*Status Hearing for both (@ 9am ET) – FL – Nubia Barahona (10) (Feb. 11, 2011, W. Palm Beach), (Victor Vocter (10) injured; had acid thrown on him; he was released from hospital 3/2/11) – *Jorge L. Barahona (43/now 50) (adopted father) arrested & charged (2/12/11) with 8 felony counts of aggravated child abuse with great bodily harm, 8 felony counts of child neglect & attempted murder (Victor) & charged (3/7/11) with 1st degree murder. Plead not guilty. $1M bond. DA will seek DP.
8/30/18 Update: Next Status conference hearings on 10/11 & 11/1.
10/11/18 Update: Next Status hearing on 10/18.
10/18/18 Update: Status hearing on 11/1.
*Carmen V. Barahona (60/now 67) (adopted mom) arrested & charged (3/6/11) & indicted (3/23/11) with 1st degree murder, 8 felony counts of aggravated child abuse with great bodily harm & 8 felony counts of child neglect with no bodily harm. Plead not guilty. No bond. DA will seek DP.
8/30/18 Update: Next Status hearing 11/1; granted motion to seal & for confidentiality order re documents.

Nubia died in 2011. Eight years ago.

1. 980 pages of evidence
2. Five million dollar settlement to Victor, twin of Nubia, paid by State of Florida.
3. Nubia's body was found with Jorge, he also tried to kill Victor.
4. Eyewitnesses to the abuse.

This is ridiculous that there is no trial date. But plenty of motions for attorney costs, investigative costs, trips to South America for research. Seriously?!

Nubia was 10 years old when she was killed. It is outrageous that her killer has not had a trial date since her death. Nubia was found on Feburary 14, 2011. Valentine's day.

The evidentiary hearings, depositions look like a lot of psychiatric treatment, mental health. It will really make me want to throat punch someone if this monster declares temporary insanity.

No trial date! Just another status update, probably for more cash for the court appointed attorney, paid by tax payers. Eight years, no trial date set! They want him to settle for life in prison, and he doesn't care. They don't want a trial.

No trial date set. This must be a record! Why is this entire situation dragging out forever? Since 2011!

There is a problem here. Why no trial date? Is it because Nubia was a female child, just a "throw away" with no family to advocate for justice for Nubia?

Since 2011! There is plenty of evidence, what is taking so long to set a trial date?!

I'm thinking it is taking so long @mickey2942 as this is a death penalty case. They've had a lot of evidentiary & motions hearings.... At least that's my guess. :)

There have been other death penalty cases that didn't take 8 years plus to set a trial date. Scott Peterson comes to mind.

The state of Florida wants them to take a plea. They won't. Stalemate.
 
Just posting to say I was thinking about these two kids (and not surprised it still hasn't gone to trial) just now.

I am not surprised either. The state of Florida is definitely not in any rush for this trial. It surprises me that the defendants are okay with this waiting game. I wonder if they are set up in a separate area at the jail.

It's really strange what's happening in this case. As far as I know in the USA the criminal justice system works pretty well and quickly!
I suppose the two defendants are not "normal" people (they must have some good "connections" that are helping them to avoid trial...)
Imho they should have been sentenced to life without parole (or more...) a long time ago*

*if found guilty...needless to say!

The problem is that the Department of Dysfunctional Family and Children services will be laid bare, with every single time there was an opportunity to save these children. And the abuse that they endured is directly a result of the bureaucracy of the dysfunctional system.

It is pretty clear that the State of Florida is not ready to let all of that information be released for public comment.

A side issue here, I believe that actual laws were broken, in regards to placement of these children.
