Sorry mind ran off on a tangent. its the devils advocate side of me.

Most likely will not, first offense. Marissa Alexander got three conviction for the same thing and she had violated probation! She got 20 years.

Why? Because there's a holdout on the jury? To anyone with a clear mind the case was slam dunk. The prosecutors did a good job. It's not their fault that one juror couldn't understand the facts. JMO

Angela Corey has had numerous problems causing Floridians to want her ousted. She was fired from State Attorneys Office in 2007 and took over Florida's Fourth Circuit in 2008. She fired fired half of the office’s investigators, two-fifths of its victim advocates, a quarter of its 35 paralegals, and 48 other support staff.

"When Ron Littlepage, a journalist for the Florida Times-Union, wrote a column criticizing her handling of the Christian Fernandez case — in which Corey chose to prosecute a twelve-year-old boy for first-degree murder, who wound up locked in solitary confinement in an adult jail prior to his court date — she “fired off a two-page, single-spaced letter on official state-attorney letterhead hinting at lawsuits for libel.”

And that was moderate. When Corey was appointed to handle the Zimmerman case, Talbot “Sandy” D’Alemberte, a former president of both the American Bar Association and Florida State University, criticized the decision: “I cannot imagine a worse choice for a prosecutor to serve in the Sanford case. Just finally catching up here with all of you. I am very relieved that this is the outcome, when I think of what has been running through my mind the last couple of days. Now we know why it was taking so long. I am satisfied with the convictions on the 3 attempted murder charges. I was really biting my nails thinking this was going to be another huge disappointing decision.
Thanks again for all of your company during this trial. There is no better group to experience this with.
I will see you back here for the retrial. Usually goes better, faster, and the verdicts come in quicker.

IIRC, the judge doesn't have a choice. They have to run consecutively. I'll see if I can find something on it.
 
My heart goes out to the Davis Family...to Lucy McBath and Ron Davis...and all of their friends and family. I thank God that Michael Dunn will have a long time to think about just how "right" he was to shoot an innocent kid (even one with a big mouth)

The only bright side to all this is that Michael Dunn destroyed his own life while trying to be a "big old white guy with a gun". He will never again have the kissy kissy life on the beach with his girlfriend and his dog...or fly another airplane into the clouds...or attend another wedding of any of his children. He took away so much from the Davis family, but he took away so much from his own. Though it will never equal out...it does make the bitter just a little easier. Even knowing that his family will see him on visits, they are such angry people hopped up on fear and Fox news, there will never be peace for any of them. Their life of hell is just beginning...the Davis family can move on and try to rejoice in the short years they had with their son. Michael Dunn will die a slow death, waking up every morning knowing that he has done this to himself.

I wonder if Dunn had shot all the teenagers in the truck if he would have been acquitted????
