Markeith Loyd to appear in court for competency hearing (with clip)
Accused killer recently completed mental evaluation

August 22, 2019

"ORANGE COUNTY, Fla. - The man accused of killing his pregnant ex-girlfriend and an Orlando police officer will appear in court Friday to discuss the results of his mental health evaluation....

A judge granted Loyd's attorneys' request for the mental health evaluation, ordering that it be completed before the court rules on other motions, such as whether to combine the trials related to the deaths of Sade Dixon and Orlando Police Lt. Debra Clayton.

Loyd's attorneys claim he's exhibiting signs of paranoia and delusional thinking.
Originally, Dr. Sandra Davis was slated to complete the evaluation, but it was reassigned to Dr. Sonia Ruiz for an unknown reason.

Ruiz's evaluation, which will not be made publicly available, will include her observations, findings, methods and opinion on whether Loyd has the rational understanding to consult with his attorneys. She must consider his ability to appreciate the charges against him and the legal penalties he faces and understand the legal process, among other things.

If Loyd is found incompetent, then Ruiz must recommend treatment and issue her opinion on whether he could be found competent in the future.

The hearing is scheduled for 10 a.m. Friday. It will be livestreamed in the media player at the top of this story."

Markeith Loyd found competent to stand trial; murder trials won't be combined into 1 (with clip)

Aug 23, 2019

"ORLANDO, Fla. - A man accused of fatally shooting his pregnant ex-girlfriend and an Orlando police officer was found competent to stand trial Friday during a competency hearing....

Loyd's competency was drawn into question earlier this month based on a motion filed by his lawyer, Terry Lenamon, and Loyd's pattern of courtroom outbursts and rants.
Judge Leticia Marques reviewed the findings of a court-appointed psychiatrist and agreed that he is competent to stand trial.

"He was aware of where he was, who the parties of the courtroom were," she said. "He followed my directions, he gave his version -- albeit a truncated one -- of what happened the day of the shooting."

Marques also denied a motion to consolidate the murder trials during Friday's hearing.

Loyd's lawyers were split on the decision, but he said he had wanted separate trials.

The trial for Dixon's alleged murder is scheduled to begin Sept. 27."

State releases witness, evidence lists

August 26, 2019

"ORANGE COUNTY, Fla. - As the first trial approaches for accused double murderer Markeith Loyd, the state is preparing its case.

On Monday, prosecutors filed a case management response outlining the witnesses that will be called and the evidence that will be presented as Loyd stands accused in the fatal shooting of his pregnant ex-girlfriend, Sade Dixon.

We also know one thing that won't be discussed during that trial: Orlando Police Lt. Debra Clayton's death. Judge Leticia J. Marques ruled in July that the state could present evidence that Clayton and Dixon were shot with the same gun but it cannot tell jurors that Clayton died as a result of the shooting or play surveillance video from outside the Walmart where the shooting occurred.

Right now, the Dixon trial is set to begin Sept. 30 and the Clayton trial is set for May 2020.

Here's what we know so far about the prosecution's Dixon trial plan...."

With trial days away, lawyers for Markeith Loyd seek to disqualify judge for ‘bias and prejudice’

SEP 18, 2019

"...In a motion filed Tuesday, Loyd’s attorney Terence M. Lenamon argued Circuit Judge Leticia Marques “prejudged” Loyd when she presided over a case involving his then 20-year-old son, Markeith Damengzlo Loyd, who was accused of robbery, attempted carjacking and burglary of a conveyance with battery.

Marques determined at a hearing Jan. 25, 2018, that the younger Loyd was insane at the time of the crimes and adjudicated him not guilty, court records show. During that hearing, a doctor testified the young man was “exposed to his father’s drug use and emotional abuse” and Marques heard about the “negative influence” his father had on him, Lenamon wrote in his motion.

Marques told the younger Loyd, who is currently hospitalized, he would not be allowed to contact his father if she released him from confinement, the motion said. The judge also asked the son’s family to make sure he would have no contact with his father.

“You can’t call him; you can’t go visit him; you can’t write him letters; you can’t see him,” Marques told the 20-year-old, according to the transcript.

Lenamon argued Marques’ prohibition against the two having contact demonstrated she developed “bias and prejudice” against the older Loyd before she became the presiding judge over his murder cases.

“The Court clearly formed a highly negative impression of Defendant, so much so that the Court deemed it necessary to repeatedly ensure that Defendant’s son would have no contact with him,” Lenamon argued. “The facts ... have led Defendant to develop a well-grounded fear that he will not receive a fair trial.”..."

Markeith Loyd has 'multiple traumatic brain injuries,' attorneys say

September 19, 2019

"ORLANDO, Fla. - Markeith Loyd, charged in two shooting deaths, has suffered multiple traumatic brain injuries, according to a notice filed Wednesday by his defense attorney....

Loyd's first murder trial is set to begin with jury selection Sept. 27 and the trial for Clayton's slaying is set for May 2020. This week, Loyd's defense attorney, Terrance Lenamon, filed a series of motions, including the notice of a possible brain impairment that could delay the first trial's start. Loyd faces the death penalty if convicted.

"Loyd suffers from complex trauma as well as neurological deficits as well as multiple traumatic brain injuries as well as a disorder on the psychotic spectrum," according to the notice.

The notice doesn't say how Loyd suffered these injuries; however, when Loyd was captured and arrested on Jan. 17, 2017, he was beaten by Orlando police. The OPD later released helicopter video of the arrest showing officers kicking Loyd....

According to Archer's analysis, four Orlando police officers delivered multiple blows to Loyd as he was lying face down outside a house on Lescott Lane, where he had been hiding. Those blows included kicks to the face and muzzle strikes with OPD rifles to Loyd's body, according to the Florida Department of Law Enforcement review.

Lenamon wrote in a motion filed Thursday asking for a delay that Archer's investigation shows bias, along with multiple statements made by FDLE investigators during the use of force investigation....

The defense also filed a motion to exclude information that when Loyd was arrested he was in the possession of two firearms and a bulletproof vest. According to the motion, these weapons were not used during the shooting of Clayton and should be admissible."

Markeith Loyd's request for new judge denied
Hearing scheduled for Wednesday morning

September 24, 2019

"...Loyd's attorneys filed a motion last week claiming that Judge Leticia Marques was biased against Loyd because when she was trying a case involving his son, she ordered that he not have contact with his father.

The state responded to that motion saying that Marques based that decision solely off a doctor's recommendation.

Transcripts show Dr. Jacqulyn Olander testified on Jan. 25, 2018, that Loyd's son tended to act out after spending time with his father and the two had an unhealthy relationship due to Loyd's drug use and emotional abuse.

Jury selection is slated to begin Friday morning as Loyd faces trial in connection with the fatal shooting of his pregnant ex-girlfriend, Sade Dixon. He'll have a second trial next year to face charges related to the shooting death of Orlando police Lt. Debra Clayton.

During a pre-trial hearing Wednesday morning, the court will discuss the state's request for special jury instructions, a motion regarding the scope of opening statements and a motion to compel complete notice of mitigating circumstances."
