Pulse trial jury will see, hear graphic evidence from shooting
Opening statements begin Wednesday

"ORLANDO, Fla. - ...Judge says 'there has to be a limit' to graphic evidence

The government filled a motion Sunday requesting to introduce part of a 90-minute recording by a victim from inside the club during the shooting, during which Mateen can be heard pretending to talk to other people, saying that he had an explosive vest on and that he had co-conspirators with him. The motion also included a request to include two 911 calls made by victims and police radio transcripts.

The government asked to include the particular recording of the gunman because it said it proves "the nature and scope of Mateen's attempted provision of material support" and "the reasonableness of the law enforcement response to the attack."

Defense attorney Charles Swift argued against playing the audio from the 911 calls, saying the jurors will already be seeing six photos of "bodies in puddles of blood" in the bathroom.

"They basically paint a horrible picture of people bleeding to death," Swift said of the audio.

Byron granted part of the government's motion and will allow part of the recording of Mateen and the police radio transcripts...

Some potential jurors were excused during questioning when asked if they could handle seeing graphic photos and video from inside the nightclub.

Who will testify....

It's unclear if Salman will testify.

Based on the discussions in the courtroom, jurors will hear from FBI agents, six officers who responded to the shooting, the hostage negotiator, a co-worker of Mateen's from his employer, G4S, Salman's uncle, a PNC bank employee and a pawn shop employee.

Defense attorney Charles Swift said in court Monday that jurors will also hear from a "broadcaster," which is likely Matthew Gentili, a local news producer, who spoke with Mateen during the shooting. The gunman called several area news stations during the standoff.

The prosecuting attorneys also asked to include radio dispatch from the first officer at the scene, Orlando police Detective Adam Gruler, who was working security at the club the night of the shooting. He exchanged fire with Mateen, but never entered the club. Sweeney said the audio will go along with his testimony...

What to expect during opening statements

Court is back in session Wednesday at 9 a.m....

No cameras are allowed in federal courtrooms.

Byron is giving each party 50 minutes to present their opening statements. He said if they require more time he will allow it, but will give them a 10-minute warning when they approach the 40-minute mark...

Salman's family arrived in Orlando this week. Several of them are expected to be there on Wednesday sitting behind her during opening statements. On the other side of the aisle will be some of the 49 victims' friends and family members."

Trial of Pulse Shooter Widow Begins: Noor Salman Told Cops Mateen 'Loves America, Likes Homosexuals'

"...In laying out the case against Salman, U.S. Assistant Attorney James Mandalfo leaned heavily on Mateen’s frequent viewing of extremist videos online as proof the soon-to-be shooter became “obsessed with ISIS.” Salman’s protestations to police that her husband would only use guns to protect himself — before she was told about the shooting — and her insistence that Mateen felt a kinship between Muslims and homosexuals because both groups faced discrimination in the United States marked some of the first moments when she would mislead authorities, Mandolfo argued.

The federal government turned quickly to terrorism as the motivation for the attack, noting Mateen’s calls to police expressing allegiance to the Islamic State and a post on Facebook identifying ISIS leaders by name to show an extremism the killer would not have kept secret from his spouse, especially since he’d been interviewed by the FBI for terrorist sympathies before and during the course of Mateen and Salman’s marriage.

Defense attorneys for Salman in their own opening statement argued that Salman remained in the dark about the shooting until it happened. Salman attorney Linda Moreno says FBI agents coerced incriminating statements out of Salman during 20 hours of interrogation the day of the shooting, noting none of that questioning happened with an attorney present and that none of it was recorded on audio or video...."

Noor Salman, widow of the Pulse nightclub shooter, gave her husband the “green light” to commit terrorism, a federal prosecutor told jurors on Wednesday.

“None of the victims that night knew the horrific events that were about to unfold. No one knew ― except for two people,” Assistant U.S. Attorney James Mandolfo said. “Omar Mateen and his wife.”

Salman, 31, is charged with aiding and abetting her husband’s 2016 attack on Pulse nightclub in Florida and obstructing justice. She has pleaded not guilty. In the courtroom, she sat between her two defense attorneys with a blanket in her lap, occasionally taking notes and sipping water.

- She knew his Islamic beliefs had recently become more radicalized.

- She knew he'd been watching ISIS propaganda videos with more and more frequency.

- He flat out asked her if she thought an attack at a nightclub or an attack at Disney would make more people upset.

- She was present when he made the financial preparations to provide for her after his death.

- She was with him when he was out driving around in the middle of the night casing locations, which included both Disney and Pulse.

- On the night of the shooting, he first went to Disney but there was a heavy police presence.
He left and went to Pulse instead.

- Earlier that evening, she sent her husband a text saying that if his mother asked her about his whereabouts, she would just tell her that he was out with his friend "Nemo".

- When the FBI showed up at her house early that morning, her first question to them when she opened the door was... "Are you here to take me to Disney?"

It sounds like she knew enough to pick up the phone and call the police and warn them... AT THE VERY LEAST. But, she chose not to notify law enforcement (or a friend, or a family member, or anyone) for whatever her reasons, and now 49 innocent people are no longer living among us as a result.

It sounds like she knew enough to pick up the phone and call the police and warn them... AT THE VERY LEAST. But, she chose not to notify law enforcement (or a friend, or a family member, or anyone) for whatever her reasons, and now 49 innocent people are no longer living among us as a result.

Thank you for the very informative info cujenn. I was a little confused, but after reading your post, I feel I have a better understanding of what the trial is about.
