While that's certainly possible and even understandable, it's not the way the article I was responding to was worded.
That article said

There is a world of difference between doing things that are immoral/highly unethical/creepy/etc., (which I believe we can all agree that she did, even if she did them unwittingly, which we cannot possibly know for certain) and doing things that are criminal. In JS's case, the PD has stated clearly she's not done anything criminal, to warrant charges - and that there are no plans to file charges.

Since they know more about this case than the public does, I'll trust them when they say she hasn't done anything criminal. Everything else she's done and said simply speaks for itself.

I see they worded it as “criminal yet”. Sounds like they expect she may do something illegal still going forward. I wonder if they imagine she may well perjure herself if called as a witness against SS. She certainly seems intent on protecting him.

Sources without a name or legal title is a little too vague for me to accept that JS is ruled out forever as having any culpability. It seems like what has been said from the outset, that there are still no plans to charge JS or possibly anyone else and I didn't see anything saying the investigation is completed and not still ongoing. JMOO

The one thing I can't get over.

According to JS, when Maddie didn't come out of school as expected, after JS had been sitting in the pickup line for an hour and a half (no comment), JS took a bunch of actions except the most obvious one: go into the school to find out if Maddie was still there for some reason.

That seals the deal for me.

I have been trying to ponder what scenario(s) might cause JS and SS to be ‘wedded at the hip’ from the get-go in this case? And I can only come up with one. One, maybe two. And neither are pleasant. :( And since authorities have elected now not to file charges for JS and with TOS can’t add here.

Reflecting back from the case outset, it seems IMO that both JS and SS did nothing but appear to stall, confuse, deflect, point elsewhere, blame the disappearance IMO in large part on dear little MS (she is forgetful, may have ADHD, probably forgot her phone, the birthday party was fine, and ‘that was it’, words to that effect etc.) - and we now know that one of those two was running around to dispose of MS remains and evidence. Now what of the other?……. MOO

It is so odd to me that JS could not be bothered to go out and physically search for her daughter in a meaningful way!

-She gets to the school for pick up - sits in her car outside the building for however long and doesn't see MS exit the building. so instead of going inside to find her daughter / talk to kids / staff... she drives... AWAY from the area to her mother's work place.
- Doesn't seem like she went to any local biz places to ask staff if they'd seen her.
- She does not go out looking in the days that follow - preferring to stay home in case she returns home.
- She tells the media she just wants her back, "whatever that looks like". She didn't say home. Just 'back'. Very telling imo.
-She doesn't share a photo of her daughter in her media interviews - not holding one up, doesn't remind viewers what her daughter looked like or the defining facial feature she had that they could recognize her quickly by. nope. Nada. She just sits at home. And waits.

I’m wondering, too, if they are intensionally giving her a long rope and perhaps her guard will drop when she is communicating with family or LE, or she will perjure herself, as you suggest. OMO.

Charges in future wouldn’t surprise me.

Added: This announcement might also be to stop the questioning of why or when they might arrest her — to get press and public off their back?

I really think she will be a disaster for the State on the stand! I hope she does perjure herself, and I hope they throw all the books they can right at her.
 
I really don't think prosecutors need her at all to make either case against SS. IANAL but it seems to me that putting her on the stand could open up a defense strategy that JS actually killed Maddie and SS simply helped her cover it up. I expect he'll use that defense anyway.

First off, I am not defending JS, I think she was a negligent mother and failed that poor girl so badly. So please, if possible, do not take this post as me trying to justify her behaviour. <modsnip> just want to make it clear I'm not excusing nor justifying anything, I'm just trying to share some info that might add a layer to the wider picture.

From my understanding, JS has been diagnosed with ADHD, which is a neurodevelopmental disorder, a real medical condition, not some kind of "modern excuse" or whatever people say to dismiss it. I don't know about the US, but where I'm from, getting a diagnosis and proper help is not an easy path, so saying somebody got the diagnosis just for drugs or something, seems like ignorance at best.

People with ADHD have issues with their executive function. I won't copy the internet here, because anyone can look it up if they care to. But from personal experience and the information I have learned over the years, so many of the "dodgy" behaviours JS is accused of, can be directly linked to her disorder. Staying calm in a crisis - known attribute of ADHD; mixing up simple information - known symptom, etc etc etc.
People with ADHD are often easy to manipulate, because again, their brain isn't braining the way a neurotypical's brain does. They are not dumb, but in a sense naive maybe, and accustomed to explaining away red flags in their head (the eternal devil's advocate).
If somebody were to put me on the spot and ask me how long I've been living in my current hometown, my guesstimate would be off by 2-3 years. Time for ADHD people doesn't work like it does for NT's. I would have to think really long and hard, try to date big milestones in my head (was covid 19 in 2019 or 2018, or 2020? there was something about the 19 not being the exact year but what was it...), look at pictures to get a mental image of what I was doing at what time etc.
I've always joked that if I was ever suspected of a crime, I would go down so fast, because my recollection would be a mess and behaviour very suspicious.

