ORLANDO, Fla. - On the fourth day of Markeith Loyd’s sentencing, the defense continued to get jurors to avoid the death penalty for the man convicted of Orlando Police Lt. Debra Clayton.

Forensic psychologist Dr. James Campbell said after evaluating Loyd, he diagnosed him with chronic post-traumatic stress disorder caused by a long list of traumatic events that included being beaten and abandoned by his mother, seeing his cousin shot and die and being robbed at gunpoint while working.

Markeith Loyd has complex post-traumatic stress disorder resulting from years of “chronic” trauma, an expert witness told jurors weighing the death penalty for the convicted killer of Orlando police Lt. Debra Clayton.

PTSD caused Loyd to constantly be in an “on-guard survival mentality,” said James Campbell, a clinical psychologist. Before Clayton tried to arrest Loyd at the Walmart on Princeton Street Jan. 9, 2017, for killing his pregnant ex-girlfriend, he believed police were going to kill him and his enhanced “flight or fight” response was already engaged, Campbell said.

Another traumatic event that contributed to Loyd’s PTSD was being kidnapped as a teenager and beaten severely, Campbell said. As a young adult, he saw others being killed, including another inmate during his time in federal prison, the psychologist told jurors.

“Each traumatic experience you have, your PTSD can get worse and worse and worse,” Campbell said.

After Loyd got out of prison, he worked multiple jobs, including as a delivery driver for Texas Fried Chicken in 2016, Campbell said. Loyd became “hyper-vigilant” after being robbed at gunpoint during a delivery and began carrying a gun, he said.

Loyd has testified that he was in “warrior mode” when he shot and killed his ex-girlfriend Sade Dixon and her unborn child after an argument outside her home Dec. 13, 2016, in which she pulled a gun on him.

Defense attorneys began Thursday’s testimony with a clinical psychologist, Dr. James Campbell, who examined Loyd to evaluate him for PTSD and trauma.

“Mr. Lloyd spoke about very intense emotional experiences that he had as a child in relation to a couple of movies, specifically, one of them was Roots, another one of them was Mississippi Burning,” Campbell said. “They were again, racially motivated, systemic violence, systemic racism.”

Jurors are also hearing from a detective who was there the night Loyd was arrested by Orlando Police in 2017. The detective said Loyd said he was in pain, but he was not taken to the hospital or treated by paramedics.

Judge Leticia Marques also granted the defense’s request to strike an aggravating factor that Clayton’s killing was especially heinous, atrocious or cruel, saying the state did not meet the burden of proof.

This penalty phase is really draaaaaagging! Today is the second time judge interrupted defense testimony to give fading/sleeping jurors a break! So much repetitive testimony! Geez! I know it’s his life on the line but I fail to see how boring the jury to death will accomplish Lwop! I think he will get Lwop anyway because the crime was not particularly cruel and heinous or premeditated. And the victim didn’t suffer. If you add up all his crimes, I still don’t think you get 12 jurors to agree to a death sentence!

But we still haven’t heard state’s rebuttal!
 
Yes, agonizing and annoying penalty phase. I agree, the recommended sentence will probably be LWOP because at least one juror (likely several) will not vote for death.

Patricia Loyd, Markeith Loyd’s mother, talked about how her husband Robert, Markeith’s father, had anger issues and once sent her to the hospital after hitting her in the eye.

She said she admitted him to a mental health facility when Markeith Loyd was younger because she wanted him in there because of his anger and he was dealing drugs.

I have seen Lazarou testify in a few other trials. I disagree with most of her opinions but I am fascinated by her ego antics.

I am so annoyed that they cut the feed last Friday during defense’a argument to exclude Lazarou. It looks like state is not calling her. I was looking forward to her take on ML. Although I believe she was going to say he’s a psychopath like she did in the John Jonchuck trial. I am also fascinated by her ‘ego antics’ —- haha great description! She’s quite a study herself!
 
Ha! 'ego antics' is my polite description of Lazarou. She sure is entertaining. I'd love to have detailed results of a forensic psychiatric evaluation of her. o_O

I, too, missed the defense argument to exclude her. The defense kept alluding to this but I figured the state would prevail. Yep, she'd likely testify that her expert opinion is that Loyd is a psychopath.

Interesting tidbit about her at the Jonchuck trial. I attended some of that trial and watched Lazarou testify. When another expert testified, Lazarou sat in the gallery directly in front of me. Wow. . . antics galore! She was furiously writing notes and nodding her head sideways a lot, indicating disagreement to the testimony of the other expert. The bailiff (eventually) came over to her and told her to stop her nonverbal antics! She didn't even acknowledge the reprimand, but thankfully she stopped the facial antics.

