Michael David Dunn will have a new lawyer paid for by the taxpayers when he is retried on a charge of first-degree murder in the shooting death of 17-year-old Jordan Davis.

On Monday attorney Cory Strolla withdrew as Dunn’s lawyer because Dunn is broke and can no longer pay him. Waffa Hanania with the Office of Regional Conflict Counsel was appointed as Dunn’s new lawyer.

Interesting about Strolla quitting. I found him to be a pretty good def lawyer. I wonder if he could have continued to defend Dunn if he was willing to accept what the state pays? Perhaps he just doesn't want to waste his time with that looser Dunn.
 
Strolla is way too smart to continue this folly. He knows Dunn will be found quilty...if he thought it was a winner he would stay on just for the exposure. He was absolutely the best Dunn will get and my guess he will go through a few public defenders as he (and his daddy) seem very difficult to deal with and they sure don't have the facts on their side. What a waste of taxpayer money. Guess daddy is broke now too...sorry.
 
Prosecutors say there's no provision under state law to delay the sentencing, which is scheduled for March 24. The retrial is tentatively scheduled for May. (snip)

Healey set a 10 a.m. Friday hearing at which he is likely to rule on the motion to delay sentencing.

Completely MOO only, but he did better than I expected, too. That being said, it just wouldn't make sense financially for Strolla to continue. Even if he was paid scale by the PD office, he'd have to pro bono his travel expenses or something for the 2.5-3 hour drive from Brevard County to Duval County. Plus, if the venue of the retrial were changed, it would probably remain in the 4th judicial circuit of Florida, which would mean either Nassau or Clay counties, and both are just as inconvenient as Duval for him.

From the intangible, attorney reputation-buillding perspective, Strolla made the publicity he neeeded from successfully avoiding the murder conviction the first time around. Sticking around for the new trial would be a situation of diminishing personal returns. There's more downside than upside for him to risk defending it a second time around. Refocusing on his practice in Brevard County makes a lot more sense than trying to work a financial arrangement to continue on with a broke client that's nowhere near his home base. Plus I'd guess that if the new defense needs his insights and suggestions, he can probably make money ad hoc as a consultant with the defense without leaving home or losing more time away from his practice.


As an aside, personally, I'm guessing that the defense will try for a change of venue for the retrial - they'll blame the local publicity, but if they move further away from Jacksonville, their odds are better of landing in a less urbanized, less diverse county, and more conservative county in northern Florida. The defense might therefore see a change of venue as an opportunity to get an even more conservative jury pool than the first time around. I'd be surprised if it succeeded, but I'd be very surprised if they don't try for it.

Again, strictly MOO and my own personal conjectures.
 
I have to say, I don't blame Strolla for ditching a money-losing proposition at this point.

IMHO, Dunn wasn't very happy with the outcome of the first trial. He believed he would get an across-the-board acquittal and he's now facing up to 60 years in prison on the attempted murder convictions. I can't recall how many times we heard it mentioned that he had a stronger case than Zimmerman.

I'm sure that fact, plus the cost of a private attorney caused those "minor" differences. I doubt his family has that many resources left after bankrolling trial #1.
 
JACKSONVILLE, Fla. -- Nearly one month after the first-degree murder trial of Michael Dunn resulted in a hung jury, the State Attorney’s Office released new documents in the case Tuesday.

The documents included a list of more than 450 jail house phone calls Dunn made in the last six months. The recordings of those call were not released, but Action News did obtain other recordings last month, that indicate Dunn was at one point kept in solitary confinement.

JSO declined to comment Tuesday on Michael Dunn's status when he was housed in a cell back in December, when officers took pictures of signs and quotes written on the wall in pencil, that appear to be related to his case.

On one wall there is a "no ” sign, while others read, "Sometimes your life just changes in the blinking of an eye," "Self-defense is not a crime," and references to two of Florida’s self-defense laws.

Defense attorney Cory Strolla argued during a hearing Monday for Dunn's sentencing to be delayed on the grounds that statements Dunn makes at a sentencing hearing could be used against him in his second trial.

Strolla also said Monday he is stepping down as Dunn's attorney and asked Judge Russell Healey to appoint public defenders.
 
Somehow I don't think Dunn and his new public defender will exactly hit it off and no doubt his "daddy" won't like him either...just a feeling.Strolla made a very wise business decision and I'm sure he will never look back. Watch the fun.

It's crazy to think that by the time Dunn is re-tried and sentenced, Jodi will still be waiting for her sentencing re-trial, almost a year and a half after her conviction. Madness!

JACKSONVILLE, Fla. -The retrial for Michael Dunn in the shooting death of 17-year-old Jordan Davis has been delayed.

At a hearing Wednesday, the judge set a pretrial date for the week of June 9, when a trial date will be set.

The retrial on the murder charge had been scheduled to begin May 5.

Dunn's new lawyer, Waffa Hanania, took over the case March 10 and on Tuesday filed a motion for a continuance to give herself more time to prepare.

Prosecutors with State Attorney Angela Corey's office said they want Michael Dunn sentenced on three counts of attempted murder before he's retried for the death of 17-year-old Jordan Davis.

His attorneys said that is precisely the reason why they want to delay his sentencing, but Corey's office wants closure on those convictions now.
