Markeith Loyd's lawyers want the name of every officer who witnessed his arrest

"Attorneys for Markeith Loyd, who could face the death penalty if convicted of killing his pregnant ex-girlfriend and an Orlando police officer, are asking prosecutors to give them the name of every single officer present when he was arrested in 2017.

Loyd was arrested last January, about a month after the death of Sade Dixon and nine days after Lt. Debra Clayton’s killing turned the search for him into a multi-agency manhunt. Police eventually found him in an abandoned house on Lescot Lane...

Prosecutors said last month that they gave the defense all the reports officers on Lescot Lane the night of Loyd’s arrest wrote, but the defense attorneys now say there were other officers from other agencies there and they would like to be able to question them...."

"ORLANDO, Fla. - Markeith Loyd has finally been interviewed in the use of force investigation surrounding how he lost an eye the night he was captured.

9 Investigates discovered the accused cop killer was secretly moved to Seminole County sometime around June 1.

Investigators are withholding the details of that from Loyd's lawyers, and that could explain why Loyd and his defense team have been so vocal about this lately.

The use of force is not directly related to the murders of which Loyd is accused, but his lawyers have been using time in front of the judge in those criminal cases to demand access to details on what they claim was an unprovoked police attack on him.

Almost two years after Loyd was captured, there remains a mystery surrounding what happened between the time a police helicopter camera panned away and what body camera recordings picked up while Loyd sat in the back of a patrol car....

The defense is also asking for money to make a racial sensitivity video to show to jurors to try to keep the death penalty off the table."

"ORLANDO, Fla. - The lawyers of a man accused of killing his pregnant ex-girlfriend and an Orlando police lieutenant said they want his trial delayed because the state has run out of money to pay for his legal defense.

Experts hired to testify on Markeith Loyd's behalf might not be paid, something defense attorneys said is a violation of state law....

He was supposed to go on trial in September in connection with the murder of Sade Dixon and their unborn child, followed by a January trial in connection with the murder of Orlando police Lt. Debra Clayton.

The start of the trial for Dixon's case has been postponed until May. A start date of the trial for Clayton's case has not been set yet....

Lenamon's recently filed motion said the Florida Justice Administrative Commission is experiencing a $16.4 million shortfall and that the resulting inability to pay people to testify on Loyd's behalf "is not only unreasonable and unacceptable, but a violation of state law."

Lenamon said he will file a more detailed motion supporting his request for a delay soon.

Loyd's next court date has not been scheduled."

"ORLANDO, Fla. - Attorneys for accused double murderer Markeith Loyd were denied their motion to further delay the trial at a hearing Tuesday morning.

According to court documents, about three dozen pending motions are scheduled to be addressed during the hearing, which began at 9:30 a.m. Chief Judge Frederick Lauten's first order of business was to deny to motion for a stay on the trial.

A motion that was approved, however, was Loyd's attorneys' motion to receive more documents relating to Lauten's involvement with the case. Loyd's attorneys said they wanted to review the documents in order to potentially file a motion for Lauten's recusal....

Loyd was originally scheduled to go to trial in September on charges in connection to the killing of his pregnant ex-girlfriend, Sade Dixon. That was to be followed by the murder trial in the shooting death of Orlando police Lt. Debra Clayton in January.

Last month, Loyd's first trial was rescheduled for May 2019, but a date was not set for his second trial...."

"ORLANDO, Fla. — Sade Dixon’s mother is coming to the defense of her daughter after a lengthy day in court, as the defense team for Markeith Loyd has asked for access to an Instagram post from Dixon....

The defense wants access to an Instagram post that shows Dixon with two guns. This will be key in their strategy to show Dixon’s knowledge of guns.

But Dixon’s mother Stephanie made sure to tell Spectrum News to not believe how the defense is painting her daughter.

“Shooting guns, carrying guns, making her seem to be a '.' She is not a . She was born and raised a middle class, straight A, B student, commendable in all ways. She would give you the shirt off of her back,” said Stephanie Dixon-Daniels.

“We believe this is evidence that is extremely relevant to show … her and my client’s knowledge of her awareness of guns and the use of guns,” said Terence Lenamon, defense attorney.

But social media requests were just a small part of Tuesday’s hearing, where more than 70 motions were hashed out...."

"...Details of Loyd’s final phone calls as a free man were revealed in a report obtained Wednesday by the Orlando Sentinel, released by prosecutors after they publicly confirmed for the first time last week that wiretaps were used during the manhunt for Loyd.

In a September 2017 letter to the Sentinel, Loyd claimed police were listening to his conversations and knew he wanted to turn himself in and give the $125,000 reward to Dixon’s family, but that officers beat him anyway as he crawled out of the abandoned Lescot Lane home in which he had been hiding.