Markeith Loyd had tossed two guns out of the abandoned house where he was hiding and crawled toward law enforcement with his hands out, but Orlando police Lt. Jonathan Cute told jurors Monday he was scared of the convicted cop-killer because Loyd’s arms were tense and he wouldn’t follow commands to look at the ground.

Cute said he also thought Loyd “was not prepared to give up” because he wore a bulletproof vest and could have been hiding another weapon in his waistband. The lieutenant testified that he kicked Loyd’s face and saw another officer step on his forehead before they arrested him.

“I believed in my heart that Mr. Loyd was either going to kill myself or one of the other officers there,” he said.

Four OPD officers punched, kicked and hit Loyd with their rifle muzzles in a beating that caused him to lose an eye — and were eventually cleared of criminal wrongdoing and exonerated of using excessive force.

“You kicked Mr. Loyd hard enough to conceivably kill him?” asked Allison Miller, Loyd’s defense attorney.

“I don’t know that — I’m not a doctor — but I definitely hit him as hard as I could,” Cute responded.

Neuroradiologist Geoffrey Negin, a state expert, told jurors he reviewed Loyd’s brain scans and found it to be “pretty much normal” despite some scarring that could be due to age. A defense expert previously testified the scarring was likely from physical trauma.

The state then began its rebuttal argument, calling several witnesses. One witness, Officer Jonathan Cute, who has been with Orlando police for 20 years and was part of the SWAT team when Loyd was arrested, testified that he thought Loyd might have had a weapon when he crawled out of the house.

In tears, he told the court, “I believed in my heart Mr. Loyd was wanting to kill me.”

Internal and Florida Department of Law Enforcement investigations previously cleared the officers involved in Loyd’s arrest.

“It was a 19-month long investigation,” said Stacy Salmons, who works for the state attorney’s office in the 18th district, of FDLE looking into the use of force in Loyd’s arrest. “Through the course, we at my last count conducted 132 interviews.”

On Monday, the jury heard from Loyd’s daughter Kianna, who got emotional as she testified she noticed something unusual about her father during one of their phone conversations while he was in a halfway house. She said Loyd was so afraid police were out to kill him that he asked her to buy him a life-insurance policy.

“He told me, 'when they kill me,' not if they kill me — when they kill me — he said do not pick up my body. Just leave me lie there,” Kianna Loyd said.

Loyd’s daughter Kianna also testified that she was young when her father went to prison but said she will always love and support him. She recalled a moment when her daughter, Loyd’s granddaughter, expressed how much Loyd means to her — even while in prison.

Good closing by Prosecutor Williams! I still think they don’t have enough for a DP verdict. I also thought the argument that ‘even if he was wrongly convicted for that particular drug case, he’s still guilty of selling drugs so it doesn’t matter’ was not a good one! Given the beating he got and the fact that ML has made unfair law enforcement practices an issue in this case. ML has succeeded, whether you agree with him or not, in making his “victimization” front and center throughout. Williams lacks the passion and conviction to nail someone like ML to the cross unfortunately - 2 things desperately needed in DP cases for closings! He has seemed detached to me throughout the trial and i know this is not his judicial circuit so that could explain it. Or it could be because he also knows he’s unlikely to get a DP verdict no matter what he does.

After hearing the closing, I’m guessing they didn’t call Lazarou as a strategic choice and not because she was excluded.

Jurors weighing the death penalty for Markeith Loyd began deliberating Tuesday afternoon on the convicted killer’s fate for the 2017 slaying of Orlando police Lt. Debra Clayton.

The 12-person jury deliberated for about three hours before retiring for the night. Circuit Judge Leticia Marques told them they will be sequestered in a hotel and reminded them not to discuss the case with each other outside the jury room.

Jurors will reconvene Wednesday at 8:30 a.m. to continue deliberations at the Orange County Courthouse.

Before verdict deliberations began, prosecutors argued Loyd had lived his life blaming others for his criminal actions in at least 10 violent felonies, including Clayton’s killing and the murder of Loyd’s pregnant ex-girlfriend Sade Dixon. Loyd’s mental illness has not been proven, Assistant State Attorney Ryan Williams said in his closing argument.

“What you’ve heard from Mr. Loyd is that nothing is ever his fault,” Williams said. “… It is Markeith Loyd’s choices that brought all of us here today, and we ask that for the first time you hold him responsible for his choices and vote to recommend a sentence of death in this case.”

But Loyd’s defense attorney, Terence Lenamon, argued Loyd has been diagnosed with post-traumatic stress disorder, psychosis and delusional disorder — mental illnesses that were heightened after spending 16 years in federal prison. Loyd, who is a paranoid person, takes a “kernel of truth” and turns it into a full-blown delusion, including his belief that police were trying to kill him, Lenamon said.

“If you believe life is the appropriate sentence, I’m asking you to please, please, please give him life,” he told jurors.