And maybe that IS what happened. Nothing would surprise me in this case at this point...
 
Someone on a youtube video made an excellent point that had not occurred to me.

In her accounts of what happened that morning, JS states that SS came into her room between 8 and 8:30 to put the leash on the dog.

Yet SS was seen on video with MS's body in the car at 8:19.

wow yes, you explained my experience (and many others with ADHD, I imagine) perfectly. i think you're right on here. i also echo that JS is suspicious for far more reasons than just her atypical functions.

Yeah, I'm multiply neurodivergent, including ADHD, and you'd never catch me defending a paederast and minimising to the cops about how raping a seven year old isn't evil.

I have a poor sense of time passing, but you can have that and still be lying out your backside. It's not one or the other, and the vagarities and inconsistencies in her statements cannot solely, or even primarily, be attributed to neurodivergence.

Also, I don't recall JS having the ADHD dx anyway, I thought that was Madeline. I thought JS it was anxiety, depression, and maybe bipolar.

I don't think JS knew MS was dead when she went to school to collect her. However, I believe she knew MS was deceased when LE soon after referred to the case as a homicide investigation. In fact, JS wasn't notified in person that MS body was recovered. She received a phone call. JS was with her father when Police called.
Yes, I think she did realize she was dead when she knew the homicide team was now on the case; she asked them about it, which I think most people would do. An officer tells you that 'this' team is taking over, which you know is the homicide team, the first thing I would ask in one way or another, was did they think the child was dead?
It might seem obvious from an outsiders point of view, that homicide team most likely equals dead, but as a parent you would try at least from hope to think there could be another reason, you want there to be another reason, so you ask.
It is hard to imagine myself in the situation, as what I would say right now could be miles away from what actually happens in such a situation.
They told her they had found A body or MS's body over the phone. It seems a bit cold to tell someone their child's body has been found over the phone.

Thank you. This is what I have been trying to say for so long. The aspects of her behaviour that people are seeing as her being suspicious or involved are ADHD traits! I know because I get them too! The first thing that tipped me off to it was the leg bouncing. My leg bounces like a duracell bunny for no reason but also when I am in a very serious situation and have to concentrate. Getting times muddled, being very perseptive but not always to the right things (like red flags), and yes, explaining away said red flags. "I see the red flags and paint my nails to match" - heard on a tv show.
Easier to manipulate, love bomb and gaslight, ADHD, especially in women can come across as ditzy.
ADHD brains work entirely differently from non-ADHD brains. An NT person would find the sum of 5X9 by memory or by doing the calculation in their head, yet some people with ADHD would times 5X10 (as that is easier to remember) and then take 5 away.
 
I’m sorry. I just can’t get behind the idea that ADHD has anything to do with her suspicious and inconsistent behavior. I also have ADHD — and while her bouncing leg and the lip biting could be ADHD-related… that’s about where that explanation ends for me. I often appear calm in a crisis but that’s only because I’m hyper focused on the problem — to the detriment of everything else. I would have never been able to just sit idly by at my house talking to news reporters while the rest of my family was out looking for my daughter. I would’ve been out pounding the pavement like a chicken with its head cut off. I have major problems with time management (like guessing how long it will take me to do something—and I’m perpetually late as a result), but my memory works just fine.

Regardless, ADHD presents differently in everyone (just like anything else).
 
Deil's advocate here, I see a different story.

JS says she doesn't like them sharing a bed, yet allows "sleepovers" as she needs to sleep.
Why would it be a "sleepover"? It made me think of when my eldest daughter came to stay and kept my youngest up watching movies, being silly, laughing, and messing around. They would have sleepovers to take the movie and noise elsewhere. After a particular time, I would have to be the bearer of bad news and stop the party as the youngest needed sleep. Yet, I would either take my eldest aside OR TEXT HER to ask her to get the little girly to bed, so it wasn't so mean mummy is killing the party kind of thing, and my eldest would gradually wind down and get the younger one teeth brushed and in bed within the next 10 minutes.

SS is many things that I won't say as I'll get in trouble, and one of them is a man-child and could be playing on that to display some innocent reason for his behaviour.
I can easily see SS doing this, getting MS excited, being childish, watching videos, and most importantly, annoying JS while she is trying to sleep, likely very sleepy from meds, annoying her until the point she says, "Turn it off" or "please be quiet," which may cause a hyped up MS to ask for a sleepover with SS because she's having fun (Obviously, I am not saying the victimization SS inflicted on her is fun, I think he made it fun so MS would ask JS for a sleepover, obviously not knowing what happens when she is unconscious or sleeping deeply). JS starts to sleep while sending texts, saying, "Tell her to go to bed now." Likely, their movies and noise keeping her awake. SS doses up MS to get her unconscious, and there we go.
Both females are asleep without a care, with a poisonous rat slinking around.
The difference being it was your eldest daughter, I.e. the sister, rather than this case in which is was a grown man with no relation to Madeline whom she was on again/off again with. Pretty substantial difference there.