His defense attorney Terry Lenamon repeated that claim in court last week, saying jurors should be able to consider it if they have to decide whether he should be sentenced to death or to life in prison. His trial in Dixon’s killing could start in May, and he faces the death penalty if convicted in either her death or Clayton’s...."

Markeith Loyd's attorney wants judge to recuse himself from case

"ORLANDO, Fla. - Attorneys filed a motion Friday requesting Chief Judge Fred Lauten to recuse himself from Markeith Loyd's case.

Loyd's attorneys said they filed the motion because Lauten signed several warrants during the time Loyd was at large, including his arrest warrant....

Earlier this month, Terence Lenamon, Loyd's attorney, asked Lauten to place a stay on court proceedings while he determined how much involvement Lauten had in the case before Loyd's arrest and how Lauten was assigned to the case.

"Judge, I need you to back away from this case and provide me the information I am requesting so I can make a determination whether or not we can raise, in good faith, a motion to recuse," Lenamon said earlier this month.

Lauten denied the motion....

Loyd's attorneys filed a motion this week, saying Lauten signed six search warrants and authorized wiretaps of phones used by Loyd and others while Loyd was at large....

A hearing on the motion has not yet been scheduled."

"Markeith Loyd's girlfriend said she helped him hide after he allegedly killed Sade Dixon, his pregnant ex-girlfriend.

Dixon suspected Loyd was seeing another woman, which is one of the reasons they were arguing in the days leading to her shooting death.

Dixon wanted Loyd to come home, but Jarquil Turner, the other woman whom Loyd was dating, said he was with her.
urner said she loved Loyd enough to put him up in a Motel 6 in the Fairview Shores neighborhood while he was at large.

"Ms. Dixon, she had already ... passed," Turner told a detective after Loyd's capture. "I told the marshals I did help him get ... a room to stay in while he was on the run," ...

Turner was never arrested...."

"ORLANDO, Fla. - Investigators said they caught Markeith Loyd's niece in a lie, and that it proved she had been talking to the accused cop killer and lying to the police about it.

She's one of several people who were interrogated by detectives in a set of newly released recordings, which show how desperate police were for clues while Loyd was at large.

Police pushed hard to find Loyd and whoever was helping him hide.

"Over the past couple weeks, *advertiser censored*'s hit the fan," a detective told Lakensha Smith-Loyd, Loyd's niece. "It's really hit the fan."

Deputies were blunt with Smith-Loyd the day she was arrested and accused of helping hide one of Orlando's most wanted suspects....."

Recent depositions revealed the potential existence of a use of force investigation dealing with Orlando police Lt. Debra Clayton's decision to confront Loyd in a Walmart parking lot, which resulted in a shootout.

Loyd's lawyers accused investigators of "emotional crossover, which may have caused them to fail to scrutinize the actions of Clayton's response."

In other words, they said there was a botched investigation after Loyd was captured and Clayton was dead....

"ORLANDO, Fla. - Accused cop killer Markeith Loyd appeared in court Wednesday afternoon to try to obtain raw footage of an interview Channel 9 conducted of his niece.

Loyd is accused of fatally shooting Sade Dixon, his pregnant ex-girlfriend in December 2016, and Orlando police Lt. Debra Clayton in January 2017.

Loyd shouted multiple times during Wednesday's hearing.

"I know the law," he said.

"Oh, I know the law, too, Mr. Loyd," Chief Judge Frederick Lauten said.

Loyd said there is a massive conspiracy against him, that he is being framed and that news media are telling lies about him.

He said he told his niece to tell Channel 9 that Dixon was armed the night of her fatal shooting and that he acted in self-defense....

His trial for Dixon's murder is scheduled to begin in May."

"ORANGE COUNTY, Fla. - Markeith Loyd, who is accused of killing his pregnant ex-girlfriend and a police officer, caused thousands of dollars in damages Wednesday at the Orange County Jail, sources told Channel 9's Shannon Butler.

Loyd is typically polite and well-behaved at the jail, but he became disruptive, the sources said....

Before a court hearing Wednesday, sources said they believe Loyd was going to make a phone call in a dayroom where other inmates were making calls.

Sources said corrections officers heard a loud noise and Loyd had torn a phone from a wall. They said he was behaving erratically and shouted, "I am the son of God!"

They said he broke glass in the room and destroyed a television and an iPad.

Sources said Loyd continued to be violent and corrections officers could not make contact with him or come close enough to spray him with pepper spray, but they tried to talk him down.

Members of the jail's special response team were able to get Loyd to return to his cell without further incident, sources said.

After that incident, Loyd had several outbursts during a court hearing...."

In November, voters approved Marsy's Law — a constitutional amendment allowing victims the right to a speedy trial, just like defendants....

... Marsy's Law changed the Florida Constitution after voters approved it as Amendment 6 on the election ballot.

For the first time in Florida, victims have the right to “proceedings free from unreasonable delay.”..."
